Attorney needed that will take my case
I haven’t been here for a while, but to update, I am 100% P & T now, but the VA did not hardly pay any retro pay. My medical records are still being withheld per Exemption 5 [ 5 U.S.C. 552 (b)(5) ], and my medical treatment records were intentionally withheld for 51 years now. I have the records request form from January 1972 when the US Army told me they were lost intransit from Vietnam. This was absolutely false, and I finally got them in 2016, showing I had no reaction to Chloroquine, yet I had a skin disease they could not determine the cause of. I actually had malaria, and was hospitalized with a serious Lung infection from “Undetermined Organisms” eight months a…

Blue Water Navy info from VA OIG
Blue Water Navy Outreach Requirements Were Met, but Claims Processing and Procedures Could Improve 09/02/2021 02:30 PM EDT Since 1991, veterans who served in the Republic of Vietnam are presumed to have been exposed to herbicides such as Agent Orange. The Blue Water Navy Vietnam Veterans Act of 2019 extended this presumption to include veterans who served within 12 nautical miles of Vietnam. The objective of this OIG review was to determine whether Veterans Benefit Administration (VBA) employees (1) notified Navy veterans of their potential eligibility to receive medical benefits under the act; …

Nehmer Footnote One Agent Orange claims
Since VA has finally started to adjudicate Glue Water Navy AO claims, this info might help- Footnote One: -----Original Message----- > Subject: Footnote One Nehmer "Rick Spataro, Head Nehmer lawyer of NVLSP, explained Footnote One to me this way in email as soon as the Regulations were being prepared for the 3 new AO presumptives in 2010: “As for your second question, if the VA should have coded IHD in a rating decision, the claim that resulted in the rating decision could be considered a claim for benefits for IHD under footnote 1 of the Final Stipulation and Order in Nehmer. It basically depends on the timing of the claim, rating decision, and e…

Backpay for Agent Orange Exposure Claim
My father was exposed to agent orange in the Navy while in country (he was brown water navy). He developed ischemic heart disease and finally rated at 100% this year, after being at 90% for several years. He hadn't applied for ischemic heart disease prior to my helping him this year. Does the VA pay or allow backpay for agent orange exposure? I'm just wanting to help him out and wondering how, if possible, to go about submitting information to the VA for him. Thank you in advance! John

Hypertension Treated by VA in the 1970's
It looks like 2021 may be the year that hypertension (high blood pressure) finally becomes a A/O presumptive illness. If it happens, I have a "what if" question. I am currently a 100% disabled Vietnam Veteran (prostate cancer). I was discharged in 1967. Beginning in the 1970's I was treated at the VA Hospital in West Los Angeles for high blood pressure. Although I eventually switched to private care, I have been treated for high blood pressure my entire adult life. So my question is: If high blood pressure becomes an A/O presumptive illness, could I submit a claim for retro compensation to the 70's because the VA was treating me for it back then? Thanks eve…

Vietnam Vets With Cml
Our son who is 29 was just diagnosed with CML Leukemia. My husband served in Vietnam in the late 60 and was covered in Agent Orange. It appears from reading these messages that there are other Vietnam veterans whose children are being diagnosed with CML. Being such a rare disease especially in children too many of them seem to be from Vietnam Vets. Exactly how many of them are out there. The targeted drugs seem to be working but at an a co pay of $1800 a month. They are working on getting him financial help or discount through the pharmacy/drug company but they are saying this could be a life time cost. Anyone out there making any progress with getting help from the VA fo…

Movement on new VA Secretary to add HBP to AO presumptives
John Plahovinsak: Disabled war veterans waiting for long overdue action | The Clermont Sun In part: "Over 150,000 Vietnam War veterans are waiting for a decision from Department of Veterans Affairs (VA) Secretary Denis McDonough to obtain VA benefits they earned for their medical conditions. This decision would be to add hypertension to the list of medical conditions presumed to be caused by exposure to Agent Orange." "During McDonough’s Senate Confirmation Hearing and first news briefing, he said he felt the urgency to act on the hypertension issue. He pledged to look at the scientific evidence, rather than the cost. “Inevitably people focus …

Agent Orange Guam recent BVA awrd
GBArmy recently posted info in his blog on AO in Guam-I am glad he did, as this situation is still affecting many veterans and probably their survivors as well. Veterans have had a difficult time proving they were exposed to AO on Guam. The fact however that 2 veterans have proven they were exposed to AO on Guam, one quite recently, and there might be more at the BVA site- there are 2,208 BVA decisions there on AO and Guam. https://www.va.gov/vetapp05/files4/0527748.txt What gets me is that VA has been so adamant about NO AO on Guam, however they said that about Thailand, Blue Water ships ,and certain C 123s , and even CON…
