ptsd DRO APPEAL/ NOD/HOUSEBOUND
Been reading this site for years. Great Info. Just joined today. I applied for SMC s Housebound in April 2015. Got Denied in July 2015. I filed A NOD for a DRO Hearing. NOD dated Aug 4, 2015. I represent myself. Since june 2009 rated 70%, P&T, TDIU, SMC k. For Severe Chronic PTSD, Panic Disorder with Agoraphobia, Severe Anxiety, Bi-Polar, Depression. All Service Connected. **I Already know that I Do Not qualify for SMC s rate on the 100%, plus 60% rule!!** I am In fact Housebound. Last Sept the DRO sent for a C&P/DBQ. 3 days after that I went on Myhealthevet read the report. All In My favor all positive. I asked my VA Psych…

Brugada Syndrome w/ AICD Implant Rated 10%
http://www.va.gov/vetapp16/Files3/1619696.txt ^^^^ That is my decision letter from the bva judge. On ebenefits it is rated 10% for brugada syndrome WITH AICD IMPLANT now they didnt rate it correctly i filed a notice of disagreement an idk if she sent it to the DRO or to the other option... how long do I have to wait for them to fix their mistake another 4-5 years!?

NOVA Attorney Information/Recommendation
Well I received my SOC today on 11 different Pending Disabilities. Of course they were all denied even with three DBQ's and NEXUS letter from my physician. I have a call into Jamie Olivares a NOVA Attorney in Olympia, WA. Just wondering if anyone has ever worked with her, the law offices of Elie Halpern & Associates PLLC, or if anyone has a great recommendation for a VA Attorney. Thanks... James

Opinion Needed..............
A buddy of mine received his Big Brown Envelope and was highly disappointed. He filed a claim with the following issues: left hip, left knee, left thigh, and Restless Leg Syndrome. He was denied for the knee, hip, and RSL. His wife asked me to look at the SOC and afterwards I was surprised by two things. In bold letters there was a statement: FULL GRANT OF BENEFITS- the left femur stress fracture (previously claimed as left thigh condition) is currently being worked and a decision will be sent soon. Back Prorated Disability Compensation
In 2007, I was granted 10% disability for a severe leg injury sustained while on active duty as a reservist. In 2008, I did more active duty time and was told that I would not rate both disability compensation and my salary on active or reserve duty. I thus had it suspended. About two years ago, I discovered that I did in fact rate disability compensation while in a drilling reserve status and that the amount would be prorated based on the number of drills each month. Consolidated claims
Hello, Is it standard procedure for an opened CUE claim (final 2 year old claim) to be closed and consolidated with a current appeal claim for the same condition? It is my understanding that a decision should be issued by the VARO and a NOD filed by me before the claim can be placed in appeal status. Any feedback from anyone will be greatly appreciated.. Getting My C-File
Need to file a NOD on a recent Tinnitus claim denial. Sent in a request, FOIA etc., for my C-file. VA acknowledged receiving my request on Ebennies and shows a date of 2018 when I can expect them to make a decision as they have my request categorized as a new claim. I was thinking I read where there are specific deadlines requiring the VA to meet my demand for the C-file. Anyone know what the time frames are requiring the VA to comply?

hypertension VARO sent remand appeal back to BVA without adjudicating the entire claim
The BVA remanded my claim back to VARO, two years ago. The remand order was for VARO to develop and adjudicate my claim, well about a year ago they did adjudicate my hypertension, and about six months ago I had C & P Exams done for my kidney and sleep apnea, so I contact the VARO in June 2016, and reminded them that my remand was about 2 years old, and when were you all going to finish adjudicating it, so they told me, we're trying to get everything together here very shortly. 1st Time CAVC
My 1st trip to CAVC with Attorney representation and 5 appeals were remanded :) Apparently both Attorneys for the VA and CAVC both agreed I had been screwed in my decisions dating back to 2007 . Lots of emphasis on bad c&p, and reasons and basis lacking....I am grateful to a awesome law practice....

Reconsideration vs. DRO Review vs. BVA Appeal
Hello, I have a claim that is getting ready to resolve where I requested an increase and it will not be granted. Will not be lowered, but will not be raised. 10% for Asthma. The ratings for Asthma state 30% for daily inhaler use. I take Symbicort 2 times a day and also meet the criteria for 60% (3 exacerbation with prednisone from 1/2016 to 5/2016).
