DBQs and possible nexus re-evaluation?
Based on a DBQ, would a C&P examiner be pressed by the VA to give an opinion on the nexus of an existing rating when the exam is for an increase (unemployability)? I filed for unemployability. During my C&P exam for my Major Depressive Disorder (MDD) increase (unemployability claim) the examiner seemed to be asking questions or making comments that would suggest a re-determination of a nexus for my MDD. Have any of you seen where VA might ask the examiner for their opinion of the nexus on an existing rating when the exam is for an increase (unemployability)? Is there a unit in the VA that will discipline VA contractors that lie and misrepresent fact to create a denial opinion?
Please, don't explain to me about the difference between opinions and fact. I know the difference. An NP with only 3 years of experience and a neurologist did exams on me few months back. Just received their reports. The NP out and out lied about facts and misrepresented medical records. It was intentional as all get out. He claimed that a clearly charted diagnosis of solvent poisoning by an MD was not a diagnosis. He called it speculation and then claimed that notes (by a corpsmen that didn't make a diagnosis though it showed his assumption he was dealing with flu) where a diagnosis and the conclusion. Rebuttal to bad C & P Exams
I like a lot of you have had issues with bad C & P Exams. I decided to get a Medical Exam from an outside Doctor. I chose Thomas Seiter, M.D. of Marian Medical. I chose him mainly because I like how he wrote his IMO's and DBQ's and his location was close to where I live. (He is in Augusta GA) I did the exam on March 7 & 8. I had to return home for a total knee replacement on March 14 that I am still removing from so I have not had much time to post hear. I will post more on my experience with Doctor Thomas Seiter. Disability rating benefits
Except for the dollar amount awarded, are there any differences in benefits between 10% and higher ratings? From my limited research, it seems that the only difference between a 10% Disability rating and those higher ratings is the monthly benefits income dollar amount.

VES C&P Examiner Rant and Defensive Actions During My Examine
Good evening, one thing have a I learned throughout my years of C & P exams is to not to argue with the examiner. However, no one ever told me how to handle an argumentative examiner. First off, C & P Exam is for a 20 year NOD that was never adjudicated. (you might have seen my previous post) About 7 conditions all related to Gulf War and Environmental Hazard Exposure. Gulf War included - Chronic Fatigue and Joint Pains. HLR C&P
Hello Everyone I recently had a HLR and the VA came back and said that they found errors with the previous C&P by LHI. So they scheduled me for another C&P exam which I had on last Friday with a VA NP. She asked me the standard question on the migraine questionnaire and then at the end she said she would have to do some research into the connection between PTSD and migraines and that I would have my decision in 30 days. I wanted to know is it normal to take 30 days because all the other C&P exams that I've had I received the results the day after the C&P exam.

Has nothing to do with my claim?
So I just got my appt. through LHI for my Menieres claim. It is an ENT appointment which I thought was perfect since I've seen about 10 in the last 15-20 years. Its with this outfit called Granite State Pain Associates...weird? I go to there website and find out they don't have anything to do with Ear, Nose and Throat and especially the very difficult disease of Menieres. I probably know more then they do about it. How can I take this as a serious C&P exam? I figured they would at least set me up with someone that new about my disability if they are going to decide on my future with them. Pretty pissed off right now

LHI examiners
Who out there had bad experiences with LHI C&P examiners? I would like to share my experience with LHI. 2019, I had filed a claim. A c&p exam was scheduled with LHI. Shortly afterwards, I received a Fedex packet will info to include the examiner info. I pulled up the examiner's info, 3 years of Nurse Practitioner, as well as 3 years with VA system. I had already been diagnosed with migraines, and had an event or injury that would connect it. The diagnosis was from my Neurologist. During my exam with this NP, he kept saying that he doesn't think that my headaches aren't migraines, he thinks that I have cluster headaches. I am unsure of how…

Allergic Rhinitis C&P VA Didn't Ask For An Opinion
Had a C&P for allergic rhinitis. Doctor stated VA didn't ask for an opinion on service connection. Only wanted an exam to see how bad I am. Doctor stated that I would get the max. 50% blockage and polyps. Why wouldn't the VA ask for an opinion? I am a Desert Shield/Storm vet but was diagnosed after the 10 year limit VA put on it.

Effective date determination, etc.
Finally after 8 years and a couple of appeals, hearing before an admin judge, 2 remands, 1 virtual C&P I was never told about, one that was with a retired VA GP, and finally after the 2nd remand, an NP, my claim was approved. I never received notification (COVID?) until I saw the bank deposit and called the VA! With all the info, data, etc, my effective date was that of the NP’s C&P exam. My question is, why with all the info provided, etc., was the effective date late 2019 when they acknowledge the problem and the 2012 filing date?

Weird C&P ROM
I had a weird C&P exam yesterday. My range of motion was like 5 to 10 degrees in every direction in the thoracic lumbar ROM measures. He didn't seem to question that, as he was looking at my back muscles while I was standing doing the forward flexion and backward extension. I was pretty seized up and he called it muscle spasms, which I'm sure it was. My C&P was for DDD, painful motion, and lower extremity radiculopathy. I'm waiting to see if he'll call it inconclusive as a result of spasms, but I would argue spasms are part of what interferes with work. Of course, I would rather not have to argue it at all.
