Proposed NOD Response by VSO Rep
Howdy All. I recently received a decision letter from the VA that approved some of my claims, denied one, and then deferred the remaining ones. So after I reviewed the decisions and rating percentage I have decided to file NODs on the rating percentage on my knees, denial of my lower back claim, and effective date of my OSA. So out of courtesy I emailed my VSO Rep and told her what I planned to do. Rather than saying "OK" and I'm here to help she just said on what and why. She didn't even mention any support for what i did win. I am honestly surprised by here less than positive and supportive response. So my impression is she is preparing to try and shoot me down or try…

VSO Letter
Why would a DAV service officer send me a letter saying earlier effective date denied when I have not even filed my NOD as of yet?? I thought I have a year from May 2018 to file NOD if I disagree with the effective date. C-file clearly shows information beginning in 2003 when diagnosis of illness that led to death in 2010. Electronic submissions are numerous, private facilities, doctors, congressional inquires, as well as formal claim in 2009, and VA medical evaluations, and death in VA Hospice. My husband was unable to file claim because of his disability and mental status that caused IU . I did it all. Now, is it too late for me to file NOD for earlier date??

I just found out i won my BVA appeal saying that my bipolar disorder is service connected what will happens next? They didn't give me a % or how long will it go back?

NOD Question on Effective Date
Howdy all. I have a partial success. My OSA (sleep apnea) was just approved secondary to service connected (SC) GERD, My left knee problem was approved secondary to my SC right knee, my Tinnitus approved SC at 10%, and I have several in deferred status waiting on re-check C&P Exams (they did not like the first ones they got I guess). They disapproved my lower back problem as secondary to the SC right knee (caused a fall) . So I know I need to get a second opinion from a neurosurgeon on that one to support a NOD. NOD Question
I have submitted requests to reopen a few items the VA denied initially in 2001 and 2008. I have also requested some increases of items they did approve in 2001. SO my question is concerning submitting a NOD if I disagree with the VA. Do I submit one NOD per claim even if I have multiple disagreements for that claim like percentage and effective date? Or would I submit an individual NOD for the effective date and one for the rating?

Our Appeal Story, Timeline, and Question on Remand
Hello everyone and thanks for your time on this post, I apologize for the LONG post. This dates back to 2005 * My husband's original claim for SC on migraines and PTSD was in 2005. He was denied. (Gulf War Vet in 90-91) * he appealed and in 2006 he was granted SC on both for 30% each in 2011. From the BVA decision to the VA implementation, it took 14 months!!! Case closed and back pay not for dependent
My appeal closed and my money deposited today after closing yesterday, but I got nohingt for my dependent only for 70% disability me alone, even though I have my daughter as dependent listed which you can pull up on benefits. Do they do that separate?

WHY?
Hello Hadit community. Many of you know our background. Here's the latest.....I filed an IRIS inquiry several days ago asking for the status of a dependency claim on our daughter in college. These claims usually take a couple of months. I filed the claim on July 4. Estimated completion on Sept. 5 (according to ebenefits). So 2 months AFTER estimated completion, I did the inquiry. Here's what it said: A review of our electronic records shows the dependency claim is awaiting finalization of the appeal that was granted March 3, 2018. It goes on to say that the appeal is pending reivew and processing.......etc, etc, same old, same old...... So I guess we will not…

RO Denials
This may be a dumb question. When the RO denies your claim are they supposed to state why your submitted DBQs and IMOs did not out weigh their opinion? They only state that their MO stated they could not find evidence of service connection and under the heading of "Favorable findings identified in this decision "Treatment Reports" and not the IMO itself. Does this suffice as indicating they looked at the IMO? It does not mention the other DBQ which was also part of the file. Thanks for any and all opinions.
