Repayment Of Overpayment By Va Due To Va's Mistake
A question came to mind while reading another post today where the VA was proposing to reduce a veteran's rating due to an error in the rating decision made by the VA. The VA was proposing to reduce the overall rating from 70% to 50%, a reduction of approximately $500.00 per month or more. If the VA prevails in the reduction, it appears the error made by the VA has resulted in the overpayment of thousands of dollars to the veteran. No mention of fraud by the beneficiary in this case. QUESTION: In a situation where the VA determines it has overpaid disability compensation to a veteran as a result of an error by the VA and no fault or fraud by the veteran, can the V…

Am I On The Right Track Here?
my knee was injured in 1988 basic training i was torn from the top of the cargo net by another trainee who panicked when he went to flip over the top... he held onto me and we both toppled over and fell strait to the ground and hit on 1 leg.. my left 1... the knee buckled and something inside snapped and my left foot was broken across the arch. because i was 18 and not a quitter i managed to get through basic training on bottles of motrin and a will to not fail. over the 5 years and 2 duty stations i ended up having surgery on the knee twice. it never got better, i also injured my back and my hearing while on active duty. i was givin a permanant profile no running, jumpin…

Va's Turnaround Time
So I just learned that for Houston's regional office the turnaround time for VA C&P claim completion is 13mths. This was kind of a shocker to me but then again I can't really be surprised about it. I'm in the stage as of now so I'm just hoping for a good rating overall. Retroactive pay will look nice I'm sure considering the wait. Keeping my fingers crossed. Let here your stories about your wait process.

ptsd Just Finished C&p I Thought Was For Anxiety. Walked Out With Ptsd Eval... Any Help On Possible %
SUMMARY AND CONCLUSION: I conclude the veteran does meet criteria for post-traumatic stress disorder. He does not meet criteria for a mild neurocognitive disorder due to TBI. He is able to maintain activities of daily living including personal hygiene. He has not experienced a significant trauma since discharge, but there has been a worsening of his condition because his PTSD has not been adequately treated. There have not been remissions and symptoms are continuous. He does not have a problem with drug and alcohol abuse. There is not inappropriate behavior. He is in treatment at the current time and on medication but has had many failed trials with SSRI medications and n…

Service Connecting Sleep Apnea
Hello brothers and sisters. I have a claim for sleep apnea. I separated from the goog'ol army upon my return from Iraq. I developed it while in service but never got it diagnosed because I literally separated 2 after returning. I reported lack of sleep and tiredness during the day and was prescribed Ambiem on active duty to help me sleep. At the time since the was no diagnose for sleep apnea, the doctor treated it like a sleep disorder. My wife wrote a statement and was filed with the claim. Also my room mate wrote a statment for me, confirming my loud snoring and possible air obstruction. How helpful those statements are to service connect apnea? Does the prescription of…

ptsd Claim Process Question. Please Help.
I claimed ptsd, tinnitus and sleep apnea. I had c&p's for ptsd and tinnitus about a month ago. I checked on Ebenefits my claim status and it showed "decission aproval" stage. Now, my sleep study for sleep apnea is tomorrow. How are they in the process of aproving an incomplete claim? Will they give me a rating for ptsd and tinnitus first and then make another decission when they get the sleep study results? or they will just give me a rating for ptsd and tinnitus, and deny sleep apnea, to make me have to appeal?

100% T/p But Not Iu
New to the forum here so hoping i can get some clarification. I am a 100% t/p for a mental condition. I have looked into it and while I am listed as t/p I am NOT listed as unemployable. Can someone in my situation still get work and not lose benefits? I am only 34 and ex infantry. While retiring this young would be fun I just can't do it. besides the fact that I just had twins mentally i get real bad off if i am inside all the time. I have started voc rehab simply because I dont wanna be inside with my family all the time as I fear I may go off if i am cooped up too much. I am being medicated currently but if i go off my meds even for a day bad things happen. Any help wou…

Dear members, My ptsd combat intake doctor and my primary psych from VA scored me 85/85 on pclm. I have no idea what that is except and they put it severe ptsd on side note as well. Also, they add mdd as well.

0% Rating For M.d.d. B4 Cnp Exam?
So I submitted my claim for M.D.D. and it went quickly to preperation for notification then all the way back to gathering evidence. I was sent the brown envelope and awared 0% service connection. The same week I had my C&P exam. This exam went like what i've heard other people describe theres as. I am curious is it normal to be rated then have a cnp exam does it help?
