I am 100% SC for Diabetes with retinopathy and have applied for SMC for bilateral frozen shoulders that are caused by my Diabetes, my Diabetes physician has provided the nexus letter that is with my claim. I am trying to understand where I might end up in the SMC area, I have loss of use in both shoulders. Thanks for any information.

The BVA remanded my claim for loss of use lower extremities to the RO via appeals management center 3/13/2014 the reason being they say the records show I have never been afforded a VA examination I filed this claim 12/2008 on 3/11/2010 i had a VA compensation & pension examination which has been totally OverLooked by the RO,reconsideration and the BVA. It was remanded from the CAVC 6/13/2013 informing them of there mistake . The Court states they made the error for overlooking the favorable evidence therefore i think a decision should be made with the overlooked evidence not a new examination. Below the Court Conclusion. The March 2010 VA examiner opined that Mr. x…

I was awarded 70% PTSD, IU, then 50% for Chronic Sinusitis, 50% for migraines, 10% for HBP in 2007. Would these ratings qualify for SMC or must the award be 60% beyond the 100% with IU? Thank you.

Hello all, My father, a Vietnam veteran, is 100% disabled (permanent and total) from agent orange exposure, which resulted in a severely weakened immune system. In about 2010 he was diagnosed with Alzheimer's, and it has progressed rapidly. He is very confused, and we currently have him on a waiting list for a veterans only home (I would do anything, and I mean ANYTHING to prevent this, but it is clear now that he can't stay at home much longer). Although the VA will pay the cost for the home, he may not get in for 6 months or so and the financial situation isn't good. I am wondering if he may qualify for Aid and Attendance. While he is not bedridden, he can not b…

Hello Fellow Members, I am in the process of discharging my attorney's who quite frankly are not earning their pay. I was awarded TDIU in 2009 and have been on appeal for A&A and or Housebound ever since. An old service officer I ran into yesterday questioned something and I wanted everyone's input. In addition to trying to get housebound because I'm housebound the service officer questioned as why I was not receiving SMC S for my TDIU + other conditions. So here is the deal. The verbiage used in awarding my TDIU was as follows: It is as least as likely as not that the Veteran is unable to sustain gainful employment solely based on his mental condit…

I have a C&P exam coming at the end of this month that I requested for A/A. Currently I am rated at smc (M), but is that automatically include regular A/A? When I was discharged from the hospital last December I went to the P.V.A. NSO and requested for a higher level A/A, E-Benefits just list the C&P exam as A/A. There are different opinions on this matter, and it is certainly confusing at this level. I have heard you have to be at the maximum rate (o) to receive a higher smc r1 or r2, it is r1 I was asking to get any thoughts? I have attached my last rating decision for anyone to look at and give me direction and I was awarded the right decision? Thanks! …

Question, I am a vet with a 100% P&T rating based on several ratings that combine to 100%. In addition I have other disability ratings not related to the above that combine to over 60%. My reading of the criteria for an s rating is that you must have a single disability rated as total and then the additional unrelated 60%. I have never been TDIU or housebound. Based on the statutes it appears the I don't qualify for the s rating. Please correct me if I am wrong. Thanks courier71

I been looking at e-benifits for a while. I go to download Va. letters and click on benifit summary letter and sumary of benifits information. Prior to Jan. 6 2014 the letter has said I have loss of limb. On Jan 8 2014 The letter says: You are in receipt of special monthly compensation due to the type and severity of your service conected disabilitys. I have no clue as what they are telling me. A few months ago I got rated 30 or 40% For my arm. Perhaps that is why. If anyone knows please help me to understand. Thank you!

Hi, my name is Carolyn Moore and my husband is 100 percent disabled with need of Aid and Attendance. He has been granted disability since 2007. I have to stay home with him as he cannot stay alone. I am trying to get A and A. It looks as though I am going to require a private doctor to get a report and exam for his case. Does anyone know where I can find one? Thank you. P.S. how do I change the password from the one emailed to me please.
