Unclaimed Claims
If you attend a C/P for one issue and the doc also opines/comments on an issue that he or she finds which is secondary to an already SC issue does the RO have a duty to go ahead an award SC for the secondary issue without you having to file a claim. Example: Vet has C/P for a left hip injury which is not SCed at the time. During C/P doc opines that he does not see any connection to service and the left hip injury. However, the veteran is having a problem getting in and out of a chair and bending beyond 45 degrees due to extereme back pain stemming from the L5 area which is more than likely connected to the right hip injury. 100% Pay Rate
I wrote my senator and told him that a 20 year old permanently and totally disabled single vet gets about 2300 dollars a month. In my city it is almost impossible to buy a house, a car, and pay for the basic ammenities of life on 2300 a month much less support a family and raise kids. These youngsters are at a major disadvantage as are all disabled vets. Unless you have some other income you will find it hard going on even 100%. The rate for 100% disabled vets should be doubled and then maybe it would compensate for the loss. Houses and condos in my neighborhood go for around 300,000 bucks. How does someone making 2300 a month pay a mortgage, and insurance for a place to …

Just Received My Brother C-file
Hello all: You might remember that i had writen several months ago about my brother. He has been receiving a NSC Pension for many years, But didn't know why. Today i received a copy of his C-File to see if he had filed a claim with the Va or what. He had filed a claim for a back condition and nerves back in 1973. [ he was discharged in 1971] In the C&P exam the examiner said that his c-file wasn't available at the time, But my brother had reported a fall with injury to his low back and recurrent back pain since then 2 months before discharge in 1971. Ssoc
I had a DRO hearing in Mar 07, however, I have not heard anything as of this date. 1-800 guru's tell me "the file is with the appeals team". Anyone have any experience with a SSOC after a DRO hearing or brave enough to take a guess on the time between the DRO hearing and the issue of the SSOC. Just dreaming but maybe I will get a rating decision Vs a SSOC. I did say that I was dreaming didn't I? hahahahaha

When I Received My Partial Award Letter
Greetings Vets, Friends & Family of Veterans, I think I may have asked this question before, but I apologies, my memory , etc is lacking. When I received my award letter, it stated on 2 of my 3 major issues that they have "permanently Worsened" as a result of SC. The issues are migraines and depression. On both issues they awarded me a 30% for each and it said this was a full grant of benefits. I guess I am still confused, if it is permentally worsened then why were the 2 SC conditions rated only at 30%? Is it because I have a fairly “good” GAF? My Motion for Reconsideration has been Granted, and as of 16 July 2007 it is now before the Expanded Reconsideration Panel. I've only won Half of the Battle, and now all I can do is await the Final Decision. I would be lying if I didn't admit that I am Thinking the Worse and Praying for the Best. Mental Evaluation
Since I have never received a mental evaluation before can anyone please explain what this thing means? I did not request it they just did it during my last visit to Birmingham. This is what it states: Vet suffers from nightime panic attacks that onset in 2005/ At that time vet learned that his grandaughter was being molested by stepfather (his daughter divorced that man an moved back in with vet and his wife.) seh is still living there with her three children. vet suffered a stroke at that time (service connected) and was anxious acout his own health. ptsd Rec'd "reply Needed" Letter From Va Today
The good thing is that I have finally recieved something, meaning they have not lost my claim. The letter states that they are working on my application for; Then it list all my SC disabilitis, then adds they are working to service connect for depression secondary to your service connections and ptsd. (I agree with all of this) My question is, the next paragraph states that THEY are amending my claim to include cerebellar gait(secondary to Meniere's Disease) and GAD as well as increased service connected compensation based on individual unemployablility(IU). All, as some of you may recall from one of my first posts, the Army DRB upgraded my discharge in 2006. Last week, literally just three days after the VA awarded me 30 percent and deferred on other issues, the Army Board for the Correction of Military Records decided my case. The opinion some 28 pages in length, reversed the discharge, ordered reinstatement to the US Army until my proper date of discharge in 1992; ordered back pay and allowances at the highest rank held; removed all references to the discharge from my files; remove a final adverse EER and directed certain other actions.
