Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Foot Injuries - what is the difference between #5283 & #5284?
Okay so I was looking up the ratings for the foot and I found two I should eventually fall under for my foot: Code 5283: A broken bone in the foot, whether it has not healed properly or at all, is rated on how badly it affects the functioning of the foot. If it is just a bit painful, but overall the foot functions okay, then it is rated 10%. Something more serious, possibly causing significant pain, is rated 20%. Something very serious that significantly affects the use of the foot, but the foot can still be used, is rated 30%. Code 5284: All other foot conditions and injuries are rated based on their severity and on how much the foot can be used. A moderate con…

Do Oral Scars count as "Scars of head, face, or neck?"
My claim back in 2014 it was found that my tongue scar was 7822-7800 rated at 10% due to the Characteristic of Disfigurement width measurement. My 2015 reconsideration claim to add a separate code of 7804 for the account that it is also painful was successful, but, they removed the 7800 code for head, face, or neck. The changed it to 7822-7802 so it's still 10% lol....those bastards. So my question is, does it still count as head, face, or neck 7800? It's my understanding that every conflict should be resolved in favor of the higher rating. I mean...it would be a CUE to not see that my tongue is inside my head lol! Thank you!

ptsd Retro Disability Compensation
I have a question, maybe you guys can enlightened me. I have been battling the VA for years In 2007 the finally awarded me 10% for my left eye, then it was raised to 60% in 2015. Then they said they had made a "CUE" on the rating of my eyes, and it should be at 80%. I am also 50% PTSD, so I am 100% IU. I filed for disability in 1978 for disability on my eyes, and was denied. They claim they had no record of me filing at that time. I want thru my entire claims file and military records page by page, and I found a letter dated August 1, 1978 in which they denied me disability compensation on my eyes, which were approved by a BVA in 2013, giving me retro pay from 200…

depression secondary to chronic pain
I finally did it. I asked my MH doc if he thought I had enough basis for a claim. He has me currently DXd with MDD. He told me that while I do have MDD, he's not so sure I could be successful with that as a claim for SCD. He asked me if I was 100%, I said no, but I am 80%. And he asked, then, if I was being paid at 100%. Said no, and he hmmmmm'd. Then I asked if chronic pain made any difference. He said all depends. I told him that I fell down a flight of stairs during my 5th day of boot camp back in November of '92. Said I've been dealing with pain in my knees and lower back ever since that day. And have developed other issues that cause more pain as well. He…

Retro pay for contentions
I have a question.... I was awarded S/C for some contentions back in June 2014 - rated at 40% and at that time there were other contentions "deferred". I was then awarded for S/C for some contentions in November 2014 - rating went up to 60% and there were contentions I was denied on. I put in for an NOD and that is where I currently sit. My question is, if I WIN to get my S/C for some of those contentions that were denied in November 2014, what effective date will my award go back to? The original one was December 1, 2013 and has been my date on both my 40% and 60% award letters. Also, if I win the addition %, for example additional 20%, how much ret…

ptsd request for buddys address
Soryr i have been offline for a bit... i filed my OSA claim secondary to PTSD in November, which they interestingly tried to originally claim it as "Sleep Disturbance TO INCLUDE PTSD - Increase" which i had to write several letters over the last month to state "I AM NOT SEEKING AN INCREASE BUT A SECONDARY RATING". which they finally have changed (in ebennies) to "Sleep disturbance - Reopen, Sleep Apnea- NEW". So that was successful.... Anyways i had put in multiple sworn declarations from myslef and my wife along with a friend i was in with. I saw on ebennies that they requested the "address for an individual who was named in your claim as having knowledge of…

S/C for L ankle but R foot/ankle is in appeal status - now I am having surgery on R - need help!
Good morning; I posted in another forum regarding temporary convalescence assistance BUT I have some questions: 1. Currently my left ankle is S/C and I had surgery on it and my toe this past June 2015 2. Currently my right foot/ankle is under appeals (NOD) since December 2015 after being denied S/C for it. My SMR's clearly show sprain to the right foot/ankle while on AD so I am not sure why it got denied. On Christmas Eve I fell down the stairs when my left ankle/foot gave out, causing my right foot to receive two fractures to the 5th Metatarsal (transverse/spiral). I am scheduled for surgery tomorrow. Since it's my Right Foot I am not able to drive…

hypertension Temporary 100% for Hospitalization - Not service connected - Service Connected Treatment
Hello, I am not sure if I am posting in the correct forum. I am trying to obtain some assistance in regards to my spouse who is a retired veteran; was 90% before a reduction to 80% (I believe) due to no-show for appointment. He is currently in the hospital and has been since 17 November 2015. He was released to a licensed skilled care nursing facility almost 2 weeks ago, which is where he is at this time. I read that it may be possible to apply for temporary 100% when hospitalization is greater than 21 days for service connected disabilities or for non-service connected disabilities where service conected issues are being cared for. My husband (legally separated) was deni…

rated competent Found "Competent" by the V.A but......
I was proposed to be incompetent, so I presented all the evidence possible to convince the V.A. that although my injuries are extensive; I am competent. I waited for about 1 1/2 years for the V.A. to decide that I am in fact able to handle may own affairs and rate me "competent". According to the letter I am rated as competent and I shall continue to receive my full payment. However, I have not received any back payment or retroactive payment. When I called the Hot Line they told me that it will take between 10-45days to process. It is now 97days later and I still have not seen any action taken by the V.A.. As I continue to call them, they state that I do rate a large sum…

Restless Leg Syndrome Secondary
Looking for some extra guidance. I go through a county VSO and they are a great asset to have but I always like to do my own research and last time i went in, the info i got from reading here and from the post i had helped out my award the last time. I am currently rated 10% for a lumbar strain. I am going through a C&P that is pending at this point. Prior to the C&P exam but after I filed, I had to have emergent surgery on my L5-S1 (i was falling constantly). In the claim, I filed for an increase in my low back strain, i filed for the bilateral leg weakness associated with the foot drop, bilateral radiculopathy, among many other things. Most pertaining to the bac…
