Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Chapter 35 and DIC
I was recently given 100% P&T and started filling out the Chapter 35 benefits for my wife as she has wished to continue her education, however i noticed that it says "If you are over the age of 18 once you receive either the DEA or FRY SCHOLARSHIP benefits, you will no longer receive payments of Dependency and Indemnity Compensation (DIC) or Pension and you may no longer be claimed as a dependent in a Compensation claim. If you are under the age of 18, on your 18th birthday you will lose eligibility for DIC or Pension payments and you will no longer be claimed as a dependent in a Compensation claim. CAREFULLY READ THE INFORMATION AND INSTRUCTIONS ON PAGE 6, ITEM 22 BE…

Hearing loss increase
In 1996 I was SC for hearing loss 0% and Tinnitus 10%; after an ENT consult I was fitted with my first pair of VA issued hearing aids. Since that time I’ve gotten a new pair every 3-5 years with several adjustments at the walk-in clinic with each pair. I keep telling them my hearing is getting worse but it never gets to a compensation level. A few months ago The VA audiologist is concerned over a sudden drop in my R ear conductive hearing and referred me to ENT. They can’t schedule me for several months so they referred me to a non VA ENT. (This was my 2nd visit to an ENT???) I was dx with Cholesteatoma in both ears, surgery is my only option, besides allowing it to gro…

SMC-S and SMC-K
Hi Everyone! I want to thank you all for the great job, that you are doing. Your "wealth" of information has help me a great deal, getting claims approved, which I am throughly grateful for. I have a question. I am receiving SMC-S as a result of 100% diaphragmatic paralysis, 80% for vision, and several other disabilities. My eye doctor, who used to work at the VA informed me, that I am now "legally blind" in my left eye, and that i meet the criteria for SMC-K. He has written two letters stating just that. My VSO says that SMC-K, is included in the SMC-S. My eye doctor says "hell no", that SMC-K is separate from SMC-S, and that I meet the criteria the VA established…

Percentage of Service Connection Based on Current status or Severity
I just had a very interesting conversation with my VSO and wanted to check out the truth of the matter. I have never heard this argument nor does it make sense to me. I am trying to get an increase for my migraine headaches. I was having headaches 3-4x a week! with at least 1 prostrating(i would not be able to do anything, would have to go lay down and be away from noise or light or distraction due to the pain etc). I filed for migraine claim and they denied at first then gave me 0%. Now i am trying for increase. Now my VSO says i will never get the increase because i am on medication. I have been seeing a neuro doc at the va that gave me meds that have been a …

Total Knee Replacement claim advice.
I have a question that perplexes me. I am 100% Permanent and Total for a total of 13 disabilities. I had a total knee replacement after many years of dealing with my arthritic 10% rated knee. i had the TKR in January 2020. I didn't tell regional office anything because I believe in let sleeping dogs lie quietly. However I do know that the VA hospital where I had surgery let the regional office know I had surgery for a service connected knee. I understand that the minimum rating after being reevaluated is 30%. Will they automatically contact me at the 13 month mark for a C&P exam? If so, are they limited to look at the knee only? Will they service connect for the TKR …

RO VA claim moved from pending decision approval to closed within days
Does this mean my claim was approved? I don't see my claim no longer on E-benefits and my current rating didn't change.

multiple symptoms
So if I am given service connection for a lower back condition that also causes sciatic pain, which is noted in my medical records (not actually sciatica by definition). Is the VA supposed to give rating for each symptom, or just the main claimed condition (lower back pain)?

FINDING THE CORRECT EED's?
I had this in another members post so instead of hi-jacking his thread I thought I'd post it here hopefully get some Intelligent and correct Anwsers. Concerning the EED's and Corrected EED's Here is my story from back in April 4th 1998 the year I first filed for my disability. This EED stuff is confusing, Here is another question maybe to help answer Pacmanx1 question?about his EED. THEY (VA) SAY ''(a) General. Effective date of pension or compensation benefits, if otherwise in order, will be the date of receipt of a claim or the date when entitlement arose, whichever is the later'' ok say the veteran files his claim on April 4th 1…
