hearing loss APPEAL FOR TRAUMATIC BRAIN INJURY
I am currently rated at 40% combined and have filed for both TBI and Tinnitus (ringing in ears) three times and have been denied three times. The VA neuro tech that saw me during C&P exam stated that my getting knocked out after falling down a stairwell on a ship was not serious enough to constitute a TBI, but maybe a mild concussion, and that I show no cognitive issues now. I also have Tinnitus in both ears, and VA denied me; yet after the denial, they sent me to a VA contracted audiologist who determined that I needed hearing aids for hearing loss (minimal at certain ranges) and Tinnitus. ptsd Dx VA clinic
This is in my medical records and entered in 2011 the DX for ADHD and was given straterra to help. I never filed for a claim had to stop taking the meds since I was a violent sleeper and that's if I'd been up for days. So forgot about it then dx for my sTBI and my dx PTSD came through. My neuropsych test from 2007 2010 mentioned my ADHD and then again it showed up in my 2017 test so the doc wrote dx sTBI with HX of ADHD. Last week doc Dx: TBI with memory/cognitive deficits Adjustment Disorder and then put me on Ritalin. I filed my secondary claim as ADHD I didn't realize it should have been chronic adjustment disorder? Is this something that is considered the same thing…

Questions with a claim or appeal
Ok so I can't respond to all posts with the same answers and to prevent Me from.missing your post. If your claim is stuck or appeal is stick more then 60 days don't feel like it's the norms. Please listen to that 60 days start asking what will get my claim moving actually call as much as you they can see the trend on their system (202) 530-9470 to get your shit rolling pardon my french. Advice on appeal
Got my packet yesterday as I stated I am rated at the T rating =R2 they denied my adapted housing The V A gave me a power chair and a lift for my house I can only use the chair in the living room my doors are to narrow also I need my handicapped bathroom can I agree with the T rating and disagree with the housing this is my appeal not a claim it said if I disagree it will go to BVA. I am happy and not greedy I don't want to leave my house it needs to be upgraded Thank You for any input

NOD Processing Time
Hi all, I hope all you fine vets are doing well. I wanted to get some other vets experiences on how long it has taken your RO to review your NOD. I submitted my NOD to the Roanoke RO on 12/24/2015 and elected the DRO review. It's been sitting there collecting dust ever since and is currently at 420 days and counting. I call Peggy on a regular basis and they give me the same sorry response that it's currently waiting on the DRO review. They have also consistently told me that on average it takes the Roanoke RO 246 days to complete their NOD reviews. That average hasn't changed over the last year despite the Monday morning reports showing that this RO is working o…

Congressional Help with Claim
I am going on nine years of waiting for my notice of disagreement to be settled. I went before the BVA in May 2016 and was sent back to the regional office for further review in October 2016. I was wondering if my congressman would be able to help me out in this matter and I do not want to stall the progress of my claim or cause any conflicts any recommendations would be appreciated. I have a financial hardship in on my case also. I was told this would help my case to be speed up but it looks like it has stalled again at the RO.

Francisco v. Brown (1994)
. . . when "an increase in the disability rating is at issue, the PRESENT level of disability is of primary concern." I read this holding by the court referenced continuously on claims for increased Initial ratings that I've researched. If by "present" they mean right now as of today, current - I know they are to consider the entire history of of an injury or disability, but how much does my present level of disability weigh and how does it relate to the overwhelming medical evidence and sympyomatolgy of a still pending claim of 35 years ago? That was then, this is now.

tdiu Floating WTF!!!!!
I just left RO and was told that my finished BVA grant was floating around the RO and she could not tell me where. I guess I should start floating She also said to me that the retro may go back to 04 if the judge gave more probative weight to doctors opinion back in 04. In the judges decision she did reference fast letter 13-13 which I looked up and it explained that if a veteran claims a disability as totally disabling and submit the form stating that. Apparently the VA no longer consider increased claims as an automatic claim for TDIU. It would be great if they went back to the original opinion stating that I was unable to secure gainful employment …

ptsd Awaiting a remand decision from RO
I had a BVA video appeal in December of 2015, which resulted in a remand on all the following issues : IU, increase PTSD, and ED The VLG ordered new C&P's, with instruction to the RO. I had the C&P's in July of 2016. I know they should either grant the claims, or support their previous denials with a SSOC and forward the claim back to BVA. Thing is, It's been almost nine months from C&P's. Do you think they are stalling ? if so, What can I do about it ? I do have an attorney, which he's written a letter to the RO, but we havn't gotten a response.... Thanks for your reply.

700 + days and waiting on NOD
I have a question on the best path forward for a NOD I filed over 700 days ago. I filed the NOD in response to several disability claims that were denied for failure to show up for my C&P exams. I never received notification of any exams so, I did not show up. I filed a NOD contesting the above information within the required time-frame. Ebenifits shows no change in the last 700+ days on my NOD. My calls to the VA's 1800# have yielded no results, they say they have no estimated time-frame for completion, and no updates on the NOD's progression. Not making any progress
I have appealed twice and yet I haven't seen any progress. I have an Si joint sprain which has resulted in degenerative disk disease. I have tendonitis in my left shoulder. They have me rated a 40%. I would like to increase my rating % as I am finding it more and more difficult to stand up and perform everyday duties.

BVA Hearing - In-Person
Have an in-person BVA Hearing, Washington, next week. I'm going without representation. Looking for words-of-wisdom as to the general feeling of the conduct of the Hearing, etc. Is there an appropriate dress code? Are there certain things I shouldn't do...should do? Over-all what is the general tone of the Hearing? Formal? Informal? What is the general competance level of a Veterans Law Judge? Any other advice will be greater appreciated. Thank you.
