Viewing Specific Evidence Listed In Statement Of The Case (Soc)
Hi, It's tough deciding whether to file Form 9 to appeal when I am not sure exactly what evidence was cited and conclusions made about that evidence. The SOC has a laundry list of material but no specific citations, just general statements. How can I file a Form 9 stating why I am appealing when I don't know what the case is? Is there a way to view other peperwork used by the VA for my case? Thanks!

Appealing A Dro Decision
Hello to everyone and thanks for serving. I recently received a DRO Decision (took 4 years to get this decision) but I do not agree with the effective date that was given. I sent a NOD for an earlier effective date . My question is, "Will this NOD of the DRO Decision also take this long - 3-4 years?" I know that any opinion will be a WAG. I have never been this far in a claim. Thanks for all of the great advice that I have received in the past. BigRed

Where Do I Appeal?
I filed my claim through the Chicago Regional Office, as I was living in Illinois at the time. I have since moved to California. My claim is at the Preparing for Decision phase now. If, when, I need to appeal do I do it through the Regional Office here or Chicago? How do I get any appeals or claims moved to my new location? Just trying to be ready ahead of time.

Your Opinion &thoughts -Sc Ankle And Shoulder Disability
1989-I was medically discharged for eczema and rated at 10% service connected. 1999 and 2000-The VA rated my ankle (5271-Moderate Ankle Limited Motion) at 10% and shoulder (5202-Dislocations) at 20% service connected. Total rating: 40%. Oct 2012-I filed for reevaluation and increase for all three service connected disabilities. Mar 2013-C & P Exam. Examiner stated that x-rays will be order. I was never contacted or afforded the opportunity to have x-rays done according to the examiner. Aug 2013-Received VA Decision. Should I Appeal
Hello, I was just awarded 10% for Tinnitus and 0% for bilateral hearing loss. I feel blessed to get this but should I appeal. I have been out of the USCG since 1972. I opened my claim August 2013 for these issues and one other that I have got to get more proof of. SC was granted for both hearing and Tinnitus but I assume they felt the hearing wasn't bad enough? The ENT that performed my C&P said that I was a certain candidate for hearing aids. My personal Doctors records indicated long term hearing & tinnitus issues back to the 70's and he provided a Nexus letter that indicated that. Well it's been 40 months and all I've received is denial. Haven't heard from va in over a year, not surprised my visor told me it will be at least 4 more years before my case is seen again by a human. Va benefit is like Bigfoot I've heard it exist but I have my doubts..lol have to smile

ptsd Reconsideration/re-Open Update
70% PTSD, SSDI I was rated 70% last year and sent in my application for TDIU. I was given another C&P and was denied an increase. I then decided to submit a NOD. While my NOD was sitting in limbo on stage 1 on ebenefits for months I was approved for SSDI based on my service connected mental health disorder. I called Peggy and they said I can submit my "New Evidence" and ask them to reconsider my denied increase. I put together a pretty simple request to reopen my denied claim and consider my new evidence. It has been exactly 40 days since they received my request at the regional office. Claims Denial ?"request For Reconsideration"?
Where is there any VA REG in 38 CFR 3 or anywhere else that addresses "Request for Reconsideration?" Is this just a "well intentioned VSO" theory?" I recently advised a VET that was at the end of the 11th month after his "Denial Letter," to immediately file his NOD requesting DRO personal hearing so as not to loose his appeal right and keep his claim alive. In response, they were worried about the NOD filing derailing their "Req for Recon" that had been pending for many months. My opinion based on that discussion, the VET's VSO is at fault. ptsd Effective Date Help
I was originally 80% service connected for a litany of issues but 70% for ptsd. I was going to the psych and was given medication which i had bad side effects from. After telling the dr over and over again I finally stopped showing up. I would get notices from the va and simply throw them away without looking at them. Well in 2009 I was reduced from 80% total to 70% total. Fast forward to 2014 and the va was actually shorting me on the 70% money and in speaking to the VSO they said I should ask for an increase because my symptoms at the time had been worsening. Help With Wording Of Nod, Please
I'm ready to do a NOD for my husbands claims. Talked with VSO and not really sure about having them do it. They said they would do it and send to DAV to submit. From the info I've gotten here, the general consensus seems to be to send by return receipt. Especially important since my husbands one year is up on Sept 19. I'm also wondering if I would likely be able to include a more thorough NOD. Just need to make sure to include all necessary wording and requirements. Would appreciate input into what to include and best way and order to say it. Also, should there be a separate NOD for each condition? They were all on one claim.
