ptsd DRO and Appeal
Face to Face DRO meeting in Nov of 2015.regarding appeal for Sleep Apnea/PTSD connection. Had two sleep studies at VA resulting in C-PAP since 2011.This meeting was productive in that the DRO acknowledged the documentantion from the sleep clinic and the fact that I was on C-PAP. Also nexus letter from a provate doctor who stated that psych notes indicate a relation between Sleep Apnea and PTSD. Jan 2016 had hearing with VLJ. That claim is currently under review at BVA by a VLJ. At different stages can these claims impact one another? thanks for the support GBA

Should I contact the Secretary?
Hello All, Some of you may know, and I'm hoping for some advice... 5 months ago, I was granted SC for several issues with a minor remand for issues that reach back to my original filing date of 2008. I'm looking at tens of thousands in back pay. I've heard neither hide nor hair from the VA regarding my SC grants, back-pay, or anything for that matter since the original SOC from the BVA. I work with lady here who used to be pretty high up in the VBA and came to my place of employment after a stressful time at the VA. She told me that BVA cases should be implemented within three months and that my five month wait time is the apparent exception and NOT the ru…

BVA just keeps up the Delays
So when I called today apparently they are just sending me a letter that states we are trying to withdrawal your request for a hearing. It was faxed in on the Feb 8 and my motion to advance was granted and the VA sent me a letter dated on the Feb. 26. But today apparently they are just sending me a letter saying they're are working on fixing why it still says in their computer that they're still trying to schedule a central office hearing. Expedited they tell me nothing takes to months to withdrawal a request when no hearing was every scheduled. They will take so long they are going to schedule a hearing take even longer with my appeal say it was my fault they now have to…

Interesting regarding my FDC claim/NOD
So most know on here my situation. I filed an FDC back in January for several issues to include 100% temporary convalescence for right foot due to left ankle. Right foot is NOT S/C so since my left ankle caused the fracture I put in the FDC. After filing the FDC, my NOD finally processed and I had my DRO review hearing last month. I noticed after receiving my C-file my FDC was "RTR" ready to rate but I assumed that it was going to wait until AFTER my DRO hearing and all those issues were resolved. My NOD included all my feet issues. Ebennies showed Preparation for Decision back in February and so it sat. Well today I checked Ebennies regarding my FDC claim and I no…

Anxiety Appeal pending.....
Hello:) Pretty new to this site, but have read some great advice, and support, so I will ask for some input for my appeal. Back story... I filed for anxiety in 2013 (I should've claimed it in my separation exam in 2009-- but didn't want that "stigma"...silly I know) Claim closed in mid 2014. They rated me 10%... Mind you, I had anxiety in service (due to a traumatic event) and was on medication for many years. I filed my NOD in the summer of 2015 ( I know.. it took me a while to file it, but I was going through other family events, either way I got my appeal in within the year mark) When I did my initial C&P with the mental health DR... I had told th…

Strange NOD acknowledgement, Outdated Right to paid Attorney info
I received a letter dated February 19, 2016 informing me that my NOD had been received. Included with the letter was a generic “Appeal Process Election” form which they want me to fill out and return within 60 days. This seems odd since the new NOD VA FORM 21-0958, which I used, asks that very same question in Part III Sec. 9 entitled: “Appeal Process Election.” My election of Traditional Appellate Review Process was clearly marked. Also, there is a third option on this attached “Appeal Process Election” form which does not appear on the VA FORM 21-0958: “[] I have reconsidered and wish to withdraw my appeal.” This just seems like another crude attempt at…

BVA Reviews
So a lady at the BVA line said my claim is slatted to been finished with the review by May 14.She said she sees the advance was granted and awaiting a Judge to pick up my file. Are they allowed to even tell me the date she mentioned? It makes sense since that is exactly 90 days after the motion was granted.

Tinnitus Denial. Need To Appeal
First time poster but have reading Hadit for over a year. Here's my situation. I filed for Tinnitus June 2015 and just received my denial letter. I see many errors in the decision. Did not follow VA training Letter 10-02. Did not consider my IMO. And I don't think they actually read the whole C&P exam notes. Also, doesn't look like the examiner had my SMR. Only my VA records. I am in the VA medical system. No service connection. I am not claiming HL. Only tinnitus. I will omit the hearing part of the exam but include her opinion on it. The examiner didn't even want to look at my smr that I brought with me. Bold parts is what I feel is relevant to an appeal. I entered…

Now what?
03-19-16 Granted 30% asthma according to AB8 letter. (From 06-03-2011) 03-20-16. Received SOC regarding headaches. 03-21-16 Submittef rebuttal to SOC and fired VSO. (Did not follow remand instructions/failed to consider nexus for migranies related to service connected asthma, rhinitis, nasal blockage, deviated septum never addressed). Have not received official rating yet. Also did not receive retro payment or new monthly adjustment for April. Damn VA. Real good at sending BS denials. Not so good at getting Veterans their entitlements when proven wrong.
