Sleep Apnea - Appeal or New Claim
Greetings everyone! Seeking advice on how best to proceed with my Sleep Apnea Claim. I retired in 2011 after 21 1/2 years of Naval service and I am currently SC at 40%. I need advice on whether to appeal my Sleep Apnea Denial (VA letter dated 3/9/12) or to file a new claim, since the 1 year to appeal has come and gone. In July of 2012, I received Progress Notes (VISTA Electronic Medical Documentation) that stated a diagnosis of Sleep Apnea diagnosed while on Active Duty with a plan for Sleep Services Consult. I assume the Progress Notes that I have came from my SMR, which I located where it said I had Mild Obstructive Sleep Apnea and it is confirmed from the Sleep S…

After 6 years of no drilling or any contact, was medically retired
TLDR: Had Mono and after a Live Flu Vaccine, got extremely sick and haven’t been the same since (going on 7 years). Was medically retired last month but backpay only from this past Feb (No TDRL or light duty), and other related conditions stemming from the same illness rated at 0% and Not Service Connected. So I’ve been meaning to write this for a little while and finally here I go. I’ll try to make it as brief as possible because Lord knows I could probably write a book on it. Background: - 4 years enlisted AD USAF - After being out for a couple years (IRR) went into the USAF Reserves for a little while and got out as a SSGT - Went into the Army Natio…

Appealing Denial of Secondary Claim
Hi All! So i filed a claim for secondary condition of Arthritis of my hips beginning of June 2016 and just checked ebenefits and seen that it said not service connected. I must mention that Iam service connected for 8 of my major joints with arthritis for the exact same condition but denied for my hips. I didn't have a C&P exam for my hips but did for the other eight major joints that was done in 2014. When they didn't call me for a C&P for my hips I was thinking that they have all the information they needed other than the doctor notes from my x ray showing that I also have arthritis in my hips. They have all the other documents in from 2013/2014 claim so I…

tdiu VA Form 9 Filed Today
I thought I would share this Form 9 info because, even though I am 100% TDIU, the VA has screwed up the effective date, thus shorting me and my lawyer out of roughly $73k. When all is said and done, THIS is why disabled veterans should hire a lawyer. Do note the various "tricks" that the VA uses to deny appeals. This is what you can expect from the VA, unfortunately. Keep your eyes wide open, if you are at this stage of the process. This document was scanned and OCR'ed but several mistakes in the OCR are still present. Please ignore the grammatical errors and such:
