Timeline @ 5 years
It has taken five years, from the time I filed my initial claim, before my appeals are on the desk of a BVA judge. I am doing the AMA evidence submission docket(no hearing). I was awarded scheduler 100% in April 2019 under the Legacy appeals for a single condition. Opted into the AMA after a DRO awarded my 100% rating following our telephone conversation. VA.gov indicates it takes 1-2 months for a ruling after the BVA judge has an appeal in front of them. True, or false?

Update
Well, it's been a few months and I'm still waiting. Last thing that happened was a C&P Exam in Dec. that strongly favors my Appeal. The examiner at the VA Medical Center said that my Remand was in Nashville. I spoke with Peggy a week or so ago and they said my file went back to Philly. So, I really don't know which RO has my Remand. Peggy said that the RO takes between 30 and 60 days to review the results of the exam. When I read the exam report, it is clearly in favor of me finally getting SC for chest wall injury caused by chest tube. I'm hoping to get 60% for that. The Asthma should be no less than 30% because of all the cortico-steroid inhalers. Lastly, I…

Has anyone ever heard of having a DRO hearing in a C&P Room at a VAMC?
I just got my hearing letter saying I am finally getting my DRO hearing, but that it will be at my local VA Medical Center. I looked up the room number they gave me and it is the room that is used for C&P exams. I'm glad I won't have to travel 2+ hours to get to the Regional Office, but I'm wondering if they are actually trying to schedule another C&P and just sent the wrong letter. Has anyone ever heard of having a DRO hearing in a C&P Room at a VAMC? Thanks in advance!

Pieces to a Puzzle....
Sorry for the long post. I am just trying to figure out what is going on..... Some of you may be familiar with our journey, but some may not, so I will try to fill in the gaps. My husband received his BVA decision packet in March, 2018. Migraines increased to 50% and TDIU remanded. The grant portion was settled in April 2019. Also in April 2019, we began receiving correspondence from the VA that they were working on the remand. Send any other medical records, employment info release form, medical records release form. We did all that. Then nothing until November 2019, when I emailed the BVA for an update. Their response : Thank you for your inquiry…

BVA Grant EED
As to my recent post, my head has not been on VA at all. I had to do some other things for a while. My question is, does anyone have a guess on a time frame for a recent granted EED claim?

Is this a legitimate claim? EED
If you filed a claim say in 4/22/1998 (original) They came back and denied that claim, June 1998 then you sent in NOD May 1998 they came back in 1999 and gave service connection.Around March 1999.. .ok year or so goes by and you reopen this claim in 2000 and send in new evidence and they come back and give you a 50% rating so you go from 0% to a 50% rating in less than a year (for hearing loss) ok you apply for Increase in Dec 2002 and have a botched up C&P and they send you a proposal to reduce you back to 0% but keep service connection. .you request a DRO Hearing to get this proposed reduction solved before it becomes a reality....ok at your…

BVA 2019 Performance Report
Here's a link to the BVA's post-AMA performance. It's still slower than watching trees grow. I have higher hopes for all this after the glut of old Legacy claims are processed. The quality of the Veterans Law Judges have improved markedly and their attitude has also become more pro-Veteran. I'm especially impressed with Judges Crawford, Lane, Blackwelder, Clementi, Powell and Hennings. Regardless, we're light years ahead of where we were when I entered this area in 1989. We always faced three anti-Veteran judges with one wearing a Dr.'s hat as well. https://asknod.org/2020/02/09/bva-post-game-wrap-for-2019/

NOD for Effective Date
I think I decided to file an NOD for my TDIU\PTSD effective dates but wanted to get some opinions before I open the can of worms. I filed for PTSD 4/18 and my claim was placed in deferment without a C&P in 7/18. When I called to inquire why I wasn't given an exam, they miraculously sent me an appointment for 12/18 The doctor denied my claim stating my MST trauma was due to a childhood incident, but my claim was never closed. I wasn't sure how to approach not getting a denial, so after going to therapy for several more months, filed a supplemental claim for PTSD, which sent me to another C&P in 8/2019...this time a separate VA doctor didn't even listen to …
