ptsd Staggered Ratings
I wish I had the time to give a more indepth post explaining staggered ratings- I believe they are often overlooked by veterans and their vet reps. For example a vet can have a disability of 10% that eventually is awarded to 70% then TDIU is granted and the medical evidence can in fact show that staggered ratings were in order for the progression of the disability. This case I posted for the new member with Hodgkins disease is a good example: http://www.va.gov/vetapp06/files3/0610464.txt This vet did not get what he wanted- however this claim- like many many denied BVA decisions contains key legal points that the BVA made in coming to their decision. …

Cue
Veterans and friends of HADIT, I was diagnosed with a disease in service and had surgery. my SMR are negative for any conditions prior to service. I was denied SC at first attempt then granted SC on second attempt for same condition. Is the a basis for CUE that refers to the presumption of soundness or other statute? Thanks for your input

Phony Iraq Vet
a local vet almost slipped running up my deck to give me the Army Times- July 30, 2007 On the cover is a picture of Richard McClanahan in full uniform and highly decorated- after 2 tours in Iraq- and one tour in Afganistan. The US Distrcit Court in Norther District of Texas has charges against McClanahan of bank fraud, felony, and two misdemeanor counts of falsely claiming military honors he did not receive- he claimed receipt of 3 Silver Stars, 3 Purple Hearts, and also the MOH (Medal of Honor) I guess the full story is at Army Times on line- The article- "Chest of Lies" brings up other instances of deceit by wannabees caught by the FBI- it pays to c…

Filed Claim/hodgkin's Disease
I filed my claim electronically on 06/03/07. How long should it take to get a rating? Since it is a presumptive disease I would think it should get fast approval or am I dreaming? I have seen where one gets rated at 100% during treatment and for six months after. At that time it says you will be rated on residuals, what does that mean? It is amazing at the information I have been able to get through Hadit. Thanks to everyone who contributes. I am going through chemo at the present time and then will get radiation treatments. It has not been fun so far, the side effects are the worst thing. Any info or tips would be appreciated.

Retro Pay
When I received my partial award letter it showed how much of an increase I would have on a monthly basis. A Rep from tht VARO called me to answer an IRIS email question and told me how much my retro would be. Ok, no problem, I got it direct deposited via VA. So today, I get in the mail a US Treasury check wihich says VA Comp on the check. So why did I get this addditional money? Who do I call to find out why I have this? I.E. I submitted a reconsideration late last month and even if the VA approved it, I doubt they could get me my additional pay that fast. So do I call the VARO and ask why? Usually thoes people that answer the 1800 rarely can tell me anyth…

tinnitus Lack Of Evidence For Va Claim
I filed a VA claim for hearing loss around 1989. The claim was denied all the way to the top. The reason for denial was the lack of proof in my medical files. I had a an audiometric hearing exam at my enlistment, but only had a whisper test at my end of enlistment exam. I was in the Navy from 1967-1971 and worked as boilerman and engineman. Both jobs subjected me to loud noise more so in the boilerman job. There was no hearing conservation program plus there were no hearing protection items to be used. In my VA claim I brought out the fact that my lack of evidence was not through my fault. I stated that the Navy did not provide proper hearing protection or audiometric tes…

ptsd Dmii Presumptive And Secondary Erectile Dysfunction
My cousin was in the AF and in Vietnam 68-69. During that period he went TDY from Ton Son Nut AFB in Saigon to I Corps and found me and my unit (I was in the Marines) and spent 3 days with me before returning to Saigon. During that 3 day timeframe we were attacked, rocketed, and mortared almost the whole time and spent most of the three days sharing a fox hole with me. He literally crapped his pants and afterwards participated and helped with the bagging of bodies also. He now has DMII and has had erectile dysfunction for the past two years. He has never filed a VA claim and didn't know. I am helping him file his claim for DMII and I found the DC for that under en…

Need Some Advice
I am helping a friend with his claim. He filed a CUE on a claim denied in 2000. He filed in May with his vet rep. He sent in the specific reasons that this was a cue, and sent in evidence that was in the record at the time that was not used , and pointed out several erroneous statements made by the VA. He got a letter today, it is the same flippin type of letter he got in 2000. It is asking for new evidence and is stating the same erroneous information that was in the original. His injury is combat related. What gives ? This was a CUE on the original. It never went past the RO. I thought that new evidence was not allowed on this type of claim. What should we do no…
