Who do you believe
Called Peggy today. She told us we should have a decision on my hubbys cad recheck around nov 8. We ask about appeal and she said they have mad a decision on 9/8,. And we should receive a letter. She said she could see the decision but she could not tell us what it was. So we called the bva number,. Some guy answered the phone,. He did not sound like he liked his job at all. But he did say they have not made a decision yet and it was showing still with rep. Now it was aug 30 when we had the girl at eglin send all the labs and dr new dbqs in. It was showing even before she sent this in that it was with rep on ebenefits. Could they have gotten the info and immed…

Sleep Apnea question about CPAP prescription
I will have been on a CPAP come a year Dec. 1st. As I understand I have to turn my CPAP into my local VAMC, which I assume is to show the actual usage in order to get prescribed for another year of usage. My question is what is VA looking for inside the CPAP besides obviously the conisitent usage, and what actual data is there for them to see and evaluate? I read somewhere that they can see if your apneas have increased or decreased......is this true? Has anyone ever actually gone from moderate or severe OSA to no apneas ? If this is true..........I do not understand how it can go lower in apneas when other conditions are still involved like allergies, sinus, deviated …

Seeking information on DRO Hearing & CFile
Q1 - I am trying to get a general idea how long it is generally takes to be scheduled a DRO Hearing date for a NOD claim. My hearing happens to be in Waco. Q2 - Does anyone know the current rate of delay for receiving a CFile from whoever does the actual processing? I read somewhere awhile back that it is running around 8-9 months......wondering if that still sounds about right - or perhaps longer? Thanks for any replies to any of these questions individually, or answered together if possible. WayneTX.

Odd question
My heater man is a vet and asked me where he needs to send his I-9. He deals with Buffalo like I do and does not want DRO review etc. I am 99% sure he needs to mail it to the Buffalo VARO with proof of mailing and I dont think ebenefits can accept an I-9 appeal on line. But I feel better checking with you guys. VA makes me even doubt what I think I know sometimes. I also believe he does Not need to waive further RO consideration formally. I gave him our web site info and he said he would join.

In home stretch for decsion after all these years of appeals and claims
In home stretch for decsion after all these years of appeals and claims. I want to post some info about the claims and appeals, and research that went into the process for injuries and diseases from chemical exposure on active duty, all the filings, research for doctor's IMO's. All of the VSO's failed attempts for lawyers to help. My claims go back to the 1990's and injuries from about 1978. The appeals, the hearings, the dockets. The C&P's, The judges remand telling the VA to include al of my medical records that were never included, and or omitted. The very long hospital stays, surgeries. More letters, more statements. I want to know how and where to post info so ot…

How should I handle my appeal
Hello! I recently retired from the Coast Guard in July and had already submitted my claim application for disability. I submitted a lot of medical records up with my claim. A few weeks after I officially retired, someone from the local district contacted me to set up my exams. However, at the time I was traveling and was not able to make the dates they had set up. I was told that my exams were going to be cancelled and that I should call the national number and have my exams rescheduled. Well, a couple weeks later, when I got back from traveling, I received a decision on my claim with a 50% rating for sleep apnea and a 0% rating each for my ankle and both hips. All …

Favorable C&P exam turned into unfavorable after addendum
Greetings all, This is my first post after looking for similar situations. My C&P exam for spine issues was in June and it seemed favorable until an addendum was made this month which turned everything around. They denied my claim for aggravated spine issues and had inaccurate information stating my condition didn't progress until after service. Is the best way to go about this by filing an appeal or by making a new claim for low back pain?

Overpayment Letter...WTF?
I need help on what to search for on this forum because I just got thrown a loop. I had recently completed my 3rd disability claim (I now have a total of 30% disability) & everything seemed fine. However, it's been "complete" on Ebenefits for 3 weeks & I was still awaiting a written notification & my backpay...however, I called the 1-800# twice & the reps kept claiming that everything should be fine. However, today I just got a letter in the mail saying "the VA recently sent you a letter explaining that you were overpaid $11,000"...first off, I never received a letter saying anything about that (that's not too surprising though). Second, I have …

Do I have access to VA examiners' decision documents?
I received my VA disability claim decisions (one service-connected at 0% and the rest denied). In review, of VA's "breakdown " of making their decision on my denied disabilities, I noticed two disabilities had the following remarks: "Service treatment records show that _______ manifested while in the service." I mentioned these conditions based on my VA and private medical records, but was surprised, that it was mentioned in my service records. I "combed" through my service treatment records but cannot find such entries. One of my questions, where in my service records did they find these existing conditions? I am going to appeal, but can I as a Veteran, have acces…

Appeal Rating Decision or Begin New Claim
Do I appeal a denial in recent decision rating July 25, 2016, or start a new claim? One of my claims was denied because I tied it to the wrong service connected issue. I am service connected sleep apnea and restless legs. I've always considered them as one. My claim was for an acquired neurocognitive disorder (memory loss) as secondary service connected condition which I wrote up under sleep apnea instead of restless legs. VA denied claim because of no evidence under sleep apnea. I've experienced memory loss from being on clonazepam for 20 years to treat restless legs. The memory loss was diagnosed by a VA psychologist specializing in memory loss in on…

Ebenefits says my appeal is still at regional office.
I had my denied claim denied a second time at the regional office even though I asked it be sent to the BVA. Now it's been about 450 days since that last denial. I did form 9. The claim was started around 2011.
