Submiting Claim
I am getting ready to send in my claim. I just want to make sure I'm doing everything to make it as easy for the VA as possible. I am filling out a 21-4138 stating what I am claiming. I was then going to provide a letter giving a little more background to my current problems listing them out (just a brief paragraph 5-6 lines) number them 1, 2, etc. Under each item I am going to list the date and location each time I was seen for the disability in my SMR and also after service up to current. I am also going to highlight in my SMRs and private medical records the items relating to my disabilities. I have all the medical records and am providing them to the VA so they don't …

Imo Qualifications/costs
My interests are very close to Rockhounds I started to add my experience to his thread but didn't want to hijack his thread. More Help On Another Reg
Looking for a reg that states something to the effect that: You do not have to have a confirmed diagnosis of a particular condition shown in SMR's - that symptomology of a disease shown in SMR's a diagnosis at a latter dates and a medical nexus connecting the two, should get SC granted. ptsd Need Help From Truckers Who've Been In Iraq.
A friend was killed, about 6 months ago, when his pickup swerved into an on-coming vehicle. He had been rated 100% P&T, in '08, for PTSD. He had active duty from 9/77-9/80, 3/03-6/03, 6/03-1/04 and Army NG from 3/03-4/04. He'd been to Iraq where he operated trucks, in convoys. His wife put in for DIC, stating his death was caused by him falling asleep due to his VA meds, but it was denied. No surprise. Death certificate states basically multiple trauma due to MVA. Myself and other friends feel he either committed suicide or perhaps was having a flashback to when he was driving in a convoy. Medical Retirement.
My Brother was hospitalized recently for an emergency and treated by Army Doctors. He lives in El Paso and the closest VA Hospital in in Albuquerque NM. The Army Doctors though that he probably had cancer or was loosing blood. He was diagnosed with psoratic arthritis was given cortisone injections in feet, ankles, back, knees and lower back. Seems like he had severe anemia from it also. Since he has a 10% rating for psorasis and a 10% rating for arthrititus we are going to ask for a higher rating. First your original topic sited TITLE 45. I am sure this is in reference to Title 45, CFR as Title 45 of the US Code covers Railroads. Title 45 my friend pertains to Public welfare. ptsd Tdiu Fastrack?
Long story, everything with the VA seems to be. Anyway after 40 years I have went from 10% with no kiss. To recently 80%, 50% PTSD and 30% GSW (gun shot wound)R (right) arm. So I files for IU (individual unemployability for fellow PTSD'ers) July 14th 2009. Sept 10th 2009 I recieve the standard letter stateing they are working on my claim and giving me 30 days to submit further eveidence. tdiu Just Got Perm 100% - Have Questions
Hi Everyone, After getting turned down by social security twice I figured I couldn't wait the 1 year for the appeal because I needed money. I did appeal the case anyway because I haven't gone back to work as of yet. I had been waiting for my convalescent leave since March for my service connected back. I had filed for TDIU because this was my second surgery and I had a 3 level fusion done with cages, etc. So I start interviewing for positions. I have doubts I can even last an 8 hour day. On 3/18/08 my claim for reflux disease and to finally get my request for a decision which had been deferred for over a year on my PN in my legs resolved. My PN on 8/21/2009 was denied . After reading my 1st C&P Progress Notes i found on page 21 section 3 that the examiner stated that the lower extremities was most likely aggravatesd by DM. This was also stated for my claim for ED.
