Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Migraine - 30% Vs 50%?
Got the white envelope in the mail today. The good news is that the VA rated me 30% for migraines, which put me in bed flat between 2.25 and 2.5 days per month, with migraines running for up to 5 days. Looking at the decision package, they rated me at 30% based on having, on average, one prostrating migraine per month over the last several months. The trip wire for 50% is defined by 38 CFR 4.120 is "With very frequent completely prostrating and prolonged attacks productive of severe economic inadaptability." The raters did not find that my claim met that threshold, despite the outside doctor stating that I cannot work and my migraines are twice the 30% rating threshol…

Suicide Scars?
A few years ago my PTSD was so intense I attempted suicide twice. First by drug overdose and then two months later by slicing my wrists. "Stupid on my part"! My two questions are; 1. Has anyone ever heard of a way to have the scars corrected so they don't look so bad? 2. Since I did slice my wrist during a PTSD panic attack would they be eligible for compensation secondary to a service connected condition? Would really be interested in a way to correct the scars if anyone knows of a way.

tdiu For People Who Writes Their Own Letter Of Evidence Or This May Just Help You...
For the past couple of years my mind has been in what I am calling a "smoke cloud". I couldn't remember anything and I couldn't do much writing because I didn't have any will power because of the pain I have to deal with. Anyway I have been dealing with memory issues due to chronic pain and of course these medications I take. Finally after about 10-15 trips to the Emergency Room due to heart rates rising to 180+ some I, not my VA MD, but I found out it was caused by the Elavil/Amitriptyline. Along with the Tachycardia I had to deal with, I had dry mouth all the time and I would get severly dehydrated even if I didn't go outside. Finally, after talking with the ER MD he su…

ptsd Help! Got A Letter From Ro Asking Me To File A Claim!
Okay quick history: I am s/c currently for my Anorexia Nervosa 0%....I fainted November 2014 and it resulted in me being rushed to the hospital and I was seen for multiple issues pertaining to my eating disorder and in the process I damaged my front teeth. I had my teeth fixed on the outside (my dentist) to the tune of $4,500!!! I went ahead and got two DBQ's filled out by both my dentist and my specialist dentist who both directly connected my damaged teeth due to my anorexia nervosa. I provided my dentists the ER notes from the VA as well as my family dentist knows my history. I submitted the claim 2/5/15 as an FDC claim since I had everything submitted. On …

ptsd Gathering Of Evidence Development Letter
Hi everyone, I am new to this forum. I've been looking through some of your forum for the past couple of months, but this is my first post (so i hope I'm posting in the correct thread). I submitted my FDC in January of this year. I just recently received news that I am in the Gathering of Evidence phase. Please do not judge me for what i about to say. I know many of you served honorably and i only wish that that could have been my case (it haunts me every moment of everyday). I was raped in my Advanced Training Unit and did attempt to exorcise every effort to obtain a discharge to get away from my attacker. My chain of command kept "losing" my discharge paperwork and …

Range Of Motion Question/ Pyramidng Question On Knee Claim
My ROM for my right leg is 15-105, my left leg ROM is 20-105 per my last C&P exam. Am I figuring the % right is this 20% based on ROM and arthritis combined? I get confused on pyramiding anyway. I had a claim remanded from CVA and the claim was granted for SC for my right knee and left knee secondary to the right SC. I had this on a remand and since my last C&P was over 4 years old I am wondering if I will have to get a more recent C&P exam. I am sure a new C&P exam will be ordered for the left leg but not sure about the right one. I have Bilateral chondromalacia patella and I had a meniscus tear which has been repaired with surgery back before th…

Well-Too Good To Be True-Back To Pending Decision Again?
Folks: After my CP exams, my claim seemed to be moving quickly but, I Called 1 800 # last week after 7 weeks at Pending Decision Approval and was told, "claim was signed off" on 04/10/2015 and fully Completed on 04/15/2015? So, I've been watching for any ebenefits updates or envelop in the mail? Well tonight, I checked "ebenefits" and saw that almost a year was now added to the claim completion date on ebenefits and the comment said, that "additional documents" were/are required from somewhere else?" Once again, it's an FDC, so they should have everything that they needed from the start? What is odd, is that the 1800 rep last week said, it was all signed off on al…

ptsd Tbi Disability
I have been trying to search everywhere for how to get evaulated for TBI etc. When I first got out i didnt want to have anything to do with the VA, compensation etc. I only went because A buddy made me go in and jsut get in the system. Because i was OIF, they had me screened (what they call level II?) for TBI. What the couple guys (didnt look like doctors, were in jeans and polo) told me was I didnt have TBI because I didnt actually go unconscious after the blast. What happened to me was this... 1) in slow motion sort of, seeing the dust lift off my cammies a few inches and thinking "thats so cool looking" 2) After I dont know how long starting to hear…

Retroactive Pay?
Hi everyone, I'm seeking information on what to expect in retroactive pay and how soon they make that payment. My service ended Sept 2013 and I submitted my first claim on June 10 2014. I just received an award letter for 70% rating. I was wandering what would be the date of my retroactive pay and how soon to expect it? Thanks in advance!

ptsd Alcohol Abuse/cirrhosis Secondary To Ptsd
In April 2013 I had an initial exam for PTSD, the diagnoses were- Axis I 1. PTSD 2. Bipolar NOS 3. Alcohol abuse in full sustained remission (5 years) When I got my award 5 months later I was connected for "PTSD with bipolar disorder" but no mention of alcohol abuse. The examiners rational DID state, "claimant started drinking to deal with symptoms of ptsd". So, six weeks ago I filed a claim for Alcohol Abuse, secondary to PTSD with Bipolar disorder and submitted a copy of that C&P as a nexus statement. Will that suffice for a nexus or do I need to go out and get another one? My whole goal eventually is to get the cirrhosis covered, which I …

ptsd Award Changed To 90% + Other Benefits
Back after six months, which is pretty rude of me. The information I received from everyone here when my life went to hell was directly responsible for helping me through this. I cannot thank you guys and gals enough! I was originally rate at 80% and applied for TDUI after being unjustly fired for being a disabled vet. I applied in January and received the VA's decision last week. It has me more confused than ever. I have been bumped up to 90% with the following additions according to the letter; 1. Monthly Benefit - 3,400 (+1 dependant). 2. Dependants' Educational Assistance, Chapter 35 3. Individual Unemployability - Effective 9 Dec 14 4. Entitlement to…
