Hello all. To the Hadit Elders, if this is in the wrong forum, please feel free to move to the appropriate one. I submitted a FTCA to the VA last year (springtime 2007) for some botched dental work that ultimately caused me to loose a tooth unnecessarily, which was confirmed by my civilian dentist. To add insult to injury, after dealing with this VA dentist for 5 months trying to get rid of an abscess that had infected my gums and asking him for fee base service to see a local dentist, he denied it and sent me to a VA facility over 400 miles away (roundtrip) for a Endo/perio consult to get a crown after the Endo/perio. Well needless, to say it was too la…

I was told told that there is a case before congress because the Va is taking the benifit money from vets who got out early and recieved compensation. Can some one tell me how I can keep informed on this. I was also told that Hadit.com has lawyers that can file a case for me pro-bono. Any help on this?

Predictions are that gasoline will hit $4.25 a gallon by the end of June. Not having to drive 20 miles to work everyday may be the best thing that ever happened to me. What a disaster. My neighborhood already has "For Sale" signs in front of every other house. We need a real increase in compensation and not just a cola. This reminds me of the early 70's when inflation began to take off and the oil shock hit us. If you have a twenty gallon tank you will be paying close to 90$ to fill up soon.

I just got off the phone with my attorney's office and was informed that they are no longer handling VA claims. The person I spoke with could only tell me that letters are being sent out, and put me through to the rep's voice mail. I had a NOD filed through these guys back in June, and am wondering what's going to happen with that. Will I have to start the entire process over again with a new rep., like DAV, or can someone pick up where they left off? Really frustrated and confused. Anyone have some insight into this? Kappa

I wrote an editorial letter to the St. Pete Times that showed up in their editorial page today. The SP Times has really taken it to the VA in my region and exposed many scandals. The title of my letter is Dysfunctional VA. Now in the next few days many letters from VA employees will appear to rebut what I have said about the claims process and about how wonderful the VAMC is and the great care we get. I will probably get a visit from "Men in Black". Somebody has to tell the truth. The VSO's never say a damn thing against the VA or the quality of care we get. I will probably catch flak from the local DAV saying my letter is all wrong.

I found this to be interesting. As of this date (August 24, 2006) there are a total of (562) BVA cases for attorneys Bendezu and Mahlin listed on the BVA’s web site at http://www.index.va.gov/search/va/bva.html . Of those (562) Bendezu & Mahlin Board of Veterans’ Appeals listed on their web site (using “bendezu” and “mahlin” in the search engine at http://www.index.va.gov/search/va/bva.html ) there are (106) of those cases that included discussions similar to “veteran failed to report for the VA examination”, apparently at the advice of counsel. Below are (19) Board of Veteran’s Appeals (BVA) decisions (numbered and listed in chronological or…

I'm soooo out of the loop! They say you get smarter as you age, but I swear I've forgotten most of the VA stuff I knew. Can anyone bring me up to speed? Since MT got his 100% back in early 2000. (I used the "3rd Party lawyer" thing back then.) What has changed? Thanks a bunch! Kim

Isn't it good to know we can write our Senator's who are supposed to support and give an intelligent? answer to our questions? I wrote mine asking him to support NOT repealing the law that allows Disabled Veterans to hire an Attorney if they so wish. The "Non-sense attachment is the answer I got. This froma aSenator who has a 80% negative vote on Veteran's Issues, but a 100% vote on building a 600 million dollar Embassy in Iraq... "The US Senate agreed to spend $592 million on a huge new embassy Baghdad, "Some conservative Republicans in Congress have targeted the Baghdad embassy project to hold down spending and trim the record budget deficit, which hit $412 billion…

(248) 380-3434 fax rbriggs@fb-firm.com www.fb-firm.com They will consider VA representation after June on case by case basis- I hope I can find more lawyers who will too- But just remember - it is up to a lawyer to take a case- some claims may well be found that lawyers wont want them- I worked for lawyers- evidence is everything- and presenting a case well can mean whether they will take the case or not. It is always best to get all the evidence you can whether you chose to hire a lawyer or not.

Nexis/Lexis has the best information about using this FTCA form. The software that includes this information is about $800.00 but every attorney who is unfamilar with this form should read this information. I have it. It's 24 or so pages long. If i could get it scanned into my computer i think i can post it here. For those here who suggest to other vets that it is a simple form that we can fill out on our own ( which is what the VA tells us when giving us the form ) is more than likely setting the vet up for denial and yet another long process of appeals and so on. It is critical to fill out the form in a specific way with specific details and a "sum certain"…

This one just popped up at VA Watchdog- http://www.veteransdisabilitiesbenefits.com/ Robert Howell- I worked with a John Howell at Stars and Stripes for a while- former VA lawyer doing vet advocacy now- need to contact him to see if his is also going to rep vets- I believe that these attorneys will be starting to put ads on the internet and at many web sites--- I believe they will focus on exactly what the VA states in the VCAA letter and any denials as to exactly what the veteran still needs- in most cases it will the same as VA claims now- EVIDENCE----the only thing that can win a claim.

Hi everyone. I'm brand new at this and I need lots of help. I got separated in 1993 under the SSB program. When I started receiving disability benefits, they went to offset the amount I received in 1993...$47K. I still owe $27K. Upon reviewing my medical records, I came upon a disability that I had then, disclosed during my exit/separation physical exam, and found out that nothing was done about it so I was separated unceremoniously. I filed only last year for service connected disability. It looks like now it will be approved. My question is, if that condition existed at time of discharge and was properly disclosed, was my discharge actually legal? Shouldn't I have recei…

I got the official notification that Waco VARO has assigned a DRO to review my claim as I disagreed with it on their April 10, 2007 decision. Included in the notification was implied threat that all my records will be reviewed and additional evidence may be required. I also can have an informal hearing if the DRO wants it or a full formal hearing anytime I ask. I think I will wait and see what happens. I was pretty specific about effective date not being correct but now I wonder if I should seek more than just HB benefit cause of all the meds and apparatus that I use. Any comments would be much appreciated. Pete
