Question on NOD process.
I filed a NOD via a "de novo" review by a Decision Review Officer (DRO) back in 2015. I filed the NOD because the VA denied my claims for failure to show up for C&P exams. (Never received notice of exam dates). No Statement of the Case [SOC] received. JAN of 2017 received notice of C&P exams; I went to the C&P exams. From what I understand, at some point, I should receive a Statement of the Case [SOC]. So far, at no point have I received a SOC from the VA. My address has not changed. My question is, what is the next step in the above described NOD process? Can the DRO just turn back on the claim process without me having to go to a DRO Hearing? Or, is t…

DRO hearing transcript-wager a guess
Im guessing the latter. A grant to January 2010. My hope is that it would go back to 2003 when I filed after a VA diagnosis of 'Anxiety R/T military experience' <br /><br /> But that was not put on the table by the DRO. ...he'll leave that to a VLJ..<br /><br /> The way I see it is that the letter of the law allows for a "Yay" and a "No Way".<br /><br /> The spirit of the law nudges it to a "Yay", and with a January 2010 effective date, there won't be a need to CUE the previous RO descision in 2008 and their inflexibility of my Substantive appeal "you had until March 6th...We received it on April 4th."

hypertension file a reconsideration?
Hello All, I just seen my c&p exam results. I filed for a loss of organ claim secondary to TCE exposure, from working with TCE for 15 years. Had a nexus from wrii exposure VA doctor saying it was at least as likely as not being exposed to TCE for a prolonged period caused it. My two questions. Dr. David Anaise will do an IMO after I send him all that I have on it. Do you think two against one opinion would turn it in my favor and what form or how do you file for reconsideration instead of two year NOD wait? Question on contacting VA Secretary
When emailing the VA secretary for assistance with a VA claim, do you have to send your entire SSN or can your truncate your SSN. I just don’t like putting my SSN on unsecured emails. VA secretary's email: david.j.shulkin@va.gov

Representive
My husbands claim has been with rep for over a year now. I called once and ask to speak to the person that was handling it.. go a name and talk to him. Then we called again to talk ask for and was y,told he was no longer there're. We out like to talk to the Pierson hadling it now . Was told it had never beem assigned. I'm going in for knee surgery tomorrow. When I get back home we are to call them again. The we are going to call that magic number, and see what we can find out.

ptsd Enjoy Life
I won SC for my sTBI and was granted SMC S so not sure if it's worth all the time of exhaustion, frustration for my family life. I'm literally tired like you have to be for fighting what I know I deserve. I think I'm taking some time to get my health under evaluation so I can start an effective treatment to help with my residuals. My claim was started in 2010 didn't grant SC after my appeal in 2016. Maybe someone can explain what all the it takes for one to go from SMC S to T (r2)? Asking the VA to CUE itslf
Question, when you have asked the VA to CUE itself regarding an obvious error, was the action noted on ebenefits? I sent the letter and all the supporting documentation to the intake center. I have a return signed receipt so I know it was received prior to a year from the decision. I however can't find any mention of it on ebenefits. Thank you

C-File info assistance needed
I filed several NOD's back in late May 2016, and at the same time I submitted a Privacy Act Request under the Freedom of Information Act for my C-File......ebenefits said estimated completion: 12/22/2016 - 04/24/2017......Current Status: Gathering of Evidence. Those dates have now expired......11 months now.......have not heard a word from anyone. Who can I contact to find out about my C-File status as estimated dates have expired? My RO is Waco, Tx. ptsd Appeal at Court of veterans appeal
I have been away for quite a while (couple of Years) mean while I have had a couple of operations that tended to knock me down a few notches. My appeal is at he court waiting on a ruling. My attorney filed my brief today so hope some kind of decision will come soon. I am hoping for a panel of judges to review my case and send it back to the board as a remand and set aside of their decision. Not real sure on my changes but my lawyer filed a very good brief on my part based mainly on my inability to follow their rules due to my PTSD and many disabilities already service connected for. hearing loss Bad Legal Advice?
I have a hearing loss claim on appeal. Attorney suggested we drop that claim as the compensation will likely be 0%. My idea is hearing loss progressively worsens over time and at some point will require hearing assistance medical devices as I age. As that happens, I could submit new claims for an increase. Personally I think it is worth fighting for.
