Reconsideration
Hi everyone- What is the process to file reconsideration of recent BVA decision. Evidence from Voc Rehab (letter of infeasibility) supporting TDIU was submitted 7/6/2017 prior to date of decision 7/13/2017. There is no reference of letter in the decision. Are there any cases that I can include when I request a reconsideration? Thanks for feedback.

BVA Docket Date "The Long Wait"
I am at the stage of Appeal to the BVA as follows: notice of disagreement effective November 2015 w/Claim certified on 3/24/2016 and waiting for a non-video hearing as established in coordination with Washington DC via the Winston- Salem, NC Region Office. Currently, as of 7/20/2017, I am being told by customer service at the BVA in DC, "we are working on claims Oct 2013...." Question: what if anything might I do at this point? As it currently stands it could be another three years ( year 2020) before I receive a hearing. And although I am content and satisfied with my attorney, I am dis-heartened that the only person winning here is my attorney drawing 2…

White House Hotline question
I am thinking about calling the White House Hotline to see about several NOD's that are well over 900 days old. I am second guessing myself as I do not want the VA to retaliate against my claims because I am rocking the boat. The RO keeps telling me there are about 700 claims in front of me. That has not changed in over 6 months. I know many NOD's are older than mine. It would be nice to have some forward movement in my place in line. Has anyone heard that the VA retaliates against veterans for calling the White House Hot Line? Does calling the hotline yield any positive results?

agent orange related diabetes mellitus type II BVA
I was diagnosed with Diabetes Type II in October of 2010 and filed a claim for disability benefits related to Agent Orange in January 2011. I was denied about one month later for failure to prove that I ever served in Vietnam as part of the AO presumption "nexus". I filed another claim for diabetes in 2014 after receiving "buddy letters" and was awarded 10% rating for diabetes. I discussed the earlier claim with my representative and was advised to file a NOD which was denied. I have just recently filed a BVA and received a letter today stating that I am being offered a videoconference. I have several questions. First and foremost, if the original claim is approved …

STUMPED
I had a C & P DBQ done by a VA ENT Clinic in late 2015. The VA examiner diagnosis was Hyposmia ( reduced ability to detect odors) and Hypogeuisa (decrease in sense of taste). I was made an award of 0% for both based on the C & P Examiner stating in Remarks Section: "It is at least as likely as not loss of smell/taste is related to SC allergic rhinitis." Further, under Remarks, C & P examiner stated "No reagents available in ENT clinic to test loss of smell/taste." I did not identify with the word "reagent" so I looked up the medical definition: :"a substance used in a chemical reaction." I was given no testing substance or even a blind test of any kind …

Help with some VARO and NOD questions
Hello, First time user so please bear with me I got a phone call from my VARO yesterday, apparently the Appeals department he said. I entered an NOD in 2016, for PTSD and Migraines. I sent in DBQ's for both, Nexus letters for both etc... After they received the NOD they requested more information from my Psychologist, which she in turn sent them 38 more pages of treatment. Since then I have heard nothing until yesterday. The man from the VARO said he just had a question about one of my stressors and asked a few questions. He said he had all my other paperwork and DBQ's and Nexus. He then stated he was the one who gathered the information so I a…

Regulatory or Procedural Review
So, I apparently had a regulatory or procedural review, which was started by the VA on August 8, 2014. This procedural review was closed on 7/6/2017. I called the 1800 number and the lady didn't know for certain what it was even for, as there wasn't a note regarding why it existed. She then went to look for my form 9 and couldn't find it. My initial claim was submitted July of 2012, and subsequently denied on all accounts. I appealed their denial, which has been stagnant for some years now, without communication from the VA or my representative (i'm an idiot and obtained an attorney group). Everyone I've spoken to at the VA has sidelined what the status of my appeal…

Awarded IU and Chapter 35
I just got a call from my regional office and was informed that I was awarded IU and Chapter 35 benefits. I am in shock as about a month ago I received a SSOC that stated the case was not settled and then my lawyer submitted a Functional Assessment by an independent physician 2 weeks ago. I received the call today stating I was awarded IU and Chapter 35 benefits. Does this mean permanent and total or will they award Chapter 35 for TDIU?

BVA average waiting time
I received a letter from the BVA saying they had my appeal and that I have a docket number. That was September 7, 2016. They said the average wait time is 270 days. I was just wondering how accurate this waiting period is. My docket number is 14-38003. Is there any place where I can actually keep track of how much longer before my docket comes up?

DRO Hearing
Hi Guys, I wan to thank you for all the help you have provided, it has been great for me! I have a question. I will try to make this brief, as possible. About three years ago, I felt the V.A. was "stonewalling" me on a couple of issues, my back and my lungs. I call the V.A line to MacDonald and Hinkley , and within a week, I was contacted by a RO from Phoenix, Az. She was handling my case, and just need completed DBQ's and Nexus letters, and any recent tests pertaining to my back and lungs. She said no C&P exam was necessary. I provided her all the documentation, and she said this was want she needed to finalize everything. I get a letter for a C& P exam…
