tdiu Construction Of A Tdiu Claim
I am working on putting together my TDIU claim. My problem is what to include in the claim. Some of the documentation that I have seems unnecessary. I have a letter from my doctor saying that due specifically to my medical condition (service connected at 60%) I can no longer perform or maintain full time or gainful employment. I have the paperwork from my last employer showing my last date worked. I have copies of my VA claim file, SSDI file, VA medical file and am getting my medical file from the family physician. What I am not sure is needed are numerous letters from my VA physician saying that this condition is permanent and all the documents supporting the di…

tdiu Thinking About Filing For Tdiu
I think I have posted this is the wrong place, so I am re-posting it here. I am trying to figure out whether I should apply for Permanent and Total and Unemployablity and when I should do that. Your thoughts are appreciated. I was rated at 60% for Chronic Fatigue Syndrome in 1994. At the time of the rating, the decision states that "extra scheduler evaluation is not necessary". They had also considered granting a 100% rating. I also had other medical conditions mentioned in the decision. In 2012, I was unable to continue working due to increasing medical issues. On my doctor's advice, I retired. It was not a medical retirement, I had my time in and was eligibl…

tdiu Tdiu Denied - Reconsideration Meeting
So I was denied TDIU back in Oct. 2013, and my VSO (Dec. 2013) recommended a reconsideration and requested a meeting with the rater. Today(Feb.2014), I received a letter from the VA with a meeting scheduled for next week. My VSO said I don't need to bring anything and not to worry if they bring up incompetency, but I don't feel like being ambushed. I don't want to be caught off guard or give the VA any ammo to use against me. So the Question is: Has anyone been through this? what was the outcome of your meeting? any other advise is appreciated, Thanks.

Disability Benefits For Veterans Who Have A Veterans Affairs Compensation Rating Of 100% Permanent And Total
From the Social Security website: http://www.socialsecurity.gov/pgm/disability-pt.htm Starting March 17, 2014, veterans who have a VA compensation rating of 100% permanent and total (P&T) may receive expedited processing of applications for Social Security disability benefits. What do I need to know about the VA and Social Security programs? Both Social Security and VA pay disability benefits. However, their programs, processes, and criteria for receiving benefits are very different. A VA compensation rating of 100% Permanent and Total does not guarantee that you will receive Social Security disability benefits. To be approved for Social Security benefits,…

ptsd C&p Result Confusing
I had a IDES C&P in Gainesville on 7 Feb then had an I/U C&P on 21 Feb. I started the I/U claim the same day I started Social Security disability claim. Social Security granted benefits due toPrimary cause Anxiety (ptsd) secondary cause Myochardial infarction. The Army Ides VA claim was for PTSD. It appears from the write up and boxes checked that a 30 % rating The I/U ptsd write up looks to be 30 % rating. The I/U C&P examiner stated that alcohol was reported 2-3 shots of whiskey 3 to 4 times a week to help calm me down. He also stated the from the IDES C&P I reported not drinking in 6 months. He misquoted what I told him about drinking. I told him…

Granted Iu, Confused About P&t
I filed a claim for IU and P & T. I received an award letter that state I was granted 100% IU, nothing about P&T, except that no future exams are scheduled. My VSO has no clue about the P&T, I called the 1-800 -827-1000 line and the woman said oh yes you are coded at P&T, I will send you a state benefit letter so you can use it for your taxes, etc. I received that letter today, it state permanent and total NO, I also received a letter to have an id card made that states no future exams scheduled. This all seems to contradict each other. Can anyone offer me some guidance? I have 2 kids in college and the Chapter 35 and ChampVa are super important!

tdiu I "think" My Lawyer Screwed Up
Hello everyone. My lawyers filed an appeal for unemployability due to my migraines. I called the 800# tonight and was informed that the lawyers is appealing for a higher rating for migraines, but the thing is, I already have the highest rating. Before getting appointing them, my claim for IU was denied due to me being pregnant at the time, and they didn't do a complete C&P on me. My lawyer isn't appealing the IU though, only the migraines. The C&P examiner for my migraines did give an opinion that I was unemployable, and the rater said there was evidence there, as well. I would like to know how will all of this play out or if my laywer screwed me over? I am attach…

ptsd Very Confused
I used Ebenefits to file a TDIU claim. I tried to first file unemployability claim, but it told me I had to first open a claim for increase. So, i opened a claim for increase for ptsd. I am 70% now, but newly unemployed due to ptsd. I had to have 2 physicians statements in order to file for disability from work. I used my 2 VA docs, one was my MH doc. Both wrote I was unemployable due to my SC ptsd, said VOC rehab is a no go. I uploaded those two records, along with a statement from my employer indicating my difficulties at work and also va forms 21-4192 and form va 21-8940 in support of my claim. I did this yesterday and it asked me at the end of the claim if I wanted to…

ptsd Tdiu, Ssdi, & Federal Disability Retirement
I was approved for Social Security Disability Insurance (SSDI) & Federal Disability Retirement (FDR) under the Federal Employees Retirement System (FERS). I could no-longer work & I had filed for IU before I was approved for both SSDI & FDR. I was denied IU but, with time & help from my wife. I appealed their decision by filing a Notice of Disagreement (NOD). I suffer from severe PTSD 70% and a couple other disabilities that total 80%. After I was award SSDI I submitted the award letter for consideration to my local VA office in Louisville, KY. According, to eBenefits a decision is still waiting to be made on my appeal for IU. I was just recently ap…
