Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

2016 VA Compensation Rate Overhaul
Does anybody else remember the talk about this years back? http://www.pva.org/site/apps/nlnet/content2.aspx?c=ajIRK9NJLcJ2E&b=6350111&ct=11629039 http://archive.armytimes.com/article/20120911/NEWS/209110319/VA-falls-behind-disability-ratings-overhaul There was talk about revising the compensation tables to not only reflect loss in economic ability but loss of quality of life, etc. It seemed like in 2012 they were already behind schedule, so i think the overhaul has been pushed back further and in light of them having 'budgetary issues" this year. This is also known as the VA wasting billions then complaining they are short billions...remember they are the on…

hypertension Rating Reduction from 100% to 10%
Back in March of 2013 I was awarded a schedular rating of 100% for hypothyroidism, 20% for meniscal tear right knee, 20% for meniscal tear left knee, 10% tinnitus, 0% hypertension, all of which were retroactive to August 2011. In August of this year I was sent to a C&P Exam for my hypothyroidism, my condition has not improved and in fact has worsened, I explained this to the examiner but she seemed reluctant to accept it since I am on medication. A day or two after the C&P exam I sent a letter (certified mail) to the VARO stating that I have not improved and listed the symptoms that have worsened and the symptoms that have remained static. A few days ago I receive…

Hello all, Currently receiving 30% compensation for the following 1) constant tinnitus 10%, 2) left knee chondromalacia patella 10%, 3) right knee chondromalacia patella 10% since then I was given a knee brace. Currently I had an MRI done for my left knee and was found to have grade 1 sprain of ACL also grade 1 chondromealacia of the lateral patellar facet and weightbearing medial femoral condyle there is mild osteoarthritis of the knee. Now I am having the right knee checked with the MRI assuming it will be the same as the left. Question is would I be able to have my disability rating increased due to this? also had the sleep study done and found to have mi…

PCP for Claims help?
A post on how to use your PCP at the VA for help with Claims and the best way to use them http://howtoapplyvabenefits.com/2015/09/23/how-to-contact-va-doctor-for-claims-help/ Many Vets out there cant afford an IMO/IME to assist in their claims. I get it, i have and still am on a tight budget and the idea of coughing up 300,500, etc for a report for something you know is Service Connected seems ridiculous. In short, yes it is ridiculous, but we live and work in the world we have not the one we want. I wont belabor over this too much, but i cant stress how important a good IMO/IME is. You will have to consider your claim and how much you will benefit. if you are 60% a…

Lower VA rating then service rating
Hello everyone, So in 2014 I was medically discharged for a leg condition (Extertional compartment syndrome) and I recieved a 20% disability rating from the military - with severance pay. VA decision finally came through, and they rated me at 10%. I was kinda under the assumption that the VA would give me at least what the military directly gave me. Was planning on signing up for Vocational Rehabilitation..which requires 20% Has anyone else actually been given a lower rating by the VA then by the military? I thought it was usually the other way around. Thanks!

ptsd I saw my VSO....
I hope this is in the right section.. I went to see my VSO last week because i haven't heard anything from my claim recently. He looks in the files and there is a decision made on 8/04/2015 that i am 100% bipolar and PTSD and 10% for my back. They gave effective date of when i filed my claim back in April of this year. I have a few questions about this. How long before i get official letter? Secondly they denied my claim back in 2002 because my original medical records from Army read personality disorder but the decision letter states I never had one Can i appeal back to the 2002 date? Also the PA from VES never used anything to measure my range of motion for my back. I w…

Generalized claims (ie im not a doctor)
SEP 2011 i claimed tinnitus and headaches secondary to tinnitus JUNE 2012 decision deferred tinnitus (no mention of headaches, but could infer that this is included since it was secondary) JAN 15 i was granted 10% for tinnitus (retro to SEP 2011) and 0% for headaches (Retro to SEP 2012. since appealed that 0% with a NOD, awaiting dro hearing). My question is that i know that it is not incumbent upon the veteran to make a diagnosis, ie if i have foot pain i am not required to claim for plantar fasciitis i can just claim foot pain and the VA's job is to figure out what it is and if its compensable. If i claimed headaches as secondary to tinnitus, but in fact that was no…

ptsd VA System/Ratings Assistance
To whom it may concern: I came here to get some assistance, after doing 2 combat tours in the middle east, enduring an IED blast, losing some of my brothers, and the list goes on. I've been on a battle for benefits since upon my return in late 2005/6 first rating was 30% then it has been an uphill battle since then I am currently at 90%. However, it's almost next to impossible to get your 100%, I swear sometimes that the VA wants you to be dead instead of providing you with the benefits and entitlements that you deserved. It's frustrating to say the least, personnel at the VA have the worst attitudes, and the thing is that they are there to provide us with a service …

Short changed for retrograde disabilty compensation
I just wanted to see if anybody out there has been short changed by the VA IRT retrograde payments. I am 100% service connected. I filed 01 March 2015 and received my first VA disability check on 01 July2015. I received a "retrograde payment" on 11 June 2015 in the amount of $2,296, and just received $4,240 on 25 August 2015. I then received a letter form the VA stating that my only compensatable months were April and May. does this sound right to anybody? I feel like I'm being shorted 2 months of retro payments. Any help would be great.

Where to start? What to expect?
I have recently put in for an increase for blood clots and have asked for Thoracic Outlet Syndrome to be added. My VA doctor says I do have Thoracic Outlet Syndrome and my VSO says to open it as a new claim, any suggestions? Here is what I am basing my claim on, it states very clearly in the report that there is an obstruction in the thoracic outlet, so how could they claim that it is a " possible " thoracic outlet syndrome. Unfortunately, at the time I got out, I had not received a copy of this, just my severance check. I always thought this was all carved into stone, little did I realize how much I had been low balled. Any ideas, thoughts or opinions are welcomed as to …
