Need good advise please
Need advise on weather writing a senator or congressman is a good or bad idea. Short and to the point history. Starting in 1997 I began having headaches and we are talking about headaches that lasted for months not just a day. Went on sick call numerous times and got the standard treatment of take two and call in the morning. Moving along VA physical stated the same - nothing no rating . Dealt with it. Each and every time that I brought it up say ole same ole. Forward one day I had a seizure. They found a brain tumor. Gee if Ft Hood would of done a MRI they would of found it. Applied and denied for SC appealed and it got remended. I have had two brain surgies and gettin…

Remanded Appeal
I got a letter from the VA yesterday stating they could not get some records from the VA in Los Angeles. They stated they had records from 1996-2009 and if I thought they had enough information to make a decision on my appeal. I got records dated after 2009 that I am going to send to the VA. My question is, the BVA judge stated in her remanded orders that I should have a C&P exam to determine if my bilateral feet disability is secondary to my service-connected bilateral knee disability. I have sent all my medical records stating exactly what my knees disabilities are. I have had 2 C&P exams in the past, but the Waco RO only asked the doctors wheatear Osg…

Court of veterans appeals panel
My appeal to the veterans court in Washington DC has recently been assigned to a panel for a decision. It was initially assigned to a judge now it's been ordered to a panel? What does this mean for my case? Will this now be much longer of a wait? Is it a good sign or a bad sign? Any insight would be greatly appreciated. Thanks Joe

Help CUE During NOD DRO
Hi I have been lurking and finding lots of useful information, but need help/advice about what has recently occured. I currently have a NOD DRO waiting in line at my VARO with three contentions. For one of the contentions on appeal, the VARO discovered a CUE, sent me to a C&P, rated it, and now are telling me that the CUE claim they have been working was cancelled by management because I can't have an issue that is on appeal be corrected via local quality error correction!!! Unbelievable that no one saw that the CUE was also on appeal!! I would think with the appeals backlog, resolving anything that can be ahead of the appeal is a good thing as the DRO would have less…

If I appeal a decision does that stop my current rating? Or perhaps, could they lower my rating?

appealing decision
If I file an nod does that stop my rating? Or can they lower my rating? Would you appeal everything trying to seek a higher rating if you felt you deserved it?

DRO Review Questions
Have two appeals in 2012, 2013, had just been denied TDIU in which people at DAV believe was wrong. However after i received the denial for TDIU one week latter i received a letter from VA requesting all medical records and hospital records for all of 2015 to present so instead of hoping the Dr and hospital would send i went and got my self and added a few pieces of past evidence the VA already has but i believe they overlooked. Also sent in a copy of the recent C&P exams i had from the request of TDIU which flat out in VA terms state under Migraines that i could not do sedentary work and under MH said i could not do sedentary work and under Cervical it stated i could…

BVA remand
I called the VA 1-800 number and the lady stated my BVA remanded claim was e-mailed back to the reviewer for clarification. On the BVA remand, it stated I should have a bilateral knee C&P that includes all the things wrong with my knees. I had claim my feet disabilities as secondary to my service connected knee disabilities. The VA had sent me to two C&P exams and had instructed the C&P examiner to see if my Osgood Schlatters disease was causing my feet problems. My knees are service connected for Traumatic Osteoarthritis with limited extension along with Osgood Schaltters disease and chondamalacia. Am I reading this right that a decision is being made without…

Asthma due to alleries
I am 0% for Chronic Sinusitis and 0% for Allergic Rhinitis. For years I have had issues with Bronchitis and Bronchial Pneumonia. A VA physician stated that I was 'misdiagnosed' while on Active Duty. He said that I have Asthma due to Allergies in 2014. Since being treated for asthma my condition has improved. I am now doing immunotherapy (weekly allergy shots). I filed Asthma as a secondary to the Allergic Rhinitis and the VA denied the claim. I am also taking Allegra, Flonase, Singular, and Asthmanex. How can I prove to the VA that my Asthma is related to the allergies? Also, the VA refuses to perform CT of my sinuses for a higher rating.
