New C&P?
I am rated at 0% for Restless Leg Syndrome. I recently filed an appeal to have that increased. Will they request a new C&P, or just go with evidence I provided?

Does "less likely than not" preclude aggrevation?
I completed my CP exam and the examiner, in short, said my condition (MH issue) was "less likely than not" incurred in the service due to it existing before I enlisted. Is there anything additional I need to do to claim that if they want to say it was not incurred then it was at least aggravated by service? Is the connection of aggravation as strong as it being incurred in the service? Will the rating officer take this into consideration, or do I need to specify that it was aggravated? The CP exam doesn't make any mention of this, only that it wasn't incurred, so I'm confused. Thank you.

C&P Exam Notes for IBS--Any guess how an RO will view it?
I just had my C&P for IBS last week and this is what the notes in ebenefits say, but I'm not exactly sure what it means in regard to how an RO may look at it. The notes do state that the condition is at least as likely as not (50% or greater probability) incurred in or caused by the claimed in-service injury, event, or illness. I know that there are no guarantees, but I was hoping for a few opinions. Does the Veteran now have or has he/she ever been diagnosed with an intestinal condition (other than surgical or infectious)? [X] Yes [ ] No [X] Irritable bowel syndrome ICD code: K58.0 Date of diagnosis: 2005 2. Medical history ------------------ a.…

These are the results from my C and P Exam I had on Saturday. Any ideas, I was sent back to the local VARO, from a Remand, and this is the C and P Examination requested by the Veterans Law Judge. I'm assuming I will just get denied again from the way this is reading, any thoughts or ideas will be appreciated. I was praying for secondary or aggravation disability because my neck problems are real!! Here goes my exam..... Medical Opinion Disability Benefits Questionnaire Name of patient/Veteran: Indicate method used to obtain medical information to complete this document: [ ] Review of available records (without in-person or video telehealth examination)…

Hadit For Real
Listen I have for the most part traded very lightly not blowing my cool, letting the process play out and having all the patience of Job. Now I am at a critical point and I have HAD IT!!!!!!!!!!! I was homeless up until a few days after thanksgiving so my family and I are now in an apartment thanks to the VASH program. I can not help but get pissed off when I think about the egregious errors made by a C&P examiner for blatantly saying that I did not have a residual scar from two previous heart surgeries. I had the Judge even flustered about the obvious disregard for the way this claim has been worked; for almost thirteen years and counting. Had it not been for this on…

tdiu Claim for increase
Hello, Please give me your thoughts on the following situations. I am one of a few veterans that meet every once and a while to discuss our particulars pending claims. One veteran in the group has a VSO assigned and submitted, what he thought was a well-supported request for increase and Individual unemployability. As evidence, he submitted prescriptions showing that his back pain required more than 6 weeks of time off from work due to his pain episodes, as well as a 21-4192 form from his employer reducing his employment to on call (from $2500 to $600 a month) specifically due his associated back conditions and his frequent absence from work. He stated that his V…

degenerative arthritis Lower Back C&P plus backpay and neuropathy questions
I recently finished a series of C&Ps for various conditions and I was hoping to get some input on just what exactly it all means - I was wondering what if any kind of rating might I be looking at? Is there a possibility for getting back pay? What can I do (possibly in an appeal) to do more to strengthen my case? At this point my case should be done with the gathering evidence phase (I can't check because ebenefits is being weird). All C&P's are done and everything that needed to be turned in is (I hope). The first C&P/DBQ I'd like assistance with is my claim for "Lower Back Condition". Originally I had claimed "chronic lower back pain" only to later find …

C & P Exam - Rater Asked For Another DBQ
I asked a question about this C & P exam in another forum but need to ask another. In the DBQ medical opinion request, the rater stated that he couldn't pull up an EMG from 2014. I went to my local VA clinic this morning and asked them to print a copy of the EMG results. The results say that I have moderate bilateral median neuropathy at the wrist as in carpal tunnel syndrome. I phoned the DAV office, the RSO returned my call and told me to fax the results to him ASAP so he could take it to the RO as moderate vs mild was noted. During the conversation with the RSO, I asked him which disability I would be rated on since being rated on all three would probably be …

C&P Exam results for PTS
Hey everyone, My claim has been processed and is now awaiting decision but fortunately its been about 90 days since I filed the claim. I am attaching scanned pages of my DBQ because I am super UN- computer savvy but they're clear and mostly direct. I was going to leave out some personal stuff, as it is written pretty poorly due to my fast talking. Please let me know what you think. Thank you in advance. EDIT: Thanks for pushing me to get rid of private information, Pete.
