Question About Rating
I haven't had much to do with the VA for 30 years. I never thought I would need to be looking at a rating increase. Here goes: I was sent to a medical board in 1978 after 6 years of service in the Air Force. I had crushed my ankle and had 3 surgeries while on active duty to repair it. Left the AF with 20% rating at the VA and went on with my life. Today, I am much much older (59) and the old bones have decided it was time for them to give me grief. My ankle is full of arthritis and I also have a mal-union of the tibia and fibia as a result of the original facture. Hard to believe I have had this all these years and only now is it keeping me from walking too far…

tinnitus Tmj
I have a TMJ problem that has already been considered service connected at 0%. I have had two surgeries at the VA to attempt to fix it but nothing has helped. I also have facial pain and constant headaches that occur frequently. I get 10% for my tinnitus but the problems in my jaw make the ringing in my ears extremely loud and I sometimes get very dizzy and have to sit down. I am not sure what type of claim I can put in for this. Any help would be greatly appreciated. This is what my MRI says about my jaw and I have no idea what it means. Right: mild osteoarthritic changes with minimal subchondral sclerosis and spurring of the mandibular condyle. In th…

Knock Me Over With A Feather
I posted on wed. I was unsure about filing a NOD on my Jan '09 decision. Well, I did. Hand delivered the papers to the RO wed. afternoon, got a signature and came home. 150 miles round trip but worth it. Out of curiosity, I called the 800 # this morning at 11:15 AM to see if it was in the system yet.I was told that this morning a DRO had requested a hearing on my NOD. I couldn't believe it, so I called again and was told the exact same thing. I was told on the second call that it will be after the first of the year before a hearing can be scheduled. Talk about the speed of light. I didn't know the VA could move so fast. Do you think there is a legit reason for this o…

Just Got Original Claim Decision, But What Path To Fix 3 Non-awards?
I don't know how to go now: NOD vs appeal vs hearing vs CUE vs whatever, for the following problems: 1) When is an informal claim not a claim? 2) How better to connect left knee to right knee & flatfeet? 3) Conditions that VA deferred? What would you suggest as an approach to resolving these issues, and should I try to correct just 1) and 2) related to the current award, or go after 3) at the same time? Does sending in new information help or can I only do that based on which appeal route I go? Seems like what I want them to ask them to do is to use all the SMRs and IMOs provided, instead of blowing them off. Have been DITY so far (not working with …

Vcaa Amended
http://www.thefederalregister.com/d.p/2009-12-11-E9-29459 I proposed an amendment to the VCAA over 2 years ago-via Congressman Filner- Havent had time to see if this new amendment made the point of it--- I have griped for years to anyone who would listen that the VCAA itself has caused the backlog when the VCAA notice is not compliant with the regs. There is lots of legalize to the actual VCAA regs but still- if the VA skims over the regs and prepares a deficient VCAA letter (the first thing the BVA lawyers check when they get a case) and if that deficiency is prejudicial to the veteran or widow- the claim must be remanded for a better VCAA letter. A…

Buddy Letter
I don't know if this been asked before. I asked someone to please write a buddy letter and instead my buddy sent me a recording. I guess he felt more at ease making a recording than writing it. He states his name, address, ph.#, and service number. He provides details about the incidents that I had asked him to please confirm as having taking place. He states in the recording that if the VA has any questions to contact him by letter or phone. Would this be accepted by the VA? He has already done a lot for me and I hate to ask him to write it instead Anyone have any input on this question? 68mustang
