Still Haven't Received Anything To Sign
We got a letter today that says that his claim for bilateral vision loss is inextricably intertwined with his appeal for stroke secondary to ischemic heart disease. It goes on to say that since these two issues are intertwined his claim for bilateral vision loss will be addressed with his appeal. He put in the appeal back in September 2013 and we were told in January that we would be getting something for him to sign and send back. This thing is just so frustrating. My father called his VSO in March and was told that it takes several months to get the forms to sign. It's now been 7 months since he filed his NOD. He's going to talk to his VSO on Tuesday to see if …

Lawyering Up For A Fight With Bva Over Eed
Well finally found a lawyer I hope will help me win the proper date for my hearing loss claim. Here is actually in Co. but has office here in DC so planning on sending back the form 9 shortly then I guess he will take over for the duration. One thing I like about him right of is he answered my email right on a Sat. so sounds to me like he is serious. Ill will keep update but got by SOC last week after spending close to a year for recon that did not work filed the NOD and that took right on another year! Did not want to go the CUE route but looks like that is what he plans on doing so we will see how this works out, Stillhere

Received 5103 Notice For Remand - Questions....
Good afternoon, Well, I finally received the notice to respond with more support for remanded items from my appeal. I started digging through my copy of my c-file to see if there were any documents the VA asked for that were already in the file. Much to my surprise, I found reports from my STRs that were from the '80s (which the VARO said did not exist in previous decisions, this appeal, etc...) that support my issue that a condition started surfacing while on my initial enlistment. This supports my contention that the issue did NOT pre-exist service, but brings something else to light: if the records are in my hands as part of my c-file, is it a CUE that the VARO nev…

My Bva Video Conference Hearing
I had my Live Video BVA hearing on Tuesday. Upon entering the conference room, I had a severe back spasm and almost fell, ( my representative actually had to help me sit in the chair). The whole time during the hearing all I could was lean side ways on the conference room table due to my spasms hurting so severely. I had an appeal in regards to me already being service connected for lower back issues, but was trying to get my upperback and cervical issues service connected. In my files it doesn't state that I ever really complained about upper back and cervical issues. But when i complained of the issues to a doctor at the troop medical clinic, he just simply st…

So...where's The Soc?
I'm getting a little concerned. I submitted a NOD, at the end of December, postmarked the day prior to the one year cut off from a claim that had been denied. Previously, based on the advice of a VSO, I'd submitted a reconsideration request claim. Because the claim processing was going to extend beyond the year deadline, I submitted a NOD appealing the denied claim's decisions to protect that original claim. Most of the areas of disagreement were covered by the request for reconsideration. The claim closed 2 weeks ago, and my combined rating increased from 60% to 80% according to eBenefits. But there's no decision letter and no SOC. Given 60 days to respond to a SO…

Which Way To Go
I recently had a claim erroneously closed out by the RO. I had appealed the recent denial of IU based on 30% service connection for coronary artery disease heart surgery x2 pace maker implant and development of atrial fibrillation recently. While awaiting for them to clear up the mistake I reopened my claim for increase based on new evidence which was the Vocational rehabilitation denial because of my heart condition and my foot conditions rated at 10%. I did not have the denial prior to them denying me so I opened a new case just in case they never found the mistake they made. I learned today that they indeed found the mistake and my appeal is back in the system. My que…

Dro Appeals
I will never ask for another DRO hearing or review again almost 4 years and he still didn't want to make a decision. The only thing could have help 2 months of calling congressman,202#,white house, iris, 800# appeals since 2010 still no info receive 3 years. All words wasn't kind either so I move from one line to the other ssoc was issue have not receive it yet but from whats been happening lately another 2-3 years for BVA just wasted 4 years for a a dro review never again I learn the hard way. Probably took them 4 years to come up with this lie to denied me a EED so I wait some more

Received My Soc This Week Have Questions
I received my. SOC this week, but it only mentions and addresses three secondary complaints which they denied as no tie to original complaint. The official NOD filed on this listed the primary issues and three secondary issues, linking them together. I am confused if this is a screw up by the DRO or what, Not sure how to address this since original complaint not mentioned in the SOC? Is this a CUE situation on filing appeal with BVA?

Could Rating Letter Narrative Be Used In Nod?
I was looking over my old rating letters and notice that the narrative for PTSD included sleep disturbances. So could past rating letters be used as evidence in support of my sleep apnea NOD? I know it sound strange, but sometimes I wonder if the VA reads their narratives. What do you think?

hypertension Va Re-Opened My Claim
Hello, everyone out there! I have question maybe someone could answer. In Dec 1994 I was transferred to Japan to a new ship. Four months later I was removed from the ship because they told me they think I had a stroke. Well I was diagnosed with Atherosclerotic Ischemic heart disease. I was placed on light duty on the base, and then 5 months later they sent back to the states. They ran all sorts of tests on me and even sent me to a shrink. My problem is that as I was on my way to a medical appointment at Balboa hospital I got rear-ended by a truck about 4 blocks away from the hospital. My car didn't get totalled but my right leg was on the brake and my hip got pushed out o…
