Letter About Appeals
UPDATE: Got a letter today for a C&P exam on Tuesday for 4 year old appeal. What do you think will happen now? Especially since they told me my appeals had been established in the appeals program. Has anyone ever got a letter from the VA that stated: "Your appeal is established and acknowledged in our development/claims tracking program. However, your appeal hasn't been established in the appeals program. We apologize for any inconvenience that this oversight may have caused. A copy of this inquiry has been forwarded to the appeals team to ensure that your appeal is established in the appeals program." They have had my appeal for over 4 year…

Hysterectomy
Hello everyone, I was just informed by my current doctor that I need to have a hysterectomy. I'm scheduled for surgery on Oct 6. I'm a little worried becasue I just started my current job about 11 months ago and I was told I will need to be out for about 2-8 weeks for recovery. My Supervisor stated my position is secure ( I pray she's telling the truth), but I will be on leave without pay for the duration of my recovery. I don't have enough sick or annual leave to cover the time off (used most of my leave for doctors appt and VA appts). I'm currently rated at 80%. I still have a claim out for bilateral feet problems (the Rater didn't address the issue during the …

Update On My Claim For Eed
I won (on appeal) 20% for residuals of medial meniscus tear that I claimed immediately following my discharge in 1994. It was dated effective from my "reopened claim" in 2006. I had been (unbeknown to me) 0% for it since discharge in 1994. I filed an appeal for an effective date of the date of my discharge in 1994 based on talking about it on here. VA claimed I never showed for an exam and had a postmarked letter saying it was undeliverable in 1994 and I never heard from them after I filed although I collected GI Bill for 3 years after, bought houses, etc. My appeal was (thanks to Berta and others) not that they rated me 0% due to failure to appear for an exam (altho…

tdiu Chronic Fatigue Syndrome And Sleep Apnea
I want to thank all that have answered my post about an increase rating. I have been doing some research on Sleep Apnea and Chronic Fatigue Syndrome. I would appreciate opinions on the following: From the CDC site: http://' target="_blank">Other Conditions That May Cause Similar Symptoms "In addition, there are a large number of clinically defined, frequently treatable illnesses that can result in fatigue. Diagnosis of any of these conditions would exclude a definition of CFS unless the condition has been treated sufficiently and no longer explains the fatigue and other symptoms. These include hypothyroidism, sleep apnea and narcolepsy, major depressive dis…

ptsd Gulf War Illnesses And The Cover Up
Gulf War Illnesses and the Cover up Posted on August 30, 2009 by dsnurse by Denise Nichols, Staff Writer How Do I go on? I am not sure. I ask all my veterans and civilian friends to unite and further distribute news of all the facts. The Gulf War Veterans are ill and are DYING! This is beyond sitting and just reading. The Government now for 18 years has refused to respond in the appropriate manner to an issue of life and death. This insane situation must come to the full light of day! Most of the Gulf War Veterans feel it is just like Agent Orange or the Atomic Veterans, not enough of us have died yet for the government to tell the truth. They feel the gov…

Ndaa 2010 - Agent Orange Equity Act Of 2009
Include the Agent Orange Equity Act (HR 2254) in the 2010 National Defense Authorization Act NDAA 2010 - Agent Orange Equity Act of 2009 Take Action! Include “Blue Water Sailors” Please send the following editable message to your Representative and Senators-- I strongly urge you to seek inclusion of the Agent Orange Equity Act of 2009, (HR 2254) into the 2010 National Defense Authorization Act. This legislation would expand the legal presumption of exposure to Agent Orange for veterans who served in the vicinity of Viet Nam. Before 2002, it didn't matter where a veteran served in the Vietnam War. If disabled due to the exposure to the terrible poisons in the air and…

tdiu Just Your Opinion On A Medical Examination.
I am workin on a claim for tdiu and I understood that my private Dr. had schedualed an emg for evidence to support the claim. I have recently found out that an emg is not going to be done but an exam by the emg Dr. is to be performed. How much weight if any will this have on the claim as far as approvial is concerened without an emg? My private Dr. said he would write a letter to the va after the visit with the emg Dr. with the facts that were found. How much can the emg Dr. tell about my condition withou an emg being performed? My Dr. knows I can't work anymore and I haven't worked a day since September 2005. I may be answering my own question here as I don't think the …
