AQ95-Proposed Rule - Update and Clarify Regulatory Bars to Benefits Based on Character of Discharge
The above is a proposed rule change by the VA. The actual document can be found here https://beta.regulations.gov/document/VA-2020-VBA-0018-0001 When these changes are 'Proposed', does it mean there will be a change of some sort? What is the general progression and how long could it take? Proposed Rule - Update and Clarify Regulatory Bars to Benefits Based on Character of Discharge.pdf

Interesting info from VA Progress Notes
Hello, I was denied for PTSD and migraines two years ago. I’ve been having sessions with a VA psychiatrist till now and found something interesting in my progress notes the other day. The VA psychiatrist wrote this: Veteran is a 40 yo male with bipolar disorder, unspecified anxiety, and PTSD from military experiences and MST. Does the statement above satisfy the Caluza elements? Thank you

Frustrated!?!?
Is anyone else out there frustrated with this process? I mean crap, its getting old. I have been making inquiries about getting some help with secondary claims. Everyone I talk to say how thankful they are for my service then tells me they want an ass load of money to help me. I understand paying for a service but, $1500.00 for a freaking nexxus letter then half of what I get for a year. Christ Almighty. Being on my fixed income that is out of reach. Does anyone have any ideas on who I can talk to? I dont mind paying but it has to be within my means.

Claimed PTSD
Hello Everyone. Just looking for thoughts and opinions if you have time. I put in a claim for PTSD because I am having flashbacks, nightmares, and cannot sleep. So I filed a claim for PTSD. I submitted my eval documenting combat, received a CAR, submitted article where people got blown up, submitted duty assignment of Bahrain. I had a disability of adjustment disorder with anxiety at 10 percent. Now they have given me 30 percent and changed it to GAD. I know every case is different and both exams was by the same doctor. Have not received my letter yet. I think the doctor would like for me to go get seen by by a professional. I will once I get an appointment. I have all t…

Another question concerning PTSD rating
Good afternoon, Have a question regarding PTSD. I was rated at 30% for it about 7 months ago. I think I should have been rated higher, but who cares what I think.... My question is I was offered counseling by a V.A doctor, but I have yet to take them up on it. Does this hurt me because I'm going to put in for an increase in the next few months. Should I take them up on this offer? Bonus Question, should I appeal the first decision or just apply for an increase? Thanks in advance!

Proposed Rating Reduction Questions
First off, hello and thank you in advance for any help that can be provided. Also, I apologize if something is not clear, trying my best to keep things concise. On Friday, May 15, I received letter from the VA, dated May 11, proposing a rating reduction from 100% to 70% for PTSD. The only evidence for the change listed is Rating Decision - Narrative(17SEP18) and DBQ PSYCH PTSD Review(06MAY20), whereas on my initial decision letter there was an abundance of evidence used. The major takeaway appears that my medical records(both prior to and after the initial rating, also from VA facilities) were not considered in this proposal. Is this normal? I have yet t…

Assistance with Form 21-4192, Helping my father with his claim
I am trying to help my father, a Vietnam Veteran, get through his claim. However, there are issues getting the 21-4192 form completed - he is the business owner, and I am the running the business entirely for him and an officer of the company. Some years ago (6 years maybe), it was determined that his involvement in the business was detrimental to the company. There were too many instances of altercations between him and the people working there, as well as customers. He would also just become unavailable and unreachable. There were many times our utilities or phone service became disconnected. He was either on edge or withdrawn and unavailable. He is still this way…

Flat Feet C&P Exam
I have a C&P Exam on Wednesday and I'm afraid I'll get denied. Flat feet was denied before along with Plantar Fasciitis because it's not service connected. I went back to my physician outside the VA and he typed my nexus as follows: "Bilateral flatfoot acquired possibly during time in military. When not congenital as a cause, pes planus (flatfoot) is caused due to ill fitting shoe-gear without subtalar range of motion support, which could have been a result to time in service, 51% probability.Patient presents today with bilateral heel pain, worse right foot. Patient states that the pain is 2 out of 10. Patient denies any injury. Patient states he is having pain t…
