NOD in review status?
Hello, I went to my RO to request to view and get a copy of my C-file as I have seen so many others on the forums say is important to have. The representative ask me why I wanted the information and I told him simply that many other veterans has told me I should have it. He then asked me if I had an open claim and I told him of my NOD for request for increase that is right at 18 months old. He said that many take much longer and some get through in the 18 to 24 month time frame at my RO. He then pulled up whatever he could see on his computer about my NOD and said "well it looks like it is under review now." He ask me what evidence I had submitted with the NO…

ptsd Mental Disorder was added today by someone at regional office on ebennies during my appeal for PTSD increase. Is this a good thing or bad?
I currently have an appeal for an increase in my PTSD rating and TDIU. I noticed today that the RO has added mental disorder in the pending disabilities section as NEW. Is this a good thing or a bad thing? I never filed for this they just initiated it. Will this help or hurt? It seems alot of confusion in deciding my appeal stems from my mental problems and PTSD that cant be differentiated.

new claim, appeal or reconsideration
OK Experts, I am currently rated 30% under migraines for headaches NOS. Before i ever put in a claim, I was experiencing jumping of my left eye. I kept going to my family doctor and telling her about the issue and also at my year eye exams. Explained the issue with my optometrist. Kept being told it could be stress, eye strain, lack of sleep. As my headaches became more frequent due to the issue or thee issue made headaches that much worse and the jumping moved down the side of my face to my lips. Well this scared me so I made an appointment with an opthamology specialist, he ordered a cat scan. Diagnosed as hemificial spasms: hemifacial spasm by definition …

I think Regional forgot about my case!
That was the successful conclusion of my case........ but it wasn't. As it turns out, they remanded a bunch of stuff back to the Regional office. They ruled on my Spine (cervical) in my favor. In the ruling, they remanded the Psych claim along with most of my secondary conditions back to Regional office. and here we are almost 2 yrs later and I have heard nothing...... Any thoughts?

Med Evidence during Appeal
after my BVA HEARING in may 2015.. and While waiting for the judges decision.,, the Regional office sent me to a QTC exam. this exam was done by request of the RO not the judge. the judge has yet to make a decision on my case but i just received my copy of this exam and it is so good in my favor infact it directly says key point is likely service connected. my Question is, should i assume that the BVA knows about this and already has this in my file as new evidence after the hearing or should i find out how to make this put into place so that they are forced to see it?

Need a Bit of Help... Clock Running out -- HELP!
Hi: Have had four separate claims on appeal to the DRO for several years. I received a DRO denial (after 4 separate C&P exams) in late September on all four claims conditions. As usual the SOC was as flawed as the original decision; evidence not considered, incorrect diagnosis, conflicting opinions with board certified physicians that provided a IME, etc. . I think I have a very good chance of winning all four on appeal, if I can spot the easy errors an attorney should have no problem. HERES THE PROBLEM: I had major surgery in late August and was in no condition to take care of business for a few months. Now I only have 18 days to file an appeal or …

ptsd Reconsideration for P&T
I am 100% schedular for my PTSD but I need to get P&T. I understand that the VA believes that I will get better because MH conditions usually improve but mine has not. I went from 10% to 70% to now 100%. It is steadily getting worse. I don't understand why the VA wont give me P&T. I have been getting SSDI solely for PTSD since 2008 when it was rated at 10%. I have recently filed an intent to file asking for reconsideration of P&T along with a 21-4138 and denial letter from vocational rehab. I am also willing to do a C&P in they want one. I was just taken off of a suicide watch list about a week ago due to my extreme suicidal ideation and mental impairment.…

Question on VAMC Care
I am trying to get a straight answer on this question. I have been told once you have exceed 51% in combined disability rating via VA math then a Vet is entitled to full healthcare services at any VAMC without anymore co-pays. Is this true or BS?!

Before I NOD, seeking input on SC sleep apnea
Hello HadIt Community, TL:DR Skip down to bold section “So that brings us to today….” I've been a bit of lurker on the forums, searching and researching information already presented, hence the lack of postings. I was not quite sure where to post this, in the “Appeals” section or the “Disability and Claims” section.” I decided on the “Appeals” section due to the fact that the claim was already submitted and decided on, and so the next step logically would be an appeal. Moderators, if it needs to be moved, please move it to the correct section. I know that there is a lot of postings, questions, and information in regards to sleep apnea and trying to ge…

NOD Submitted, Inc ordered?
Good Morning! My husband submitted his NOD at the end of August. He got called on Fri for a Increase appt for his rated condition. This was one of the conditions we appealed. He was granted an increase on that day effective for 10/28/2016. The rest of the conditions are set to REP (not sure what that means). Since he appealed the rating on the one condition and an increase was granted, shouldn't he get back pay to the original date? Also, how does the REP status work? 4 of the conditions he did the NOD for were stated to not be service connected. When we finally got his SMR, I found where they were contained in his records. I am afraid that…

C&P for appeal > 6 months ago
I had filed a NOD for CAD, High blood pressure and insomnia over a year ago. I had a C&P for the CAD & High blood pressure in February. The C&P office notes stated that as likely as not that both were service connected. Then nothing for going on 8 months. My local VA rep said he can only see the status he can't see who is working on the claim. How long is typical ? I didn't know if I should ask my congresswomen to help me find out whats going on or will that just set me back? - Steve
