OMG please help me with this mess for NOD hearing this Friday
Okay so most of you know my situation... I have my NOD this Friday and I got my C-File in the mail today! Nothing like getting it at the last minute but I am sure glad I did!!!! Here is my issues and I need help please for my hearing on Friday! My NOD hearing is for right ankle sprain DENIED; right 5th metatarsal fracture DENIED; and left foot/toe condition. NOD denied and errors to boot! Need opinions
I posted this in my other ongoing thread but I want this brought to the forefront. I was recently denied by WACO DRO Steve Wilbur and I believe I was retaliated because I simply asked Robert McDonald in an email to step in after 6 months of waiting for a decision when the DRO told me in the informal hearing to give him 60 days. My hearing was 45 minutes long and I was well prepared. The DRO Steve Wilbur has a very bad reputation at WACO for denials. I received a call from DRO Wilbur on August 18th, 2016 stating he received my request for a decision. Va Appeal To Bva 5 Years Old Without Progress
This is getting almost comical. I have been in appeals to the BVA since 2010 and they still have not even sent my stuff to the BVA yet. I recently e-mailed Bob McDonald and got a response that they would look into it last week. When I send in an inquiry I get the exact generic same answer each time. Is there any specific legal recourse that I can take to see exactly what is going on?

Can I add Additional Denial Rebuttable While In NOD?
Filed for ankle and knee problems that both are documented in my SMR. I was denied with a reason stating that both were acute problems. I filed a NOD. I requested my c-file, received it on Monday. Had a c&p from a contracted VA doctor so was not in my medical file as it was a contractor. The c&p doctor that did the ankle and knee exam opined the claimed condition was at least as likely as not (50 percent or greater probability) incurred in or caused by the claimed in-service injury, event, or illness. Questions on DIC
Trying to help a spouse who was separated from her 100% P&T husband, for 10.5yrs, at time of his death. Never divorced as reconciliation was a consideration. They paid her his final check but then denied her DIC. He died in early 2020 at a VA contracted nursing home in FL. VA never notified her of his death. Also tried to look up m21-1 but found the VA may have discontinued it?????? Thx

Supplemental Claim Denied w/IMO, High-Level Review Next?
Hi All To make a long story short, last year the VA granted my right-knee tendinitis 10% but said my left-knee was NOT service connected. I reached out and obtained an IMO from Dr. Anaise whose IMO opined that either my left-knee tendinitis WAS service connected or that it was secondary to my service connected right-knee. I filed a supplemental claim at the end of June and just received the decision back that they stuck with the original decision to not grant me anything for my left-knee tendinitis, stating that it was still not service connected. hypertension Denied Sleep Apnea Claim
I am new to this site and I will apologize ahead of time incase my question seems pretty basic. I was recently denied sleep apnea and hypertension as not being service connected. I will only ask about my sleep apnea at this time. I was recently diagnosed with sleep apnea (I retired from the military in 1995). I use to snore very loud while in the military according to my ex-wife. My question is will a statement from my ex-wife be enough to justify my sleep apnea? I was also given a service connected rating for my scoliosis of 20%, I have read online that spine problems can cause sleep apnea. VSO states they work for the VA not for ME
So, as some know I have been having a little war with the VA and my VSO, the American Legion, about getting my DBQ's. So today I went to the VSO's office in the VARO building during their "walk in" hours since I could not get them to give me an appointment. On the door was as sign saying the office was closed for the week for training and left the 800 number for Washington DC office. I knock on the door anyway. Two ladies answer. Tell them what I want and that I need them to do it today. They invite me into the office. The Dav Did Me Again!
So I get my new SO with the AL, but before that I FAXED my NOD with a request for a DRO hearing and the correct VA form for the NOD, I had a cover letter addressed to the VARO. So Friday I get a letter from the DAV GUESS WHAT THE DAV DID!!!! THE DAV SO SENT IN MY DOCUMENTS AS A "RECONSIDERATION" WTF!!!!! Attached is the letter I received from the DAV on Friday. Hugh
