Pending HLR
While my higher level review for my hearing loss is awaiting service connection Ive been getting evidence all lined up which cant be submitted for the review very annoying. Ive been deemed eligible for the 3M settlement for my hearing loss and tinnitus by Brown and Greer who is handling all the 280 k claims. Is there anyway to submit their medical findings into evidence now or do I have to wait for the denial first?

SMC QUESTION..SMC T
What do you think the odds are that I will get SMC-T awarded by the BVA, Bronco? Laska (in for Haskell) v McDonough has not been decided yet. CCK seems to be taking SMC cases. I just sent my signed fee agreement to them yesterday. I think I may qualify for SMC-T. Was denied SMC period by the AOJ on January 22, 2024. Have a nurse supervising my care and medications, including filling the medication dispenser once a week. She also ordered community care occupational therapy and physical therapy. Will get her help to get housekeeping, possibly from the senior center and someone to cook a meal on weekends. Need watching because I take a seizure medication.…

I have been told that a C&P examiner can retain only a limited amount of information. What information may be retained and where do I find such a rule (e.g.: "M21-1 Adjudication Procedures Manual"). Thank you in advance.

Cervical Spine Rating
Greetings How would my service connected cervical spine be rated? THERE IS REVERSAL OR NORMAL LORDOTIC CURVATURE OF CERVICAL SPINE WHICH MAY BE RELATED TO MUSCLE SPASM OR TRAUMA. HYPERTROPHIC CHANGES ARE SEEN IN THE CERVICAL SPINE. THERE IS NARROWING OF THE DISC SPACES BETWEEN C3 AND C5 AND POSTERIOR SPUR FORMATION IN MULTIPLE LEVELS. THESE FINDINGS INDICATE SPONDYLOSIS. SAH Grant SNAFU
So, I was approved for the SAH Grant last year without even asking for it when I was awarded a single 100% rating for LOU of both feet (yep, I got the automobile grant, too). At first the lady from the VARO in Nashville was hot and heavy about it and I had a home visit scheduled very quickly. The day came and she was a no show. Question on ratings table
If a claimant already 100% schedular for a single disability/condition, why is the VA allowed to use the combined ratings table to get to the 60% needed to get an SMC(s) award?? From what I've seen in cases I've read, at the BVA & CAVC, the VA never lets it get that far. The way I see it is that claimant is already rated 100% and shouldn't have use the combined table. Once you are 100% the next ratings should be just added to total the 60% but that's not what the VA does. If anyone can explain it to me, I'd appreciate it.

Most Veterans dont hire a professional until/unless they are unable to or frustrated by the long delays with a VSO. At the CAVC level, generally, lawyers will receive their compensation from EAJA fees. To make this happen, you need to appeal a BVA decsion within 120 days and no more. Dont wait the full 120 days, it does take time to enlist the services of a NOVA advocate professional. At least some Veterans hired "unaccredited agents" and did not get a good …

How to find an attorney (for Veterans)?
Many Veterans have grown tired of denial, delay, more denials, more delays. Its what the VA does. There are 2 legitimate organazations you should know about. I have used both of these, and found them to be top notch. They are NVLSP and NOVA, links provided below: 1. NVLSP Free Legal services. (Pro BONO). Some examples: You are a Nehmer Vet (generally that means you served in Vietnam, or overseas, but ask, if unsure). Agent orange. "Bad discharge".
