Got Letter From Nehmer
It says I can send more evidence ( I am using their enclosed 21-4138 form to re -iterate all the evidence I already have sent-just in case they missed some of it and my A & A accrued claim) Also this might help any Nehmer survivors here- They are asking me who the surviving spouse is (which is me), names, addresses and phone numbers of any children,or surviving parents of the veteran, and letters of testimony (Estate or administration) with a raised seal from the appointing court. They are saying they can resolve my claim as soon as they get this info -even prior to the 30 period they give for response if I send this all by fax- and they say Fax number is on …

hypertension Rec'd Nehmer Letter On Friday
I am sure the answer to this has already been posted somewhere on this forum, but I have been unable to find it. Any help would be greatly appreciated. My husband was granted 100% P&T for his disabilities(the majority is for PTSD)back in 2007. They went back to 2005 with his award. On Friday we received a letter from the VA in Auburn,WA,(we are in Florida)stating that he was identified as a potential Nehmer class member. He has been treated by the VA for severe hypertension, high cholesterol, triglycerides, etc.as well as skin and mouth cancer since back in the 80's. He was never granted disability for these conditions but was rated at 20, then later 40% for cervical a…

hypertension Little Nervous About Stress Test!
Well had my annual stress test at my private cardio doc on Monday and today they called and want me to come back in. Not quite sure what this is about but I was able to walk this time and did OK but who knows? I recommend that anyone especially Vietnam veterans to get their hearts checked if they have any type of the so called markers for heart disease hypertension, shortness of breath, chest pain or just plain fatigue! Good luck to all!

Fast Track System
I put in my claim for Parkinson's using the fast track system. I really liked the way you can upload your information. So, that was the fast part of it. Checked the status, and it is now in "Traditional Claims Processing" Other words, it is going on a stack, like my other claim. Papa

diabetes Footnote One
http://search.uscourts.cavc.gov/isysquery/f5a7478c-74d6-4fa9-98da-0c44a8998cec/1/doc/ This unusual case link was given to me by Rick Spataro, attorney for the veteran's surviving son as part of his response to a question I had over Footnote one of the Nehmer Stipulation last year and I think I might have posted this here before-as to Footnote One – a very important facet of the Nehmer Stipulation. The CAVC decision with Rick as the veteran's attorney , came a month after he discussed Footnote one with me and this info might help someone here with similar situation under the new AO presumptives. “As for your second question, if the VA should have coded IHD in a rati…

Ao-Ep681 Nehmer Claims Moving Quickly!
I just took a look at the VA spreadsheets published every Monday for workload on claims. The good news is that they are zipping thru the backlog of EP681 claims for AO. From the data, they posted, it looks like they will be finishing the EP681 by the 1st of April or so. This will allow them to tackle the bigger job of the EP687 backlog.

Ao Soft Tissue Sarcomas
In addition to the main cancers on the AO list , the many STS cancers could easily be overlooked in filing an AO claim. The list has been posted here many times but best to refresh the list-these types of cancers often need a thorough review of the medical records to determine the exact terminology. The VA is not going to hunt through your records to find these terms.Best to send them copies of any diagnosis that would warrant a STS AO award. And a reminder that any AO cancer that metasizes can also warrant a potential secondary award for the metasized effect. AO STS cancers: Types of Soft Tissue Sarcoma with no time requirements for manifestation Adult Fib…

Agent Orange
So Confused: My husband has filed 1151 which I feel strongly that he will win. Lets assume he will win - would his disabilities be considered direct service connection? Have filed an SF 95 and we have not heard back. We are nearing the discovery of malpractice in a couple of months. Have not heard back - does filing SF95 toll the time clock on filing malpractice in Federal court or should we proceed. Has filed for colon cancer due to Vietnam and TCE exposure at Fort Ord, CA. Has anyone won an agent orange claim for colon cancer. Have medical evidence that cancer started right after Vietnam and progressed for many years to diagnosis

Ao And Your 201 File
I am in the process of constructing a page per page record of documents I have supplied to VARO in St Petersburg for my claim which has been in since July 7, 2010. Too long for me, reading other persons posts I'm a newbie way in the back of the line. Thing is I'm not going to take it. Today, I was reading a Military Personnel Records Jacket DA Form 201 (June 1966). Interesting reading, wonder why I never read it in the past. For those of you without access to one I will repeat word for word the information printed printed on the form. The bold face type is of my making, for emphasis. On left side: INSTRUCTIONS This side of the Military Pe…

Pd
I am a CVSO I just received a rating on a veteran with PD. The examiner stated that PD does not effect your usual occupation as you are not employed. He is not employed because of his PD. The whole VA are idiots. Here we go with an appeal to clog the system.
