Mechanical Defect In My Vehicle
My claim pending NOD I feel will be a long case. But if their is a recall out for the car I was in, and the recall is all over the news even to this day. I received compensation from the car manufacturer for this defect. With all the evidence I have which I didn't have at the time of my initial claim with the cover up for this defect for 10 years would it take so long to admit it may not have been my fault? Seems like they are dragging their feet even though my service department said it was not my fault about 10 years ago as well. Is their anything else I will need to show them?

Cue On Original Claim
Hubby has 4 denials all for exactly the same thing. If he wins a cue claim on his first, original decision- would he get backpay all the way back to that first decision?

To Cue, Or Not To Cue, That Is The Question My Friends.
I was looking over some of my recent claim info regarding a granted increase on my back from 10 to 40%. C&P Doc wrote that this is the natural progression of the disease(DDD). And she noted that there was an X-ray from my AD time that showed then the DDD already starting. . And she noted that this should have been the original diagnosis as well. The original rating was/is still for low back pain. Can some of you well versed VA claim Warriors give me some input on this? Thanks! Semper Fi. Andy

Timeframes At The Va For Cue Claims
Apparently the Monday morning workload has nothing on it for a CUE filed appeal pending at the regional office. Date of Progress Progress Progress Office 11/14/2014 Local VA Office Decision RO 12/22/2014 Notice of Disagreement (NOD) RO 04/22/2015 Appeal Pending RO So has anybody had any experience at the Philadelphia regional office to see if this will be a few more years of frustration?

Exit Exam Diagnosis - Not Service Connected?
During my exit exam in 2009, I had several service-connected conditions diagnosed and was placed on TDRL for those conditions. I filed claims with the VA, and the VA denied them stating that all but one were not service-connected. I was dumb and did not appeal in time. This past year, I was re-examined by the MEB. It was determined that my conditions stabilized, and I was placed on permanent disability retirement. I've filed to re-open my case because 1.) the new exam and disability rating are new and material evidence to those conditions and that 2.) the VA committed a CUE by ignoring my exit exam and the entire reason I was discharged to begin with. Hello everybody, I have a question and I will get straight to it. Service connected since the day I got out 1OCT2004. For servical spine injury and for both hands all at minuium 10% ratings and one for a scar on hand at 0% rated @ 30% total. Got into VOC REHAB in 2007. ptsd Won Cue Now How To Get Retro For Dependents
I won my CUE all the way back to 1990 & was granted 30% for PTSD. Now how do I make them pay retro for my two children that were still in school at the time and for my wife. My daughter was 6 and my son was 14. Do I have to file a NOD for the retro payments for them ? Anyone ever had experience with this issue? I appreciate any input. Btw my wife was added as a dependent in 2008 when I was able to reopen my claim for PTSD.

I have a verified PTSD stressor in 2002 ,2004 and 2005 first PTSD C&P exam No Dx second PTSD C&P Exam I was DX with Dysthymic personality disorder with mixed features non service connected. In letter to RO from a VA staff Psychiatrist gave me a service connected Dx for PTSD and even though he past away after Before giving me the DMS IV exam and over 40 yrs. as a VA Psychiatrist it didn't hold any weight with the VARO.A private LCSW gave me a DX of PTSD But it was ignored because the stressors were not mentioned even though the exam was done because of the stressors. I figured I'd tackle this at a latter date but with them calling, I felt at the time to go ahead and do it.
