Old Or New Medical Evidents
This is the VA decision; I filed a claim in the year 2000 for my heart,which they say is an inferred claim under Nehmir, They made there decision on retro benifits based on medical testing from 2008/2009 =10% The medical evidents when the claim was filed showed 48% LVL and test in 2010/2011 showed 50 % LVL. They awarded 100% starting in 2011 and said this was a full grant even when the retro was based on 10%. I will be sending the decision to NVSLp for there review. RDT

Cue Agent Orange
If you have an enjection fraction of 48% in the year 2002. Would not your rating be 60%. The VA rated me 10% retro for 2002 based on a C&P in 2008 that guest MET at 10,C&P in 2009 that quest MET at 11 and last C&P in 2010 that show MET at 5 and injection fraction at 50% I would think it would be 60% based on the injection fraction in the year 2002, not some C&P in 2008-2009 that I disputed. Would a rating in 2000 that show 40% and a new award at 60% no bet = 78% Thanks RDT

Ihd Decision
Received a decision today on IHD and Agent Orange. I have a questing on how they figured the retro. They stated my LVL in 2000 was at 48%. There decision awarded me 10%. Should this have been 60% based on LVL @ 48% Then they stated I had a C&P in September 2008 that showed a MET of 10. Which I sent in a NOD. Then had another C&P in October 2009 that showed a MET of 11. Which I again filed a NOD. As it was a NP that only ask question and did not testing. Then had another C&P in Janurary 2011 that show 3-5 MET and LVL @ 50% / Decision awarded 100% starting Janurary 2011. Seem the retro should be based on 60% from the year 2000 thru 2008.…

Vietnam Ao Exposure May Have Caused Tumors
Hi Folks, I filed for a couple of issues stemming from service in Vietnam and exposure to AO. I ended up developing two tumors which have now been removed. One of the claims is listed under SMC since the tumor was in my scrotum and was next to my right testicle. The VA removed the tumor and testicle, which is a normal process. So I was looking for SMC (k) on that issue. For this issue I basically wanted to get it in on the books. i don't really expect any awards except perhaps a residual scar compensation. Agent Orange Chemist
Let me start off by saying that I was on a U.S. Navy destroyer from 1964 until 1966 and then was transfered to Great Lakes, Ill. for a couple of years and completed my duty in-country Vietnam. I was a Navy court reporter and traveled everywhere from I-corps South. The bad water was everywhere and remember vividly the rain, rain, rain. The purpose of this post is to informed those that may be interested that one of the producers of Agent Orange in the chemical plant in Aniston, Alabama, died this week of a massive coronary. Nehmir Claim
I received a call from the San Diego Regional office that they had a made a decision on my IHD/Nehmir claim. She said by-law she could not tell me what the decision was and wanted to make sure they had the correct address to mail the letter to. She said to watch for the decision letter. .I should know in about ten days the out come and will forward the decision to NVLSP for the records. Let pray it is the right decision from the start. Has any one been contacted by the VA on the Nehmir claim by phone? Is this standard to call the Veteran when there Nehmir claim is complete. RDT

Ao Filing Date
The American Legion is asking vets to make sure they file their claims for any new AO presumptive by August 30th,2011. I questioned their online article abut this but what they mean is this- for new AO claims (IHD, Parkinson's, or Hairy Cell B)that are not under Nehmer due to a past denial, as long as the medical evidence warrants it, the EED for these claims will be Aug 30,2010 per the new regulation's publication date. In essense the AL means that date can be the date the "earliest entitlement arose" and could be one year prior to the claim date- if claim is received before August 2011. New to this site and trying to gather information for my mother,
New to this site and trying to gather information for my mother, My father, a Vietnam vet and 100% VA rated passed away in Feb of 2011 from a heart attack. I filed a DIC claim on my mother behalf in March of 2011. I found out this week, Aug 2011, the DIC claim is in, Nehmer limbo. While going through one of my father’s old VA claims I saw he had been denied a claim for a, “heart condition” in 1986. No other description was given. If the heart condition claim denied in 1986 falls under the Nehmer guidelines does that mean it is retroactive back to 1986 and that my mother is entitled to the retroactive payment? Any information would be greatly appreciated.
