Some Vets Get Shot At Medical Retirement
Week of March 21, 2011 Approximately 70,000 veterans who were given a medical separation between September 11, 2001 and December 31, 2009 have the chance to have their separations reviewed and possibly changed to a medical retirement. The reviews are conducted by the Physical Disability Board of Review, which will examine each applicant's medical separation and make a recommendation to the respective Service Secretary based on their findings. Although there is no guarantee that applicants will become retirement eligible, there is no risk of veterans losing their existing benefits. To be eligible veterans must have been medically separated with a combined disability rat…

Foia Request
I am so mad right now I can barely write this. Aug. 17 of last year I submitted a request for copies of information in my C file of information from April to that point to my VARO. At that time, I had a remanded appeal from August 2010 and IU claim from early 2011 there. It became apparent they were treating the request like a claim and I became concerned there were holding off the decision process for it. On Nov. 22 and Dec. 12 (after I had seen the Aug. 17 FOIA request still showing as a claim) to two separate fax numbers at the VARO I faxed in letters rescinding any outstanding FOIA request I might have that would impede the decision process.. I started seeing on Ebe…

Mental Health & General Medical C &p
Should my wife go with me to these exams ? My wife is from Costa Rica and English is her second language that she is still learning. She is very personable and sociable, but she may misunderstand something said or say something that could be misunderstood. She would have to take two days off work to go with me because the VA unit is about 4 hours from our home with exams on Thrs and Fri. The VA paid for the hotel room Thrs night. Also what pertinent records should I take, the latest progress notes, the most important, etc. Thanks Paul

Question About Medical Opinion
Asking for clarification: I thought the purpose for a medical opinion is to determine service connection. In 2008 I retired with 20 years and did the BDD program while in Germany. I was given service connection for three issues at 0% each. I immediately sent in my NOD and like most it was never received. Eventually I got it in and in 2009 got my appeal in. I had my date with the BVA and a VLJ, remaneded in 2010 for further development (C&P) for an increase in the three issues as the previous C&P was inadequate. I have been to two C&P's since: one terrible, one favorable. The 800 number said decision made waiting for 2nd signature then a week later s…

Bva Denies My Cue For The 2Nd Time
The BVA denied my CUE for the second time today. My CUE was on remand from the Court to fix some technical errors, but I thought they might reconsider. So now I am pretty sure my lawyer will take it back to the court to get a decision on the merits of the case. How long, Lord, how long? John

Freedom Of Information Act (Foia) Helpful Information And Instructions.
Hello All, We have seemed to run into a subject thread and I feel posting the FOIA information will help all of us to understand it and the vehicle and mechanism on how it works.... The National Archives and Records is the big one to search records so let her fly. I am going to post some of my actual FOIAs from many departments and their responses so that our veteran community can see how hard it is to get your hands on some records. Jbasser and Jerrel Cook and I have come to the same conclusions thru many denials of FOIA. If the veteran is getting a request that is sensitive to national security , especially opening records that will cause harm to the DOD and government …

Single Veteran
I am the Federal Fiduciary for my brother's VA Benefits. He is wondering if he should pass away, the money in his checking will it go back to the government or be left in his estate. He does not currently have a savings account, but if this keeps it in his estate he will plan on starting one. He has never been married and both of his parents are living. Thanks

Base Maps
Hey y'all. Me again. :) I'm looking for old base maps. Hubs was stationed at a few places many years ago, and we are trying to locate maps to prove that he was in certain locations on the map. Any ideas? I've got a good one of Tooele, but coming up short on Fort Ord and Seneca. I've found a couple of smallish, fuzzy ones but I need maps that show specific locations on the base. Thanks again.

Call From My Lawyer
Did not not where to post this, but yesterday I got a call from my Lawyer. He was telling me that he has tried for 2 weeks to get a hold of someone from the Houston RO regarding my claims and appeals. Now, I realize that the VA can ignore everyone. BTW, I'm changing my middle name from Wayne to Wait. Papa

Veterans' Benefits In Limbo After 10 News Investigators Uncover Another Mistake
"ST. PETERSBURG, Florida -- There were three stories from the 10 News Investigators, two letters from Congressman Bill Young, and one admission from a member of the Cabinet that the Dept. of Veterans Affairs was making a potentially costly typo. Yet, after eight months, the VA still hadn't fixed it. In a story the 10 News Investigators first broke in April 2011, the VA has been sending out outdated medical reimbursement forms to hundreds of thousands of pension-eligible veterans and family members. Instead of receiving the 41.5 cents per mile for medical visits, mandated by Congress in 2008, the VA had been sending out forms with 20-cent and 28.5-cent rates. The …
