“Demand to Pay” status?
I’m helping my MIL who refuses to call but once a month or so to check on her deceased vet husbands claim. She keeps getting conflicting information. She was told in June her claim packet would come in July and that he was going to be paid out on at least 5 claims dating back from Vietnam. He was exposed to Agent orange and ultimately passed 4 years ago from complications. He’s been fighting for this for almost 15 years. In July she was told her claim was in Demand to Pay status. Still nothing. We’ve searched all over the web and found no information about what this status means. Anyone heard of it?

100% P&T, should I stay in Reserves?
I have been granted 100% P&T and was rated this after I joined the Reserves. I am happy with my rating and do NOT want to lose it at all cost. The Reserves however gives my family great Tricare health insurance. I want to keep Tricare by being in the Reserves, BUT absolutely do not want to lose my 100% P&T by just risking it being in the Reserves. The Reserves does PHA's through LHI and I really don't want to risk anything at all. I am truly 100% P&T by having many many separate conditions but am so paranoid and untrusty of the VA because I know they will take it away at any chance they get. Basically I want to stay in Reserves for TRICA…

ptsd 100% Total And Perm. Or Unemployability. (Ptsd Claim Question)
Hello Fellow Vets. I recently had a C&P exam for PTSD (among many other things). However, I had a question that I was curious about. I submitted a claim for TDIU but after looking at the Dr.'s notes via Myhealthevet, I am curious to find out if it is possible I that would receive a 100% scheduler rating, even though I submitted a claim for TDIU, based on the Dr.'s notes. I have copied and pasted the majority of the document for your viewing. I am currently rated at 70% for PTSD and 90% total. Thank for your help, opinion, and service. -Brad "Given the chronicity of this veteran's diagnosed PTSD and associated features of depression, at the current time he wo…

1st VA claim, presumption of soundness Q's
I found your website. I have never posted anything asking anyone about this but I'm finally doing something about it and desperately need some advice. The question specifically has to do with my physical exam at MEPS and the presumption of soundness attached to it. If I am found 100% physically fit and did not have to sign any waivers, how can I have a disability existing prior to entry discharge for a physical disability not previously noted at MEPS or in any previous records? Am I correct that unless otherwise noted at my MEPS examination, any physical injuries thereafter besides something congenital had to have occurred in service? As in nothing was noted …

3 Points Needed to Prove Adjudication Made a CUE
Hello Defenders of freedom! I have a question pertaining to this denial for headaches. The decision letter is quoted below. 3. Service connection for headaches. "We may grant service connection for a disability which began in military service or was caused by some event or experience in service. Your STRs are negative for any treatment of or diagnosis of headaches. On your post-deployment exam in 2005 you denied any headaches. On separation, you denied any headaches. VA treatment records are negative for any treatment of or diagnosis of headaches. On VA exam, the examiner stated there was no evidence of any residuals of a traumatic brain injury…

ptsd 30% For Ptsd And Why Not 50%
I received 30% for ptsd in Feb 2013 and the used the GFA of 62 from 9/2012 and not the GFA of 55 they VA dr's have used for the last 19 months. The VA regional office said to get to 50% I would need these 6 things: flatten affect, panic attacks, difficulty understanding complex command ,impairment of short term memory, imparied judgment, disturbances of of motivation and mood and difficulty establishing social relationships. I have in the A psychiatrist flatten, panic attacks more than 2 times or more a week, disturbances in motivation and mood and difficulty in social relationships. this is all in the va doctors notes for the last 2 years. It seems they took most of the info…

38 CFR 4.114 - Pyramiding GERD & IBS
Has anyone here ever received a separate rating for GERD and IBS? I had claims for Diverticulitis, IBS & GERD, and it appears that they have lumped Diverticulitis and IBS together, but GERD is its own condition and I'm trying to figure out why. The IBS claim was not listed in my STRs and it is claimed as secondary to SC anxiety. This was backed up by my VA doctors, and should be rated at a 30%, but the raters combined it with Diverticulitis and gave it a SC 0% rating (will be appealed soon). GERD was listed in my STRs and I have two VA Doctor's medical opinions that it is worsened by SC anxiety. The original claim was due to the diagnosis in my STRs, and it…

70% rating under non service connected status on eBenefits
I submitted a claim that was denied this past December. I then received a letter at the end March from the VA stating I had a week to called back and schedule a C&P exam. I called and scheduled my C&P for the following week which was the beginning of April. I attended the examination for PTSD, Depression and Anxiety. After the exam the examiner said the VA would make a determination with in 60-90 days. It has now been 9 weeks. I called the VA Friday. The VA rep said it was "Decision Approval" stage and them he muttered Final Review. He said there were "couple steps after this on and I should be notified shortly" I checked eBenefits. Now I am confused. I…

ACE Exams - How Long Does It Take To Advance a Claim?
I ask questions on this forum from time to time for two of my Vietnam vet, AO disabled brothers. One recently filed a new presumptive illness claim (cancer) and as part of the Evidence Gathering phase was told there would be an ACE exam. That was exactly three weeks ago. Since then he's heard nothing. The VA website still shows as Evidence Gathering. We have submitted online all of his medical reports, biopsies etc, so on this end we are just waiting for the VA to take the next step. Any idea on how long we should wait before we contact them (800 number) and ask if there is a delay? Thanks in advance for your advice and assistance. Max
