Question on ratings table
If a claimant already 100% schedular for a single disability/condition, why is the VA allowed to use the combined ratings table to get to the 60% needed to get an SMC(s) award?? From what I've seen in cases I've read, at the BVA & CAVC, the VA never lets it get that far. The way I see it is that claimant is already rated 100% and shouldn't have use the combined table. Once you are 100% the next ratings should be just added to total the 60% but that's not what the VA does. If anyone can explain it to me, I'd appreciate it.

Most Veterans dont hire a professional until/unless they are unable to or frustrated by the long delays with a VSO. At the CAVC level, generally, lawyers will receive their compensation from EAJA fees. To make this happen, you need to appeal a BVA decsion within 120 days and no more. Many Veterans have grown tired of denial, delay, more denials, more delays. Its what the VA does. There are 2 legitimate organazations you should know about. I have used both of these, and found them to be top notch. They are NVLSP and NOVA, links provided below: 1. NVLSP Free Legal services. (Pro BONO). Some examples: You are a Nehmer Vet (generally that means you served in Vietnam, or overseas, but ask, if unsure). Agent orange. "Bad discharge". Superior Canal Dehiscence
Situation- I have been suffering from serious ringing in my ears for roughly the last decade or so along with very sensitive hearing. Among those symptoms, I have a slew of other issues that are currently unimportant to this post but some of my other issues were vertigo and occasional memory loss. After countless trips to the doctors, audiologists and ENT's I was finally diagnosed with tinnitus and hyperacusis. VA is involved in still another scandal, according to Ben Krause
Ben Krause is a disabled Vet himself, also an attorney, who is a Veteran's activist.
