Hi y'all- I'm new... please bear with me.... I have PTSD & had a meltdown in Jan. while working on my claim. ( Been doing an excellent job of Avoidance for 20+ years and it came back at once - danged therapists...). Got put on a 72 hour hold including state mandated transport in a cage car to facility. Anyway- The ambulance company, AMR, didn't bother to pick me up for 9 hours after they were called, then sent me a bill for $3500 for taking me 88 miles. (for that amount I should have gotten strawberries and champagne on the trip) I sent them the VA information. I got another letter from AMR. I saw a website for a lawyer that specializes in VA and SS disability cases. He says on his webpage that sometime the award can go back further than the date of filing. Can this be true? I though the law changed and that the date was set to the date the claim was filed. If it can go back further, would the following set of circumstances warrant go back before the file date? I'm strongly considering turning my case over to a lawyer, so I want to know what is the incentive for a lawyer to get my case closed quicker rather than later? If they operate on a percentage of the recovered funds then doesn't it make more sense for them to let it drag out a bit to increase their cut? I have a natural distrust of lawyers. The only incentive I can think of is to switch law firms if I think that it is lasting too long, then I would think that they get nothing and that the new firm would try to get it closed out quickly in order to collect the check with little time involved. I would like to hear of anyone's experiences suing Tricare for first committing to a hospital or physician to pay for services, and then reneging on that commitment. Were you successful, did they pay the charges, plus any attorney and court costs? Who was your attorney? I can briefly discuss details, if needed. The surgery was for a service connected back injury, but performed in a civilian hospital by the veteran's preference. Right now, we need an attorney familiar with suing Tricare.

Hi, I recently won a claim and I sent my attorney his contingency fee (30%) out of my direct deposited back monies check. My attorney had it set up so I would get all the back claim money and I would would then pay him myself. I did that last Friday. When I returned from mailing his check and checked my regular mail there was a U.S. Treasury check -- for not much less than what I had just sent (same day --weird). I thought, what's this? There was no letter. There was an attached check stub that had some writing on it and part of it read: ATTYFEES. (Obviously, that stands for Attorney Fees.) But there was no reference to VA. Just want to get some opinions here. I just had SC surgery at VAMC Asheville in January. This past Friday, coincidentally the 13th, I had my final follow up with the surgeon. He just now tells me that as a result of the surgery, I will be on a 5lbs lifting restriction for the rest of my life. My surgery was to "repair" an abdominal hernia with incarcerated colon caused by a right nephrectomy that I had while in service. Now the doctor tells me that the "repair" is holding, he does not know for how long, and if it fails, it will not be repaired again. Hence, the 5lbs restriction. usually it is a good idea to shop around but wanted to ask if it is a good idea to submit a VA claims denial to a few of the legal groups who represent vets. such as these two: www.legalhelpforveterans.com http://www.veteranslaw.com from Internet research they both appear highly recommended. i was thinking of sending both my claims denial and compare notes as to fees, and responses, etc. or should i toss a coin and just go with one?

I served in the 1st Marines in Korea and fought at the Chosin Reservoir. I have 100% VA disability status. I recently went to the VA in Massachusetts for a routine colonoscopy procedure which ended in disaster. During the procedure, the VA Dr. ruptured my spleen. I then had 4 hour emergency surgery where my spleen was removed. I have not been the same since and I am still recovering from the ordeal. Any guidance on how I can pursue legal action would be greatly appreciated. Thank you!

It is always best to get all the evidence you can whether you chose to hire a lawyer or not.

There is a group of Attorneys,(who kick Butt) located in Montgomery,Alabama. I just eMailed them to see if they would be taking on the VA-helping us with our claim. Might help if Vets would sent them eMail asking for there help. i found this lawyers site on jim strickland and sent them a copy of my lowball rating at amc. i received notice from them on veterans day they are looking into my claim. said would take two to four weeks to evaluate. i think they are the ones i am going with if they decide to take it. i am glad i did not jump on another lawyer that contacted me and said would represent me even though they may be good just dont know . fauson i think is the guys name for legal help for veterans . i was wondering if any body may have heard or used them. i am just kinda following my instincts

I received results of MRI and xrays of C-T & Lumbar spine today. Currently rated at 10% for spine disease which is a joke. Well, I went ahead and hired an attorney. I know I reached 30% on my own, pretty much. Now I am awaiting a DRO hearing on a rating increase. Plus, I was denied tinnitus recently and have a claim for typhus going back to 1971. That I want to reopen. The atty., won't cost me out of pocket, only 20% of any award, nothing prior or future. They also handle any IMO'S, that are needed. They must feel I have a case or they would not have taken it. I think it will take a lot of pressure off me. Have not signed any papers yet. Any feedback, would be appreciated.
