Appeal Complete...what is next step?
Earlier this year my grandpa passed away. For the past few years I have been helping him work through some service connected disabilities with some success. Well he has had an open appeal for over 2 years. Being that 80+ year old men aren't that great on the computer, I helped him track and manage his benefits via eBenefits. As I was helping my mom go through all the forms to fill out for a flag, burial allowance, etc, I thought to check the status of the claim. Online it says that the claim has been completed, I assume he was denied because there was no rating change. The date of the appeal completion was the date he passed away. I just finished helping my mother …

More c&p exams
Hi, after 11 years I finally received an increase to 70% for ptsd and 100% unemployability. I had a mental c&p exam last April 2017 and now VA is sending me to another mental c&p exam in July and also a copd c&p exam. I'm wondering why they are going to give me another mental c&p exam... * I have a BVA appeal for hypertension and I've recently sent them medical info and asked for a waiver for them to consider any new evidence and NOT VARO. It doesn't make sense that I'd have a mental c&p last July 2016 and again April 2017 and another mental exam scheduled for July 2017. Does anyone know why VA is requiring a c&…

Appeal advice...denied broken wrist
I just joined the forums and I'm new to navigating the VA system. So far it hasn't been that bad. I filed a claim in March 2017 for the following: Left ankle-sprained on an airborne jump. Claimed approved at 10% rating Skin condition from Desert Storm- Claim denied as I was never treated when I was in. Left wrist/hand- Broke hand during an airborne jump and went to the hospital on Ft. Bragg and was in a cast. Claim was denied, VA said not service connected. so here's my issue. I had a C&P exam for the ankle and my medical, records supported it. I never had a C&P for my wrist or an exam and I'm sure since it was in a cast it should …

New Bill In Congress to Reform VA Appeals Process
Hi Everyone, As I wait my fate after a DRO hearing (been 16 months) rather then worry about it, I took Broncovet advise that he has given to keep myself busy. I just came across this bill called the "Veterans Appeals improvement and Modernization Act". The bill is expected to pass late summer as it as bi-partisan support (both Democrats and Republicans). It is expected to speed up and shrink the claims process by creating "three" lanes of appeal. Lane #1 "Local Higher level Review Lane' would allow a adjudicator to review the same evidence considered by the original processor. Lane #2 "New Evidence Lane" , veterans can present new evidence for review and have a hear…

Advice on First NOD
I filed my first claim and recently received va decision. 10% awarded for tinnitus, sleep apnea denied, wrist tenosynovitis denied, and hearing loss denied. I have county VSO but I know they are very busy and want to put paperwork in good order before I file the NOD with them. I was only given audio exam from VA but no other exam. I retired from the Air National Guard and have twenty years of service. The service history is convoluted but I have all the records involved 3 DD214's (Active Duty Army and Air Force), Title 10 orders for (Air Guard), and NGB22 (Air Guard and Army Guard). My career was Infantry to start and Flightline Avionics for the latter part. I have…

SSOC with denial.
I am a little frustrated with an SSOC I just received. I had a case remanded at the CAVC due to the BVA not properly using my Drs statements. At the CAVC the DAV lawyer and VA agreeed evidence was not properly used. The SSOC says the claim will be denied because the opinions from the new C and P. They state two opinions. I saw one Dr for three minutes. The case involves esophagus stricture currently at 50% should be 80%. See attached ssoc any help would be appreciated. I have 30 days to submit more evidence.

DRO Hearing Scheduled - What To Do/Expect?
Ok folks, In the midst of researching attorneys to replace my VSO, I got a call from the VSO who was working/not working on my claims. He wanted to get a few more details to work up his Form 646. After a week of speaking back and forth with him, he came to the conclusion that the VA had not reviewed several medical reports, including some of my active duty USAF medical records. (If the VSO would have woke up years ago, and saw that, maybe I would not have had to scream from the mountain tops for the past few years.) I know that it has been my fault all along though for keeping the VSO there. Meanwhile, I get a call from the Houston VARO, who wants to discuss…

DRO meeting not scheduled
Fellow vets: Briefly, I submitted NOD through VA county regional rep along with a letter stating if I would like a personal hearing. However if I am to be approved for IU then I would agree to waiver the DRO personal hearing. Now on ebenefits it states my appeal is complete, hearing disposition is cancelled. It's what I asked for, any thoughts and thanks! vietvet

auenone
After reading USAF-Vet's post and the following replies, there is good info there. With my reconsideration, all I could do was send some BVA citations for lack of smr's for Vets that won their cases using 3.304 (d). There is no record of me being in the hospital in Vietnam although I spent 12 days there. The NPRC has no record of me being in the hospital but my letterhead from the hospital awarding a PH. But, during my c&p from qtc, the doctor cited an "in service note for frag wounds, blah blah" the day after I was wounded. The BS w/V award stated I was thrown to the ground, which according to the CDC, is a tertiary blast effect. So, I'm wondering how a doctor giving…

Should I FAX Claim data to Providence RI Regional Office?
I have several NOD’s at the Providence RI RO. When I am able to contact this regional office to ask about my NOD’s, they tell me a variety of tales about my NOD’s. Sometimes they say they have all the data, then other times they say they are missing data, things like medical records, C&P exams… I have already sent in all of my claim data to the VA’s Claims intake center, I just don’t have any proof that that data has made it into my VA records. Should I also send my claim data to the Providence RI Regional Office?
