726 days and counting NOD
I've had an outstanding NOD for almost two years. I've personally contacted the VA as well as my congressman and have been told that there are other more pressing claims that are being worked. My personal opinion, for what it's worth, is that my NOD is pretty solid since I have an IMO from the VA doctor and my personal doctor supporting the claim to include the required VA language (i.e., more likely than not...). Any ideas on how to get this NOD processed? Thanks

nod dro 690 days in florida???
i am at 690 days waiting for iu nod dro to get done in florida....hardship was denied, smc a&a that a va pcp filled out and i sent in was denied.....i am tired of this game....i have called the wh number ,202 number, the 1800 peggy number,.....nothing told to wait..the va said it would be another year to get done maybe????? backlog...lol

Viewing C-Files at Your RO
While on a recent trip to the Det RO, I had occasion to try the VA "Walk-in No Appointment necessary, viewing of my C-File." I have to admit, I really didn't believe that the VA allowed Vets to review their C-Files, even with an appointment. The VA 800 Line Rep told me, that was the VA policy at all the ROs, Walk-in, 1st come 1st served. It was also confirmed by (1) VARO Det Rating Dept employee and recently by a former Det RO DRO Hearing Officer, now retired. All (3) knowledgeable VA employees were wrong, you must make an appointment. I have to say, I agree with the rational behind the need for the appointment. Help with Effective Date of Disability Appeal-related Back Pay
Hi to All, In full disclosure, let me begin by saying that I am not the veteran in question...I am the 22-year wife of a veteran with Schizoeffective disorder. He served his country with distinction in both he Army and the Air Force. In Anticipation of Litigation
I have come to learn my medical evidence was withheld all my life due to "ANTICIPATION OF LITIGATION", from what I gather, and the VA used a couple FOIA EXCEPTIONS OR EXEMPTIONS in withholding them. New and Material evidence for DRO review
Good afternoon everyone. I will give a brief overview relating to my question. Seperated from active duty January 2015 (Title 32) after a two year active duty tour. Filed claim with VA for cancer and hypertension May 2015. Had hypertension prior to active duty which worsened during active duty and was prescribed additional medications to control it. Daignosed with cancer May 2015 (within one year presumptive time frame). Claim denied. Conditions did not occur on active duty or during one year presumptive time frame. Effective Date
I first filed my VA disability claim in 1982, but it was closed without a decision because the VSO who did the case claimed that my whereabouts was unknown , yet the same day he closed the case the VA did a C& P master audit of my file and my correct address was in my file for sometime. i never was notified. Appeal & new evidence sent to RO
Hello I filed for IU in 2014 and it was denied I received the SOC which stated they denied me due to form 21-8940 and the examiner stated my condition had gotten worse but on the DBQ for occupational and social impairment section checked off the symptoms of someone that would only be rated at 30%. I am rated at 70% for MDD. I wrote to the RO that the DBQ was inadequate and should not be used to rate my claim. I submitted the form 8940 & a doctor's note from my treating doctor stating my condition was at least likely due to my unemployability & other supporting evidence from employers. My husband put in a claim for ihd/aortic valve stenosis secondary to diabetes, in 2009. It was denied. I have been doing some research and in 2012, they did test on people with diabetes and aortic stenosis. And they found they produce a protein that enhances inflammation that causes a greater risk of stenosis of the aortic valve much worse and faster, than someone with out diabetes. My husband had surgery to replace the valve in 13. Now his cardio doc says they can hear the murmur again. Can you no longer request a DRO Hearing
So it's been a long time since I've done claims and now that the VA no longer accepts a 21-4138 as sufficient to file a NOD, I see that the only option is "traditional" or "DRO review." I find this to be a convenient way to deny a face to face hearing, but wanted to ask if there is a way to request a DRO hearing. I prefer to, and have never lost a case when argued at DRO hearing. Rating Percentage Request on NOD
I filed an appeal (NOD) requesting a DRO review. One of the questions on the NOD asks "Percentage (%) evaluation sought, if known." If I list a number, am I bound to that number, or can the rater give more (I evaluated myself on ROM% ignoring other factors discussed)? Do I file an "amendment" to my claim requesting more, or if the rater gives me the percentage that I requested, should I file a subsequent appeal asking the number to be adjusted (retroactive?) based on the higher percentage?
