Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Crdp Payment Question
I served in the Marine Corps from 1986 to 2007. I was placed on medical hold in 2006 due to back injury hence the extra year of service. I filed for VA disability in 2006 before retirement but I was also placed on TDRL. Guess I got a medical retirement. I was rated 40% originally by the VA but was upgraded to 50% in 2009. I was under the impression that I would be collecting CRDP. Currently, my retirement pay is being offset dollar for dollar from the VA. I will soon be taken off of TDRL and placed on the PDRL. Is there a reason why I dont see CRDP being paid? I thought the VA contacted DFAS with the new disability rating so that I wont have to do anything. I am guessin…

Appt
I have an upcoming apptt with VA on June 13th, this will be my initial appt since retireing from the military. My appt I suspect is an overall or general visit because it only state that I have an appt with an outpatient clinic. Can VA reduce your conpensation based on this first appt? Also should carry all civilian records (records since retireing) with me to this appt? vet2010

A Simple Math Question....i Think
So I previously posted that the Va in its infinite wisdom granted my spouse CH. 35 benefits with a retro starting date. The letter says "Based on Legislative changes on DEA requirements, we determined you are eligible to receive DEA benefits effective April 26, 2001, your date of marriage to the Veteran. You have 10 years or until April 16, 2011 to receive DEA benefits." I'm I missing something or are they cutting short her benefits by 10 days? Shouldn't her eligibility end on Apr. 26 2011? It matters because she in school full time this quarter so she would be losing $300.00. Should I file a NOD? Thanks.

My neurologist prescribes meds for daily headaches and states its cervionic headaches from my cervical fusion (is this enough to file a claim for headaches and migraines as a secondary condition to my cervical fusion?) or do i need to bet an IMO? What about ED? I also read somewhere not to…

Proper Procedure To Procure A Hospiyal Bed From The Va
I am 100% SC IU P&T. I have trouble getting out of bed and want to get a bed that will help me sit up. What should I do? Make an appointment at the Va, ask for a prescription for one and then send that off with a request to the VA? Please don't suggest I use a VSO. I have had terrible experiences with the DAV and they have hurt me more than they have helped me. Assuming the above is correct does anybody know what form I would use? Thanks.

Chapter 35 Spouse Benefits Backpay Question
Since I only applied for Ch. 35 benefits for my spouse when I realized there was a chance she could be approved (Cypert v. peake), by the time I applied she had gone to school for three years already. Now she has been approved with an effective date that precedes all her schooling but I am reading different things as far as backpay. She applied once in 2004 and then her eligibility ended in 2006 according to the VA. She never actually got paid benefits the first time i applied because she dropped out after a week due to medical problems. Then I find out about the Cypert Peake decision so I filed again in 2009 and they changed her eligibility dates that were originally 19…

Chapter 35 Dea Benefits.
SO here I sit, amazed at the letter I am looking at. In June 2009 I applied for chapter 35 Education benefits for spouse. I was denied. I sent in a NOD which was deniedd, and then sent in a FORM 9 Appeal with Travel Board hearing. Well for the last two years I have been looking forward to a travel baord hearing date to be set. Everytime I call the VA they tell me there is an appeal and I just need to wait for the hearing date to be assigned. Well that's just fine right??? Wrong! Apparently I never even needed to file an appeal. I just need to reapply for my education bebenfits. My VSO at PVA Albuquerque just informed me that if I am denied, I can re…

Champva Eligibility
THANK YOU SO MUCH for making the SVR shows available in the archives! I had no idea there was so much information available there! I was just listening to the one on CHAMPVA and I was surprised to hear that the Veteran does NOT have to be 100% P&T, they only have to be P&T for a SC rated disability, no matter how low the rating is. This got me thinking.... my husband is SC at 80% for injury to his shoulder and extensive scarring from an in-service MVA. I dug out the sheet that lists his disability codes & percentages and while I don't see the words permanent & total, I do see that he has No Future Exams Scheduled, and each of his disabilities is…
