VA found an error in their duty to assist
I just received a letter regarding a higher level review that says the VA has found an error in their duty to assist. Has anyone else ever receive that letter? If so, how’d yours turn out? I have received many letters from the VA but nothing like that one. Still waiting patiently…

SMC S awarded never paid
I was awarded SMC S and have not been paid. I submitted a claim for compensation and was told to submit VA Form 21-2680 my problem is I was awarded this in 2012 back dated to 2010. I received a increase in compensation but did not know of the monetary benefits of SMC S. I am afraid that the “VA” is attempting to award in 2018 and not pay retroactive. I was also told when I called the 800 number that it was a mistake and I did not rate SMC S.

Claim consolidate
A few questions. I filed a claim for my increase rating of hypertension and heart attack secondary. So months later when I put in some pact act claim they moved like 5 conditions into this claim. I called the Va and she confirmed that, not like I couldn’t see it but wanted to know why….those will hold up my original claim. Is there a way to get that changed? I’ve already have the exam for my original claim increase bp and heart attack…. I also told them I had another heart attack last month and didn’t know if submitting that claim would mess up the current progress. She said just submit the evidence with the current claim. I want to ensure my 3 mon…

Veterans Law Blog strategy vs eBenefits
I studied Veterans Law Blog and he recommends mailing in your claim and organizing the documents like so (see attached). However, is this the old school way to do it? The only way to do this on eBenefits is to type everything out and attach it as a file in supporting documents. And it would be a lot of files

Va disability claim
I got out of the service in 1992. While going through separation I met with a Vso. They filed a claim for me but I never seen exactly what they filed, I did know that one was for my knees, (actually as I just found out it was for my left knee) had a c&p exam at the va and showed 3 things for service connection, they all said general skeletal except one was general nervous system and got 10%. Fast forward t o 2001 and started going to the va for my knees. But just recently I see they billed my regular insurance, called and asked why because it should be sc. she seen my disability letter and she told me she had never seen where it just says general not specific. I was t…

VERY strange C & P exam
Yesterday I drove 87 miles over an unplowed pass in a blizzard at 530 in the morning to make a c & p exam. The appointment time was 8am, but I was determined to be early so I showed at 740. But the drive isnt the weird part... I was scheduled to get evaluated for neck pain and GERD. The nurse was nice and drew my blood quickly, the doctor arrived and it was the same doctor I had 8 months ago in another town and he actually gave me my first service connection at that time. He starts with neck pain, does very fast measurements and basically then tells me I have no strong claim. I was claiming it secondary to TMD and had provided with a nexus (which he read) 2 appeals t…

P&T, is he safe?
Morning folks, Got a veteran who's IU P&T, whose conditions are worsening. He would rather have the 100% scheduler because he want's to work. Sadly, somebody has been telling this veteran to not "rock the boat" with the VA, and not file for an increase for his SC vertigo and hearing conditions. It's my understanding that unless there is some evidence of unlawfulness, that P&T means just that, Permanent and Total. The veteran is 62, if that makes any difference. Given the above, are there any reasons why the veteran shouldn't file in order to try for 100% scheduler? Thanks. Allan 2-2-0 HUAH!

Loss of Use
Hi, my husband’s health has poorly deteriorated and has been diagnosed with Functional Neurological Disorder. The doctors say he developed this because of his PTSD. He had severe PTSD and was an alcoholic. He attempted to kill himself many times before. He finally stopped drinking after therapy after many years but since December has developed this disorder. The PTSD was service connected back in 2011 at 70%. He is now experiencing loss of use of both lower extremities, Lou of right arm, he cannot see out of right eye and cannot hold bowel or urine. How should I go forward with his claim? Can someone give me some advise please. Thank you so much for any input because I’m …

Terrible News Posted On E-Benifits
I just checked my e-benefits and noticed some disturbing information. I submitted through the DAV at my local VA hospital for a temporary 100% for convalescent. (JULY 17,2013) I provided all information, date of surgery, discharge summary and paper work showing how long I would be out for convalescent. I also faxed in 1 month ago paper work that showed this was going to be extended for 2 months. E-benefits shows this claim was closed due to lack of paperwork submitted by date indicated. What the heck! It now says it is in the rating phrase so they can do a quick denial so they can chalk this up as another claim processed. So-I am going to have wait another 5 years…

ptsd Retired Bdd Program Question On Temporary 100%
My apologies for chiming in on your thread. I have a question hopefully someone can answer. I retired from the U S Navy in June 2010. I went through the BDD program to start my V A Disability claim process. One of my complaints was headaches that was recorded through out my SMR for 20 of the 23 year years I was in. I was electrocuted in 1988 on a living barge while my ship was in overhaul. I obsorbed 440 volts of electricity and was seriously burned with second and third degree burns on my arms, chest and face. The V A Doc who examined on my Benefits Disability at Discharge told me, the VA doesn't award for headaches. Well, I went and settled down to my home of records a…

Supplemental Claim for Sleep apnea
Hello all, I've tried to read up on this great forum... Probably should have done it sooner and would have helped with my claims but I don't quite understand all the acronyms and the process to be honest. I did all my claims online with no real help, tried reaching a VSO multiple times with no luck. I had applied for sleep apnea less than a year ago (Sept-18') as a secondary condition to the MDD (50%) but with confusion and a new job there was no sleep study just an interview for Chronic fatique syndrome which I also applied for. I was denied service connection for both sleep apnea and chronic fatigue syndrome. Since then I've been going to counseling and …

ptsd Dro Timeline?
I served from '68 to '72. I filed for severe hearing loss, tinnitus, and PTSD in 2007. I received 30% on the hearing and tinnitus. They denied the PTSD for lack of proving stressor incident. At that time I had no idea where to get copies of my ships logs as I had assumed they would get them. I did not file a NOD. I continued to be treated for PTSD by the VA for the next few years. As my condition seemed to be worsening, my Dr. asked why I was not receiving compensation so I could retire and alleviate some stress? In June 2012, I found the official logs of the incidents and re-filed. After a C&P exam they awarded 50% PTSD for a combined rating of 60% in September 2012.…
