Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Retroactive Pay After Successful Appeal
New here, forgive me if its hosed up. On 1 Dec 05 I was awarded 40% combined rating from VA. To be honest, I was very confused with the process and in fear of losing my retirement if I elected to receive VA pay. One of the conditions they gave me disability for was major depressive disorder. That disorder severely decreased my ability to make such a financial decision at that time. I waived my VA benefits, either in writing or by default, I really can not remember. I excluded the amount of my VA award from my reirement pay when doing my income tax citing the Strickland Decision based on guidance from DFAS. In Oct 2009 I sent in the form to actually receive my VA ch…

My friend retired in May 2010 and the VA just contacted him last week. On saturday my friend called me and stated that he received his Brown Envelope and he stated that he was granted 30%. Here is the Question, included in that letter was a statement attached to it saying that his claim for his kidneys has not been decided and they are still gathering more information from his doctors. P And T
I am rated at 100% Sc with three claims rated above 40% each. I filed for SSD with no word back yet, I received my initial claim Feb 2011. What do I need to do to file for P and T? I tried working after I retired from the military however I was only able to last for two weeks. My initial VA appt is next month (June) however I am seeing numerous Speciality Civilian Dr's because of my ongoing problems of which several have recommened Surgery for my Lower Back, however for me that is not an option. I would rather live with the pain versus getting cut on again. I take several medications a day of which one is a hydraMorphine pill (Exalgo), that pill in itself is a pill from L…

ptsd Tbi / Migraines Deferred For Medical Opinion?
Hello, I am new to posting but have been following Hadit for a while and appreciate all the advice from the members here. I am in a quandry. I am currently rated at 80% (20, 10, 10, 10, 70). I was rated at 40% for a neck injury. I just recieved the white envelope taking me from 40 to 80 percent for PTSD, depressive disorder and cognitive disorder. They deferred on the TBI and migraines for a medical opinion. The TBI is documented by neurologist and spect scans as well as my being on a TBI study group at the VA. Is covering me under PTSD for a cognitive disorder the same thing as the cognitive problems that stem from my TBI? I am currently still working only because I hav…
