I have a question. Am I entitled to look into the treatment my father received when he was sent to the VA in TN under duress from a nursing home?

This advice may be old news to some. Hopefully It will serve useful to those who are just delving into the VA claims ordeal. I think there are some great VSO's out there. For me, I went into the deal feet first. I didn't have the first clue what a VSO was or how to obtain one at the time. I filed a claim on my own in 1997, was denied and then just gave up. Seems no one really knocks on your door to tell you you may be entitled to something for your illnesses. The paperwork necessary to me was overwhelming (PTSD the gift that keeps giving). I knew I couldn't make it successful on my own. I had no direction. If you are first filing a new claim you may use…

I am disabled and drawing Federal Disability of $1170 a month. I filed for my VA disability pension rating over 5 years ago, denied due to VA losing my medical records and currently on appeal. I have filed for Aid and Attendance well over 2 years ago and was denied due to income limits. I do not understand the system and all I know is that it is working against me. I have given the VA all medical records and have given them my permission to access any other records they may need. I have Spasmotic Torticolis or Cervical Dystonia diagnosed by Emory Neurological (5 years ago Atlanta VA diagnosed this as somataphor disorder.), Severe Diffuse Idiopathic Skeletal Hypertos…

"For the People" out of Tampa, FL...I just wanted to let you ALL that they do VA Law. I was "searching" for an attorney and came across their website. A guy called me this morning from Morgan and Morgan and I told him I was looking for an attorney who did VA Law. He stated that Morgan and Morgan does these types of cases also. I told him I didn't see that info on the website. He stated that its under the SSDI menu and if you go there under SSDI look to the right middle ways down you will see Veteran Benefits. I advised him that link needed to be in the main menu because I looked and didn't see it in that main menu so I left the website but came back later to send in an in…

I was told about these guys by a good friend so I contacted them. I want to challenge a "pyramiding" decision I recently got back. They said I would be better off putting in a couple new claims and seeking an increase for my back, since I so close at 100% anyway. They said they would put everything together for me and wouldn't charge me a dime. Does this make sense?

At the start of the year I was awarded 100% P&T, and was over joyed. But, the VA would not pay my lawyer fees. My Attorney said the VA did not believe one letter was justification for the 20%fee. Of course, my lawyer has appealed. My lawyer also told me that I should just stay out of it, as it will be the VA's decision. My award was for PTSD, and to be honest the letter was not that strong, but was it strong enough for the 100%, torn. Papa

I was told but an attorney that crdp could be used as alimony whereas crsc could not. Could someone please enlighten me on issue? And if this is a true statement...then why because they both are compersations for injuries that occurred while in service. Thanks.

Hello everyone, I am having big trouble with my lawyers lack of faith in the strength of my case. I get this email 10 days after my SOC with my BVA form 9 due w/ 50 days left: (background is I have been mental paralyzed for the last yr. and a half and unable to do anything due to stress, anxiety, and a host of other things. As well as my brain having turned to mush because of meds) Perhaps if this is too difficult for you you should drop your appeal and try and reopen it another time when you are feeling better. Right now unless you get that doctor's statement and we produce some evidence of your whiplash, your case is pretty weak and we will not be successful. Thank…

I thought I would take a moment and share with all of you my experiences in attempting to secure legal representation for my wife in her VA claim. We had found a website with a number of "VA specialty" attorneys and were very fortunate (so we thought) that one was in our state and only about an hours' drive from the house. I initially sent this person an email and received a welcome reply from an assistant who gave the boiler plate response about successes and fees. Before sending any files or anything to this firm I asked if they had any references regarding their prior performance specific to VA issues. Let me tell you what, I received a response, not by the assista…

My cue claim at the CAVC is awaiting a brief from my lawyers to get this train on the track. This is the second trip to the CAVC and I think I will get some kind of decision in the next six months. In Cushman v Shinseki the VA altered a vet's record to avoid awarding TDIU. In my case the VA excluded evidence to avoid 100% and to allow them to low ball my award. Cushman went to federal court to establish that VA did not give him due process. I may have to go to the same place but why should I have to reinvent the wheel. Altering or excluding evidence results in the same violation of due process.

With my current law firm, I'm starting to feel like a mushroom. They will not respond to my emails, and when they call me back, it is to tell me that they are looking into things. I expect to be ignored by the VA, but not my own Law firm. Now, if I did change lawyers, what would be the impact of doing this? Papa

Is there a website....or can some one suggest a law firm where I can retain an attorney to fight the VA, RE 30 years plus of VA denials for my service-connected claims from my AO-related medical conditions? I tried Google and found several sites who seem to have potential to locate such an attorney, but so far....nothing. Not one attorney willing to take on my case. I appreciate any help/suggestions. Thanks -- Michael

I may come across as bitter, and if I do, I apologize in advance. Upon advice from the good folks here, I hired a law firm to help with my Social Security Disability case. The law firm I hired has had me submit the same paperwork to them on at least 2 occassions, and some documents I have had to send them 3 times. I almost never hear back from them, and the last time I heard from them was when I sent a nasty-gram to the named partner of the firm, complaining about the feeling of abandoment from his firm. He proceeded to tell me how my case would be difficult even though I am 100% SC disabled (mental illnesses), and another 30% SC disabled (physical illnesses). The VA V…

http://www.vawatchdog.org/07/nf07/nfJAN07/nf010407-10.htm "ATTORNEYS FOR VETERANS" LAW MAY BE OVERTURNED BY NEW CONGRESS -- Legal advocacy group claims backroom deal will allow legislation to "be introduced in the next session to repeal that portion of S-3421 that would permit attorney representation." The information comes from a Bulletin-by-Fax newsletter from the Workers Injury Law & advocacy Group (WILG). Their web site is here... http://www.wilg.org/index.asp It seems there was a backroom deal in the 109th Congress to pass the "Attorneys for Veterans" legislation, then have that law repealed by passing a new law in the 110th Congress.…
