TBI vets- new info from OIG and Ben Krause
Yesterday I got the latest VA OIG report on TBI but didn’t have time to even read it. Of course Ben Krause did! https://www.va.gov/oig/pubs/VAOIG-15-01580-108.pdf I hope every TBI vet reads this information carefully----Ben Krause has been on them about this for years----he states: "Use The IG Report As Evidence But, based on what I read here, I suggest all veterans fighting for a fair rating to submit this report as evidence against the presumption of regularity that your exam was conducted by a clinician who was not adequately trained." https://www.disabledveterans.org/2018/02/28/va-oig-report-traumatic-brain-injury-disab…

TBI being SC is a judgement call...
I had called the White House hotline due to the CUE and equitable relief in my case not being handled. This resulted in me receiving a phone call from a resolution team supervisor from my RO. He stated what he needed for my claim and I pointed out where each of these items were in my file. They reopened my claim but didn't finish it. I called the WH hotline back and received another call from the same RO sup. We went over every document and I even emailed him my entire form 9 package. He verified receiving them. He wasn't familiar with the reg for epilepsy secondary to TBI so I emailed him a copy of that, he verified receiving and we went over it. Given…

TBI vet here, I think a miracle happened...
I've been a reader here for years, rarely talk, took advice, filed my claim, was denied, appealed, you know the drill. I'll try to give the basics of my story from hell. During the Gulf War, stateside, I had an accident while we were loading aircraft and I was knocked unconscious. Being the gentlemen that they were, my buddies carried me to the side and finished loading the aircraft. Afterwards they laid me on the couch in the break room and I came to sometime later. The accident wasn't documented, But I did start showing up at the base hospital complaining of nausea, vomiting, headaches and sleep problems. One doctor was so irritated at my complaints that she …

Confused about combining disabilities
2010 - Discharge 40% memory problems, status post head injury 30% Major depressive disorder with history of Insomnia 2011 added seizure disorder to memory problems, status post head injury. (remained at 40%) 2012 I had a diagnosis of seizures because they showed up on two sleep studies and one EEG. I did not have a "frequency" to report because they were nocturnal seizures. They added seizures 10% only because I was prescribed medication for seizures. 2015 had a C&P for possible PTSD. PTSD denied and they basically increased my Major Depressive Disorder to 70% but dropped off the memory problems, post status head injury. They explained that th…

Attorney For TBI CUE
Looking for recommendation for an attorney for a TBI claim that is well documented with an neuro psych exam. I am service connected back to 2008 but I believe I was low balled at 40% for TBI. Generally describing the results, the Exam notes severe and moderate in the results for memory and other cognitive and executive function. I asked for a reconsideration based on the difference in the test results and the VA schedule criteria on my own but got denied and gave up. I should have kept at it but I think getting an attorney is the only way I am going to make any progress. So here I am doing what I should have done a few years ago. Does anyone have a recommenda…

tdiu TBI - first VA appointment
After 34 years, I was finally competently diagnosed with TBI on My Nexus dated 4-9-16, and I finally had a medical Root cause for most all of my misery since about the 3rd day of my job in the Service. Now, I have got my first VA TBI meeting next week: maybe an hour meeting or less. I was not told to bring anything, but I am going to be prepared to unload it all with notes, since I walk into rooms and don't know why half the time due to a fading short term memory. If there is any reference to indicate what to expect, I'd appreciate the link. If I try to prepare for everything, I just get bogged down and accomplish little. I guess after the first meeting, it coul…

TBI/PTSD info-these are 2 separate disabilities
https://www.hadit.com/category/veterans-compensation-benefits-articles/ and more info here on that in this forum PTSD- mental health issue due to emotional trauma TBI-physical brain injury due to physical trauma One cannot get a TBI from having PTSD. If a vet has a TBI however, the situation that caused it could certainly also cause PTSD.
