Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Other Specified Trauma/stressor What?
Okay so I am still awaiting the "official" BBE to come but I do have a coordinator I have been in contact with for several months and she is at the RO office. She and I were chatting today and she "unofficially" told me my breakdown and one of them is 30% for Other Specified Trauma/Stressor......WHAT IS THAT? I had a MH claim in for Anxiety/Sleeping - Eating Disorder and then I added PTSD/MST a few months ago. The original claim is from May 2013. In addition I was 0% S/C for my Eating Disorder Anorexia Nervosa which is great b/c I can get the treatment now and the VA will out source me to a treatment facility. But I am baffled at the Other Specified Trauma/S…

What Constitutes As 5% Of My Body
I was just awarded 0% for my PFB appeal. I was given 0% because At least 5 percent, but less than 20 percent, of the entire body affected has to be affect to receive 10% compensation. I have shaving chits for my face and the back of my head from when I was in the Marines and I currently have very small PFB under my chin an neck and PFB all over the back of my head and neck with dark discoloration. Is this enough to appeal again for10%.

Va Comp Check Withheld Due To National Guard?
Hey guys... I'm in a real pickle. I've posted previously about my comp check being withheld.. ( I'm 60% plus 1 dependant so I normally get 1136.00) however..this month I got 72.39 I logged onto E benifits and did some research since the toll free # doesn't work on the weekends.. It would appear that they never received a copy of my info to withhold dual pay.. This was in 2010-2011.. Badically, my claim was decisioned on August 2010.. I left the Natl guard in Feb 2011.. I'm under the assumption that because they didn't take the WHOLE check that they got their money? I'm just trying to put my mind at ease until I can call tomorrow. Thanks guys

hypertension Secondary Conditions
I received a service connected disability rating for kidney disease recently of 60%. I have multiple other conditions at least two of which should have no problem being connected as a secondary disease. Gout and hypertension. Since I am going through the process of filing another claim...I feel like I might as well throw everything out on the table. So a couple of other things that I have also filed for aren't as clearly connected. Depression and sleep apnea. My question is, should i even bother pushing the envelope on the other two conditions - depression and sleep apnea? I dont know if they are related or caused by kidney problems or not. So could it hurt an…

Ace
I, along with a few other persons I personally know, have had our claims go to ACE and I noticed we all had commonalities. 1) We were all denied. 2) We all had bad initial C&P's that didnt favor us, then promptly we had all future C&P's cancelled. It seems the second we had that negative paperwork on us, the VA sent us to ACE, cancelled our other C&P's as to block any possibility to get a favorable opinion from another examiner. Is this the newest tool the VA uses to deny Veterans their compensation? It would sure seem so!

Disability And Self Defense Class
If I have a VA rating and would like to take self defense courses, will this affect my rating if the local veterans office discovers this information? It's rough where I grow up and I need to learn how to fight or die. Will this violate my disability benefits?

cervical strain Need Some Help.
I recently had a C&P exam for my cervical degeneration and bilateral nerve damage. I am currently SC'd for 20% cervical strain. I had IMO diagnosis and MRI results which confirmed these contentions + 2 herniations. I picked up my exam copy and was shocked to see the examiner did not recommend service connection. She totally dismissed the possibility and instead reported it was more probable do to old age. (I am 40). I am really surprised. She asked me what my MOS was and I told her I was a grunt. She asked me when I initially injured it (cervical strain) and I told her my chin was stuck to my shoulder for three weeks after I took a stumble down a cliff with a …

Venting
Two things that I want to vent about. I had an appeal that was decided in my favor back in September. Still no paper work or retro. DAV tells me to wait a couple of months and if still nothing to call them back. I have a claim in since last June (2013), did the C& P exam and the VA changed it from an FDC to a regular claim. Had my knee replaced in February. That was added to the existing claim. I had the C&P for that. In June the claim went to PFD, then back to GOE, I needed an updated HIPPA form. Sent that in back in June, still sitting in GOE. I have called the 800 number and they told me to call back every 30 days. Last time I called back the woman on t…

Payments For Disability--How Does It Suppose To Work?
Hi Berta- I wasn't a PEB or medical retire. I did the early retirement. Almost 19 years. Went to my EAS which was 31 Aug. 70,50,30, and (8) 10's were my percentages.. I have to be eval'd again on Sept 1, 2016 they said because Im not permenant. I have always been told that you get disability dated to the start of your claim. Even though I started my claim when I was still on active duty, on ebeneffits it didn't show that it started until Sept 1st, 2014. It was completed on 9 Oct. I was told by a few other people that I should have got a retro payment for Sept 1 to Sep 30, and then the regular October payment on time for Nov 1st, which is what I got in…

Hello, all! I recently had a sleep study done because my wife said it seems that I stop breathing while sleeping. Well, the sleep study revealed that I do not have sleep apneam but that I have alpha-delta sleep. The doctor said it is due to chronic pain. I hae degerenative arthritis in my lower back and my right ankle. My back aches all the time. I am on medication. I am 70% disabled. Can I make a claim to increase my current rating for this new "alpha-delta sleep"? Has anyone even herad of it? I have googled it and have seen sites talking about it.
