It Used To Be That The Va Did Not Share Your Medical Info
I just found that the VA billed my Insurance company 8,000 plus. It used to be that I felt my Medical Info was not available but since they put in a claim for me I am sure that they have to share all my medical information. By the way my Insurance denied the claim :D

Dock Williams, Plaintiff-appellant V. Robert Finch, Secretary Of Health. Education And Welfare
This was a U.S. Court of Appeals case, Fifth Circuit - 440 F.2d 613, decided March 17, 1971. Perhaps someone could put up a link to this case because it provides an interesting definition in 42 USC of substantital gainful employment. V.A. also uses this same term in some of its regulations. The case is found at www.cases.justia.com/us-court-of-appeals/F2/440/613/352580 This veteran's claim for Social Security was denied but on appeal he won.

Veterans Advocacy Tips
Advocacy Tips (from the same link as Broncovets previous post) 1. Many of the written arguments VA receives in support of claims for VA benefits from veterans’ advocates do not appear to appreciate that the principal reason a written argument is submitted to VA is to persuade the VA decision maker to rule in favor of the claimant. Everything that appears in a written argument must focus on persuading the VA to grant the claim. Anything that does not help persuade VA to rule in favor of a claim should be omitted from a written argument. 2. When a veteran’s advocate files a written argument with VA on behalf of a claimant, the advocate is presenting the VA decision m…

What Do I Do To Prove My Secondary Conditions?
I'm sort of at the beginning states of my VA disability claim. I suffer from anxiety/panic disorder. I also have insomnia and ulcers I know are a result of the panic disorder. I am not very good at going to doctors and I hate meds. I'm not sure how to prove to the VA my secondary conditions. My recent letter from them states "Submit medical evidence on your current insomnia and ulcer disabilities as well as evidence showing a connection of these and your panic attacks condition. We will consider service connection for insomnia and stomach ulcers as secondary to panic attacks. Note: temporary or intermittent flare ups of a condition are not considered aggravation, unless t…

Claims Checklist:
Link: http://www.pva.org/site/DocServer/SOAR_Vol...pdf?docID=12444 Appeals Checklist & TipsIt is important for anyone appealing to the Court of Appeals for Veterans Claims (Veterans Court), to be sure to present all issues and arguments in the opening brief. An appellant cannot wait to present them to the Court in a replybrief because the Court will not consider them. Courts, including the Veterans Court, “have consistently concluded that the failure of an appellant to include an issue or argument in the opening brief will be deemed a waiver of the issue or argument.” Carbino v. West, 168 F.3d 32 (Fed. Cir. 1999). See also Fugere v. Derwinski, 1 Vet. App. 103,…

hypertension Va May Be Cheating Vets With It's Calculator
Here in Atlanta our VA is so far behind that it send simple stuff to other states to process. Recently my records were sent to Seattle, WA to be processed. Now this is funny becasue it has to be to keep me from snapping. I have been fighting VA for 6 years on this one request for increase. In February 2004 I was approved for increase from 40% to 80%. They rated me wrong so I appealed. One year later my quadricep tendons snapped, SC for knees. I never recovered. I was already rated 10% on each knee for instability. After my right leg became basically useless, I was given another 10% on my right knee. I was ruduced to 60% and with the 10% moved back to 70%. I was still awai…

Berta - Wings -tbird - Certification And Training Of Employees
CERTIFICATION AND TRAINING OF EMPLOYEES OF THE VETERANS BENEFITS ADMINISTRATION RESPONSIBLE FOR PROCESSING CLAIMS. I am very interested in trying to find out if there is any way we could get hold of a copy of the VBA CERTIFICATION EXAMINATION even if it was like a pre-test. Also a copy of whatever study information VBA employees are provided to learn whatever VBA requires them to in order to pass this examination. I wonder if there is incorrect information contained in their training and study materials. I would almost be willing to bet there is. I WONDER IF THE UPDATED CERTIFICATION EXAMINATION HAS BEEN DONE YET AS VBA HAD OVER ONE YEAR TO DO SO.…
