Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Dependent Status for NG son attending full time college
Regarding my monthly Veteran's Compensation Benefits - My son was removed as a dependent when he turned 18 even though he was still in high school. I submitted for and finally received the back pay that finished him out through his HS graduation. After graduation in Jun 2013, he joined the National Guard, attended Basic, returned home on 1 Nov 2013 and since Jan 2014, has been enrolled full time as a college student. Since he is only in the NG, yet living at home when not in college and I am providing over 50% of his support, can I have him added back on as a dependent to have my rate adjusted accordingly? My two previous inquires to the VA resulted in a No and a Yes.…

I have "Chronic Fatigue" listed throughout my military med records with no diagnosis.
Has anyone been awarded Chronic Fatigue? I was told by one examiner that I could not have Chronic Fatigue in addition to Somatization Disorder. Any advice on getting this service connected would be appreciated.

completed disabilit re-examination, how often?
How often does the VA perform a re-exam on disability awards? mine was approved in may and I have already received one, with a CUE and proposed reduction. Do they do this all the time? Once every year to everyone? Can I expect them to continually come after me forever? Thanks.

weird, but worth asking
Okay, so on 4 August I submitted my FDC Approved 5 May 2015 80%. Life is good :) Today, I get a letter from the VA saying they reviewed my claim, and disagreed with the 20% I received for Hemorrhoids, that it should be 70% overall and if I want I can submit evidence to keep my rating. So, at my C+P the nurse noted in the record loss of sphincter control, moderate leakage when doing the C+P for hemmorrhoids. Under 7332 on CRR38 Part 4 that is 20%. But VA review makes no note of it, stating that my hemorrhoid condition is insufficient for anything over 0% Apparently South Dakota RO gave me the 20% for the leakage, but the VA didn't like that. Is that because it falls unde…

How to access in-service medical records
Recently got 10% rating for tinnitus and 0% for hearing loss, but I had claimed on some other things they flat-out denied. I'm planning to appeal, but it would be helpful to see my medical records, since I know these things were treated while in service. The question is, how do I get a copy of those records? Can anybody enlighten me? Thanks for the help, fellow vets.

ptsd Secondary vs New Claim VA adjudication
background: I claimed shin splints secondary to flat foot, i had been seen for shin splints in the military and was noted on exit exam. I looked at C&P notes, Flatfoot and plantar fasciitis is listed as "likely as not" so it seems i got that. However Shin splints were listed as "Less Likely as not" due to flatfoot. Question: I know that the VA is the supposed to be the adjudicator, if i claim Depression and they decide its PTSD then they give me SC for PTSD and not depression as i had claimed it as. Since i claimed something as SECONDARY to another claim but as above say well its not related to it are they not obligated to opine on whether it is a SC on its own an…

Establishing a service connection for shoulder / arm radiculopathy
Hi Strangers! I haven't been back for a while because a lot of things have been going on in life, not so good, but those are for other posts. I do, however, have a question please. On my last claim, I was denied Service connection for upper right radiculopathy and upper left radiculopathy stating "Service connection for right upper radiculopathy is denied since this condition neither occured in nor was caused by the service". I do have a current diagnosis of radiculopathy, both left and right. When I had my exit medical exam from the Army back in 1991, it clearly states that I claimed "occasionally painful right shoulder". I was Light Infantry, so we humped a LOT. Lots…

Pending Decision Approval
Checked ebenifits and my claim for specially adapted Housing grant has moved to pending decision approval. Since, this is not my first rodeo with the VA I called the 800. Granted, nothing is certain until the vet receives the brown envelope; however, the rep did tell me that the decision approval is pending a senior signature. I believe that suggest good news, we shall see.

Rating increase, part of retro withheld?
So I recently was awarded a previously denied claim and that increased my total rating. I received retro but it was short of what I calculated based on the increase so I made some calls. My contact says the system shows that $180 a month was withheld, but he couldn't explain why so he put in an inquiry to the proper department. Being the effective date was 12/1/14 it shouldn't be a CDRP issue right? That's been phased out and hasn't effected me with any of my other payments. Oh and it's not an issue of not getting paid for December I already about that BS :) This is listed in the "system" and $180 each moth for 10 months as "withheld". Any idea why they would have withhel…

Chapter 35 Back pay
Alright, so I started college last fall and my dad just qualified for 100% disability over the summer, which they back-dated to February. According to the VA lady here at my school I should receive back pay for the housing allowance for the months that I was in school. I was just wondering if these payments would be direct deposited in the middle of a month or if they would only come on the first of the month, like the actual payments? I am asking because it is the first today and neither my brother nor myself received any payment. I am really curious if I am going to have to wait an entire month to receive that payment or if it could show up on some random day this month…
