No DRO Hearing
Just received a VA big white envelope with the Statement of Case enclosed. My NODs were for multiple denials for service connection of disabilities submitted over two years ago. NO DRO hearing was provided, even though I had requested one when filing the NODs All i was provided was where some DRO reviewed the evidence and denied it all. Returned the enclosed VA Form 9 with no new and material evidence, and a request to send my appeal to the BVA for an in-person hearing at a VA office. I wonder what the timeline will be for the hearing to be scheduled(St. Pete)? 3 more years, or less?

Received BVA decision
Good afternoon! I received the BBE from the BVA and all of my contentions were remanded by the BVA Judge. I’m fine with the remand; however, I believe the judge made an error writing my decision and I wanted to pick some brains. Two of my contentions, my right and left ankles were on appeal for a higher rating of 10 percent each. The judge remanded both ankles for and entitlement to initial rating in excess of 20 percent each. I wonder if the 20 percent is a typo or if the judge is directing the RO to begin the rating at 20 percent after the C&Ps. Have anyone seen this type of decision before? Thank you!

Really BVA....
I haven't got the letter in the mail yet, but I checked E-Ben for signs if the BVA approved me for an earlier back date and I found this when generating the detailed benefit letter that states you're P&T. It says my date of 100% is on 02-01-2016. I don't remember if this is the original back date; so, I compared it to when I got my first monthly comp payment. My first monthly comp payment was in 11-01-2016... So it would appear the BVA has only granted me an extra 8 months of backpay? [edit] Nevermind. Lawyer just confirmed that nothing has changed yet.

Case with veteran law judge
So about 2 years ago I was awarded 100% P&T for PTSD; however, the VA did the backpay to my last C&P exam. My lawyer feels the back pay should go back many years more than it did. When it shows as, 'Case with Veteran Law Judge,' how much longer do I have until I know if he grants be a better back date?

NOD, CUE, or some other process
Hi all, As i said in another post I am new here and looking for guidance, opinion, options that may be available to me. Without all the gory and boring details, I am currently rated SC 70% PTSD, 10% Tinnitus with a statement that my bilateral hearing loss is not service connected. This all comes from the same original claim in 2012. I found out last year, 2017, that in making the bilateral determination the doctor only looked at my second enlistment and did not review any records from my first enlistment. I found this out when going through my records which took years for the VA to "Find". In the records are audiology test records from the fi…

What's my next step? BVA remand being returned to Board
Hello Hadit community, I received an IRIS response a couple of days ago regarding my husbands Grant/Remand from BVA. Based on the letter, my grant is being worked at the RO and is "pending" review. The Remand (for TDIU) is at the ARC, but is soon to be sent back to BVA for a final decision (which means it was denied, I think). The letter is below. My question: We recently (this week) got a letter from my husband's doctor stating that in his opinion, he is unable to work and unemployable due to his disabilities. Should we go ahead and send this in? If so, where? To the BVA, ARC or both? Or should we wait on the SSOC? Also, any other interpretations of …

Remand of renal failure and iu
Will they rate the renal failure. Should we send anything in on hubbys stay in hospital o aug 27th with pulmonary embolism. Since it did effect his Kidney and heart? They did send us the Iu papers to file. We did not originally file. That was their suggestion. So we did file last week, and got it sent back. Should we just wait now and see if they are going to approve it quickly. And will they go back ten yrs on contacting the employer. We gave them the address. So it is up to them if they contact his employer. We are waiting for a referral from our private dr to a private pulmonologist.

Claim Returned, Migraines at 0%?
Hey All, New to this, so appreciate the help. My migraines were granted service connected, but at 0%. The only info they asked for was how often I had them and if they made me lay down. I said they did, and that they are apx 1x/mo. I was surprised to see a 0% rating. What do I do now? Do i need to see a neurologist, or should I just keep journals. What is the best way to appeal? Appreciate the help!

first filed & EED?
I realize this has been Answered 100 times But I still do not understand it. If Veteran files HIS FIRST CLAIM IN Feb1998 claim and is denied and NOD within a year Aug 1998 and gets a Service Connection but at 0% ok then in 1999 files a claim as reopen for increase and is awarded 50% for the same claim he filed back in 1998 then a year later he files for increase on the 50% in 2002/2003 and is Awarded 90% INFEERED TDIU P&T NO FUTURE EXAMS DISABILITY CHRONIC IN NATURE OK what would be the Veterans EED? FOR THE 20 YEAR PROTECTION RULE? Would VA go back to the 1998 date the claim was first filed? or go back to the date the 50% was incre…

To "RAMP" or not to "RAMP"
As many may know, Congress has passed new legislation which essentially requires VA to cut down on appeal backlog. This plan is known as "RAMP". Currently, only Veterans who ARE INVITED by VA can elect to go with RAMP. Im not sure it will do much good to write to VA and tell them you want RAMP, tho its POSSIBLE that VA may grant this request. A well known law firm has published some credible, and valuable information on RAMP. If offered a chance to "RAMP" through a VA letter, its probably a good idea to: 1. Just do it and go for RAMP. 2. At least read the following before declining ramp, and discuss this with your representative. https:…
